There is NO eligibility to state, because there is no statelessness route to qualify for — this section documents the disconfirmation, not a pathway. A stateless person present in India cannot point to any provision of the Citizenship Act 1955 that grants nationality on the ground of statelessness. In particular: a foundling (a child of unknown parents found in Indian territory) is NOT deemed a citizen, because §3 confers citizenship by birth only through the enumerated parent-citizenship / non-illegal-migrant conditions and contains no foundling presumption; and a child born in India who would otherwise be stateless has no safeguard clause in §3 or §4. A stateless person's only theoretical routes to Indian nationality are the GENERAL ones (naturalisation under §6 + Third Schedule, or registration under §5 where a category fits), which are not statelessness-specific and impose the ordinary residence, character and language conditions. There is no reduced threshold, no waiver, and no determination procedure keyed to statelessness. (As of 2026-07.)

There is NO statelessness procedure in Indian citizenship law as of 2026-07 — no statelessness-determination procedure (SDP), no dedicated application form, and no administrative mechanism to recognise or naturalise a stateless person as such. Because India is not a party to the 1954 or 1961 Conventions, it has not enacted the identification-and-protection machinery those instruments contemplate. UNHCR India operates statelessness programming precisely BECAUSE there is no domestic framework. Any stateless person seeking status must use the ordinary Foreigners Act / visa processes for stay, and the ordinary §5 registration or §6 naturalisation processes for nationality — none of which is triggered by, or adapted to, statelessness. The §13 'certificate of citizenship in case of doubt' is a discretionary Central-Government power to resolve doubtful citizenship, not a statelessness remedy. (As of 2026-07.)

Autoridade competente

No authority administers a statelessness route, because none exists. The Ministry of Home Affairs administers the general Foreigners Act framework under which stateless persons are treated as foreigners, and the ordinary §5 registration / §6 naturalisation processes. UNHCR India provides external statelessness programming and advocacy in the absence of a domestic framework. The UN Secretary-General (as depositary) maintains the 1954 / 1961 Convention party lists from which India is absent. No Indian court has read a statelessness safeguard into §3 or §4.
