A Commonwealth citizen (First Schedule countries) may register after 14 years' residence (Constitution s.92(1)(b) / Citizenship Act Cap 1.05 s.3(3)); a discretionary entitlement distinct from s.6 naturalisation.

  • Commonwealth-citizen registration: Constitution s.92(1)(b) entitles any Commonwealth citizen who, being ordinarily resident in Saint Christopher and Nevis, has been so resident for the 14 years immediately preceding the date of application, to be registered as a citizen. This is by REGISTRATION (not naturalisation) and carries the same 14-year residence floor as the alien naturalisation track — it is NOT a reduced-residence track. - Statutory parallel to s.92(1)(b): Citizenship Act s.3(3) lets a citizen of any First-Schedule (Commonwealth) country of full age and capacity be registered at the Minister's discretion if the Minister is satisfied the applicant (a) has been ordinarily resident in SCN, or (b) has been in Government service, or (c) had partly such residence and partly such service, for a period of not less than 14 years immediately preceding the application date. Government service can substitute for residence within the 14-year count.

  • Ministerial discretion is ouster-protected: Citizenship Act s.13 provides that the Minister need assign no reason for the grant or refusal of any discretionary application under the Act, and that the Minister's decision on such an application is not subject to any appeal or review in any court. This governs s.6 naturalisation, s.3 registration, and refusals under s.3(8)/(11). (Constitutional registration ENTITLEMENTS under s.92(1) are by contrast subject only to the express defence/public-safety/public-order proviso.)

This historical-territorial crediting can complete the 14-year residence for the Commonwealth registration route. Niche but primary-grounded edge case.
