Who qualifies

§10 Act 186/2013 Sb. provides a narrow jus soli ("right of soil") rule limited to foundling-statelessness avoidance. A child under 3 years of age found on Czech territory whose identity cannot be established acquires Czech citizenship by operation of law (ze zákona) on the day of finding. The rule operates as the principal Czech compliance mechanism for the 1961 UN Convention on the Reduction of Statelessness Article 1 obligation.

Operative conditions:

  • Child is found on Czech Republic territory (any age under 3 years; the under-3 threshold is critical for this specific provision)
  • Child's identity cannot be established (parents unknown; no parental documentation available)
  • Acquisition is by operation of law (ze zákona) — no application required; the matrika and child-protection authorities document the citizenship attachment
  • The "until-disproved" principle: if parents are subsequently identified, the foundling's CZ citizenship may be reassessed depending on parents' citizenship at moment of birth

A second provision under §11 Act 186/2013 addresses foundlings over 3 years (or where age cannot be determined) — broader investigative procedure required; less automatic.
