- אופן רכישה ייחודי במינו (sui generis). נזירים-מתחילים ונזירים אורתודוקסים זרים המתיישבים ומקבלים תספורת נזירית בהר אתוס רוכשים אזרחות יוונית אוטומטית (מכוח הדין) לפי משטר השלטון העצמי של סעיף 105, "ללא כל פורמליות נוספת" — ללא בקשה, ללא תקופת מגורים, ללא מבחן שפה וללא אגרה. המעמד הוא הפיך: ניתן לשלול מנזיר את האזרחות לפי סעיף 17(1)(γ) לקודקס האזרחות (שהוסף בסעיף 41 פסקה 4 לחוק 3731/2008) אם הוא נוטש באופן מוכח הן את מנזרו הן את הקהילה הקדושה של הר אתוס.

סקירה כללית
GR-SPC-01 הוא מסלול האזרחות הנזירית של הר אתוס (Άγιον Όρος). לפי סעיף 105 של החוקה, טירונים ונזירים אורתודוקסים זרים השוהים בחצי האי אתוניטי בשליטה עצמית רוכשים אזרחות יוונית ipso jure, ללא בקשה, ללא ספירת שנות מגורים, ללא מבחן שפה או אזרחות וללא תשלום. החל משנת 2026 (חוקה מתוקנת ב-25 בנובמבר 2019) המסלול פעיל והמעמד הנרכש ניתן לביטול על ידי קיפוח אם הנזיר ינטוש גם את המנזר שלו וגם את הקהילה הקדושה.

בסיס הרכישה הוא Constitution Art 105(1), משפט 3 (בתוקף; מתוקן ב-25 בנובמבר 2019), שהטקסט האופרטיבי שלו קורא "Όλοι όσοι μονάζουν σ" αυτό ατονττ ελληνική ιθαγένεια μόλις προσληφθούν ως δόκιμοι ή μοίχχς άλλη διατύπωση' (כל מי שמנהל שם חיים נזירי רוכש אזרחות יוונית ברגע שהתקבל כטירונים או נזירים, ללא רשמיות נוספת), יחד עם האמנה החוקתית של הר אתוס (ΚΧΑΟ), שאושררה על ידי חוק החקיקה של 6 בספטמבר-119. הטענה שהבסיס הוא 'חוק 945/1979' מתוקן: L.945/1979 הוא אשרור אמנת ה-EEC-הצטרפות (ΦΕΚ Α' 170/27.7.1979), ולא חוק אזרחות של הר אתוס.

Acquires Greek nationality ipso jure on tonsure, 'without further formality' — no application, residence count, language test, or fee.
Constitution Art 105(1), 3rd sentence: all leading a monastic life on Mount Athos acquire Greek citizenship automatically; applies to foreigners of any nationality tonsured on Athos (GR-EV-008).
Not eligible. Cannot acquire under Art 105 because she cannot be admitted to Athonite monastic life.
Admission to monastic life on Athos is reserved to Eastern-Orthodox persons and barred to women under the Charter (ΚΧΑΟ) and the avaton; Art 105 acquisition is conditioned on that admission (GR-EV-008, GR-SRC-213).
Exposed to deprivation (έκπτωση) of the acquired Greek nationality by Ministerial decision; status is revocable, not irrevocable.
Code Art 17(1)(γ), inserted by Art 41 §4 L.3731/2008: an Athonite novice/monk who abandons BOTH monastery AND Holy Community may be deprived; declared by Minister of Interior after Citizenship-Council opinion, effective on ΦΕΚ publication (GR-EV-009, GR-EV-011, GR-EV-078).
No deprivation. The (γ) ground is not triggered.
Art 17(1)(γ) requires abandonment of BOTH the monastery AND the Holy Community; an intra-Athos transfer that keeps the monk within the Holy Community does not meet the conjunctive condition (GR-EV-009, GR-EV-078).
If deprivation is declared, the consequent ID-card cancellation is a bound competence, but proportionality of the loss (including any loss of EU citizenship) must be reviewed before consequences attach.
ΣτΕ 18/2026: ID-card cancellation following nationality revocation is δεσμία αρμοδιότητα, yet proportionality review attaches under national law + Art 8 ECHR and, where EU citizenship is lost, per the Tjebbes/Rottmann line (CJEU C-221/17, Charter Arts 7 & 24(2)) (GR-EV-032, GR-SRC-136).
