Ciudadanía en Saint Lucia

Elegibilidad
Cuando se dicta una orden de adopción respecto de un menor no ciudadano y el adoptante (o, en una adopción conjunta, cualquiera de los adoptantes) es ciudadano, el menor se convierte en ciudadano a partir de la fecha de la orden (Ley de Ciudadanía de Santa Lucía, cap. 1.04, artículo 7(1)). Automático por operación de la orden de adopción: no se requiere una solicitud de ciudadanía por separado. Distinto del registro ministerial discrecional de menores vulnerables según el artículo 7(2) (CBN-01). Un hijastro o un hijo adoptado menor de 21 años de una persona con derecho a registrarse tiene derecho a registrarse por separado (s.6(2)(d) / Const s.102(2)(d)).

Resumen

Where an adoption order is made in respect of a non-citizen minor and the adopter (or, in a joint adoption, either adopter) is a citizen, the minor becomes a citizen as from the date of the order (Citizenship of Saint Lucia Act, Cap. 1.04, s.7(1)). Automatic by operation of the adoption order — no separate citizenship application required. Distinct from the discretionary ministerial registration of vulnerable minors under s.7(2) (CBN-01). A step-child or adopted child under 21 of a person entitled to register is separately entitled to register (s.6(2)(d) / Const s.102(2)(d)).

Quién califica

  • Step-child / adopted-child registration entitlement: a person under the age of 21 years who is a step-child or adopted child of a person entitled to be registered as a citizen (or who but for death would have been so entitled) is entitled, upon application, to be registered as a citizen (Citizenship of Saint Lucia Act s.6(2)(d)). The Constitution carries the parallel entitlement for a stepchild or child adopted in a manner recognised by law of a citizen (Const s.102(2)(d)).

Cómo solicitar

  • An application for registration by a person under 21 falling within s.6(2)(d) (step-child / adopted child) may be made on his or her behalf by the parents or guardian. Where such a minor is or has been married, he or she may make the application personally (Const s.102(3) proviso; statutory parallel s.6(3) read with s.6(2)(d)).

    Where an adoption order is made in respect of a minor who is not a citizen, and the adopter (or, in a joint adoption, either adopter) is a citizen of Saint Lucia, the minor becomes a citizen as from the date of the order (Cit Act s.7(1); LC-ASSERT-018). Acquisition is automatic by operation of the adoption order — no separate citizenship application is required. A foreign infant adopted by a Saint Lucian citizen couple therefore acquires citizenship on the order's date. As of continuously since the Act in force (5 June 1979).

  • Eligible via LC-ADP-01: in a joint adoption it suffices that EITHER adopter is a citizen.

    The s.7(1) adoption rule applies where the adopter 'or in the case of a joint adoption either adopter' is a citizen (Cit Act s.7(1); LC-ASSERT-018). A joint adoption in which only one adopter is a Saint Lucian citizen therefore still confers citizenship on the adopted minor as from the date of the order — both adopters need not be citizens. As of continuously since the Act in force (5 June 1979).

  • NOT eligible via LC-ADP-01: the automatic-acquisition rule is confined to a MINOR who is the subject of the adoption order.

    Section 7(1) confers citizenship automatically only where the adoption order is made 'in respect of a minor who is not a citizen' (LC-ASSERT-018). An adopted person who is no longer a minor falls outside s.7(1). A separate entitlement exists for a step-child or adopted child UNDER 21 of a person entitled to register, who may be registered (s.6(2)(d) / Const s.102(2)(d), LC-CBN-01 / LC-ASSERT-019) — but that too is age-bounded. An adult adoptee would need an independent route (e.g. residence-based registration/naturalisation). As of continuously since the Act in force (5 June 1979).
