A minor child may be registered as a citizen on a parent's acquisition (Constitution s.92(1)(g) entitlement + s.92(2) parent/guardian procedure; Citizenship Act Cap 1.05 s.3(7)). The s.3(11)(m) refusal hook governs CBI-derivative minors.

Quién califica

  • Derivative minor registration (constitutional entitlement): a person under 18 who is the child of a citizen — or the child of a person who is, or would but for death have been, entitled to be registered as a citizen under any of the preceding s.92(1) paragraphs — is entitled, on application, to be registered as a citizen (Constitution s.92(1)(g)).

  • Minor registration is made on the minor's behalf by a parent or guardian; an application for registration under the Constitution s.92(1) by a person under 18 shall be made on their behalf by parent or guardian, save that a person who is or has been married may apply themselves (Constitution s.92(2)). - Statutory minor-application procedure: an application for registration under Citizenship Act s.3(2) or s.3(6) on behalf of a minor shall be made by the minor's parent or guardian, or by the minor themselves if the minor is or has been married (Citizenship Act Cap. 1.05 s.3(7)).

    Constitution s.92(1)(g): a person under 18 who is the child of a citizen (or of a person entitled to register under the preceding paragraphs) is entitled to register. The application is made on the minor's behalf by the parent/guardian (Constitution s.92(2); procedure in Citizenship Act Cap 1.05 s.3(7), Form R for minors). Derivative minor registration tracks the parent's acquisition.

    Citizenship Act s.3(11)(m) lets the Minister refuse to register a child of a person who obtained citizenship under s.3(5) (CBI) who applies under s.92(1)(g). In practice a CBI investor includes children as dependants in the CBI application itself (SRO 26/2023; SRO 20/2024), but a later standalone derivative registration is screened against the s.3(11) good-character/security grounds. Distinguishes ordinary derivative registration from the CBI-dependant channel.
