Naturalisation under Citizenship Act Cap 1.05 s.6 + 2nd Schedule: residence two-limb aggregate (12 months immediately preceding + 14 years before that), good character, intent to reside, and oath of allegiance. NO language or civics test.

  • Ordinary naturalisation of an alien is governed by Citizenship Act Cap 1.05 s.6 (discretionary grant by the Minister) read with the Second Schedule (Section 6); the alien must be 'of full age and capacity'. The certificate of naturalisation takes effect, and the person becomes a citizen by naturalisation, only on taking the oath/affirmation of allegiance in the Third Schedule form, as from the date the certificate is granted. - British protected persons have a distinct naturalisation track (Second Schedule para 3): qualifications are (a) ordinarily resident in Saint Christopher and Nevis and so resident for a period of not less than 14 years ending with the date of application, plus (b) the good-character and intent-to-reside qualifications of para 1(c)-(d). This differs from the alien track in that it states a single 14-year ordinary-residence period ending at application (no separately stated 12-month immediately-preceding limb).

  • Naturalisation residence-counting and Ministerial relaxation: under Second Schedule para 2 the Minister may, in the special circumstances of a particular case, allow a continuous period of 12 months ending not more than 6 months before the date of application to count for the para 1(a) immediately-preceding limb as if it had immediately preceded that date. The Minister's grant or refusal is discretionary and, under Act s.13, the Minister need assign no reason and the decision is not subject to appeal or court review. - Ministerial discretion is ouster-protected: Citizenship Act s.13 provides that the Minister need assign no reason for the grant or refusal of any discretionary application under the Act, and that the Minister's decision on such an application is not subject to any appeal or review in any court. This governs s.6 naturalisation, s.3 registration, and refusals under s.3(8)/(11). (Constitutional registration ENTITLEMENTS under s.92(1) are by contrast subject only to the express defence/public-safety/public-order proviso.)

  • Qualifies for naturalisation under s.6 + Second Schedule (discretionary grant).

    Citizenship Act Cap 1.05 s.6 + Second Schedule para 1: an alien must have resided in SKN throughout the 12 months immediately preceding the application AND have resided in SKN during the 14 years immediately preceding that 12-month period (i.e. ~15 years' residence anchored by an unbroken final year), be of good character, and intend to reside. NO language or civics test. The grant is discretionary ('the Minister may') and ends with the oath of allegiance.

  • May still qualify if the Minister exercises the Second Schedule para 2 special-circumstances discretion.

    Second Schedule para 2: the Minister may, in the special circumstances of a particular case, allow a continuous 12-month period ENDING NOT MORE THAN SIX MONTHS before the date of application to count for sub-para (a), as if it immediately preceded the application. A 4-month gap is within the 6-month grace window, so the broken final year can be cured at the Minister's discretion.

  • NOT eligible — falls short of the Second Schedule residence.

    Positive disconfirmation. Second Schedule para 1(b) requires residence during the 14 years immediately preceding the qualifying 12-month period. Eight years cannot satisfy the ~14-year aggregate, and there is no general reduced-residence track for ordinary aliens (the CARICOM/Commonwealth registration routes also require 14 years). The applicant must accrue the full residence.

  • Qualifies under the simpler single 14-year test for British protected persons.

    Second Schedule para 3: a British protected person qualifies if ordinarily resident in SKN for not less than 14 years ending with the date of application, plus good character and intent to reside (para 1(c)-(d)). This is a single continuous 14-year ordinary-residence test, distinct from the alien two-limb structure (12 months + prior 14 years). Demonstrates the BPP carve-out.

  • Citizenship is not effective until the oath is taken, and the oath must be taken within one year of the certificate.

    Citizenship Act s.6: the grantee becomes a citizen by naturalisation 'on taking the oath or affirmation of allegiance' (Third Schedule). The Regulations require the oath to be taken within one calendar year of the certificate of naturalisation. An 18-month delay puts the applicant outside the prescribed window, jeopardising the grant. Edge case on the oath-timing condition.

  • Refusable under s.3(11)(e) — likely to become a public charge — notwithstanding satisfying the residence test.

    Citizenship Act s.3(11)(e): the Minister may refuse to register a person who, NOT being the dependant of a citizen of SKN, has not sufficient means to maintain himself or herself and is likely to become a public charge. Meeting the residence and good-character qualifications does not guarantee the grant; the s.3(11) refusal hooks (good character (a), serious conviction (b), prejudicial activity (c), undischarged bankruptcy (d), public charge (e)) apply to s.92/registration applicants. A self-sufficiency screen that applies beyond the CBI and marriage routes.
