Elegibilidad
The One-way Permit (Permit for Proceeding to Hong Kong and Macao) is the family-reunion route for Mainland residents settling in HK. It is administered under Mainland law/policy via the Exit-Entry Administration of the Ministry of Public Security at the applicant's household-registration locality — it is NOT an HK-issued residence visa and not part of HK's own Immigration Ordinance. Basic Law Art.22(4) requires Mainland-resident entrants to obtain such approval; per the NPCSC's 1999 interpretation. Holders acquire HK ordinary residence upon arrival, which starts the 7-year abode clock under Cap.115. The One-way Permit daily quota is 150 (set 1995, unchanged as of the most recent LCQ answer 2024-05-22), of which 60 are reserved for children born on the Mainland with HK right of abode by descent under Basic Law Art.24(2)(3), and 30 are reserved for long-separated spouses. • She would apply for a One-Way Permit (單程證) through the mainland-administered family-reunion quota scheme, which upon approval and entry to HK leads toward permanent residence.

The OWP is issued and quota-managed on the Mainland side (150/day national quota across all applicants, not HK-specific), distinct from HK's own abode framework — approval timing depends on the mainland administrative queue, not HK Immigration Department discretion.

  • OWP family-reunion applications are processed against a mainland-administered quota (150/day nationally) and timing varies; this is distinct from — and does not replace — any separate abode-by-descent claim (HK-DSC-01) the child might independently have if the child is itself a Chinese national with a category (1)/(2) HK-PR parent.

Do not conflate the two routes — a family should check whether HK-DSC-01 might apply directly (which is an HK-side registration, not a mainland quota process) before assuming OWP is the only path. Processing timeline is NLR-flagged, dependent on mainland administrative queue data not published by HK Immigration.

  • Elderly-parent family reunion is one of the recognised OWP categories; approval and quota allocation are administered on the Mainland side, with HK playing essentially no discretionary role in the OWP grant itself (only in subsequent HK-side registration once he arrives).

Clarify to the persona that this is fundamentally a mainland exit-approval process, distinct from any HK Immigration Department application — a common point of confusion.

  • This scenario raises significant complications — the sponsoring relationship (marriage) has ended by both divorce and death — such that standard family-reunion eligibility criteria may no longer be straightforwardly met.

This is flagged as a genuine NLR (no-legal-resolution-without-professional-review) case: eligibility likely depends on discretionary mainland/HK administrative review of the specific facts (custody arrangements, the child's own HK abode status, etc.) — do not present a definitive yes/no answer; recommend consultation with a mainland/HK cross-border immigration specialist.
