Resumen

GR-MAR-01 es la vía de naturalización reducida de 3 años para cónyuge de un griego, disponible SÓLO cuando hay un hijo del matrimonio (τέκνο). A partir de 2026 (Código refundido codificado el 17-9-2025), se trata de un caso de naturalización ordinaria (Arts 5-9 ΚΕΙ) con el reloj de residencia reducido de 7 a 3 años continuos. El matrimonio en sí no confiere nacionalidad (artículo 31); el cónyuge debe naturalizarse.

Quién califica

Eligibility requires (i) a subsisting valid marriage to a Greek citizen AND (ii) a child of the marriage, plus the Art 5(1) formal preconditions: adult at the naturalisation declaration (a), no disqualifying conviction under the serious-crime catalogue (b), and no deportation/legal-stay uncertainty (c). All conditions are assessed as of the current consolidated Code (2026).

  • Eligible — naturalises on the 3-year reduced track; acquires Greek nationality on the oath.

    Art 5(1)(δ) 3rd subparagraph grants the 3-year continuous-residence reducer to ‘τους συζύγους Έλληνα ή Ελληνίδας με τέκνο’. She is a spouse of a Greek WITH a child of the marriage, holds a definitive title for 3+ continuous years (GR-EV-043), and meets the Art 5(1) formal preconditions, Art 5A integration (ΠΕΓΠ passed), and Art 5B security bar. Marriage itself confers nothing (Art 31); acquisition is on the oath (Art 9).

  • NOT eligible for GR-MAR-01 — routed to GR-MAR-02 (general 7-year track); cannot yet naturalise on the 3-year basis.

    The reducer is conditioned on a child of the marriage (‘με τέκνο’, Art 5(1)(δ)). With no child, the spouse benefit as a residence reducer does not apply; the general 7-year requirement (‘επτά συνεχή έτη’) governs (GR-EV-038/065). His 6 years are short of 7. The marriage still helps only as favourable integration evidence under Art 5A(1)(b). This child-conditioned split has applied since 24-3-2010 (L.3838/2010).

  • Eligible — the abroad time on the Greek diplomat-spouse's posting counts toward the 3-year period.

    The final clause of Art 5(1)(δ) provides that for spouses of Greek diplomatic/consular servants, time spent abroad due to the Greek spouse's official duties counts toward the required period, provided the foreign spouse has completed at least 1 year of residence in Greece (GR-EV-066). With a child of the marriage she is on the 3-year track, and the diplomat-spouse counting bridges the residence requirement.

  • Eligible on the 3-year track; pays the reduced €100 naturalisation fee category; marriage alone does NOT confer nationality.

    Spouse-with-child satisfies Art 5(1)(δ) for the 3-year clock; his definitive omogenis residence title (excluding ΕΔΤΟ) qualifies under Art 5(1)(ε) α)στ) (GR-EV-043). As an ομογενής he pays the €100 fee category (e-paravolo 2161) rather than €550 (GR-EV-046). Marriage is nationality-neutral (Art 31); he must complete the full naturalisation including ΠΕΓΠ unless exempt under Art 7(4).

  • Not yet eligible — must complete 3 continuous years of lawful residence and obtain the ΠΕΓΠ certificate first.

    Even with a child of the marriage, the 3-year reduced track still requires 3 CONTINUOUS years of lawful residence on a definitive title immediately before filing (Art 5(1)(δ); GR-EV-039/043) and the ΠΕΓΠ as a substantive precondition (Art 6(2)(γ)/7(2); GR-EV-048). At 1.5 years and without the certificate, the application is premature; she should accrue the residence and sit the ΠΕΓΠ in its twice-yearly cycle before filing.
