Legal basis

IE-DSC-07 concerns INCA 1956 s.11A ('Citizenship of children born as a result of DAHR procedures or surrogacy'), a discrete statutory section conferring Irish citizenship on children of donor-assisted human reproduction (DAHR) and surrogacy via the Children and Family Relationships Act 2015 (CFRA 2015) parentage machinery and via parental orders under the Health (Assisted Human Reproduction) Act 2024. The inserting provision is s.226 of the Health (AHR) Act 2024 (18/2024) (the inserted section is s.11A; the inserting section is s.226). CRITICAL STATUS ANCHOR: s.11A is NOT COMMENCED as of 29-May-2026 (revisedacts annotation 'Inserted by Health (Assisted Human Reproduction) Act 2024 (18/2024), s. 226, not commenced as of date of revision', re-verified 2026-05-30); it confers no present entitlement. Operative architecture (once commenced), four subsections: s.11A(1) 'parent' includes a CFRA 2015 s.5 parent of a child born in the State; s.11A(2) where an Irish citizen is declared under CFRA 2015 s.21 or s.22 a parent, the child (if not already Irish) shall be Irish from the declaration date; s.11A(3) parental-order limb (Health (AHR) Act 2024) where an intending parent is an Irish citizen; s.11A(4) applies to a child born before or after commencement (retrospective). No phantom Acts: the inserting instrument is Act 18/2024 (no standalone 'INCA 2024'); the parental-order limb depends on Act 18/2024 Parts 11-13 (ss.66/103/205/217), uncommenced.

Example scenarios

  • ineligible

s.11A (DAHR/AHR-parentage citizenship) was INSERTED by the Health (Assisted Human Reproduction) Act 2024 (18/2024) s.226 but is NOT COMMENCED as of 29-May-2026 (Parts 11-13 uncommenced; AHRRA established 13 Oct 2025 per S.I. 469/2025). Until commencement it confers nothing (operative_today=false; NLR-IE-02). DO NOT assert s.11A as operative law. Context: X./Z. [2025] IEHC 214 (Phelan J) held the lacuna for the non-genetic Irish parent breaches Art 40.1 (route-differentiated; appeal status NLR). [Pins: INCA 1956 s.11A (uncommenced); Act 18/2024 s.226; X./Z. [2025] IEHC 214] [Route operative_today=false]

  • conditional

Although s.11A is uncommenced, the GENETIC-mother scenario may be addressed under s.7(1) NOW via X./Z. v Min for Foreign Affairs [2025] IEHC 214 (Phelan J, 11 Apr 2025): s.7(1) 'parent' is read TO INCLUDE a genetic mother recognised under the law of her domicile (interpretive remedy, double-construction rule) — NOT a blanket strike-down (VC-IE-descent_s7_fbr-02). So a genetic-mother claim may succeed under s.7(1) descent; the non-genetic-parent lacuna remains pending legislation. Appeal status = NLR-IE-descent-01. [Pins: INCA 1956 s.7(1); X./Z. [2025] IEHC 214; A,B&C [2023] IESC 10]

  • ineligible

Cohort-distinctive uncommenced-section trap: s.11A (DAHR/surrogacy) is INSERTED (Act 18/2024 s.226) but NOT COMMENCED as of 29-May-2026 — it is NOT operative law and cannot be relied on (NLR-IE-02). For non-genetic intended parents, s.7(1) does not assist (A,B&C [2023] IESC 10), and the X./Z. [2025] IEHC 214 finding was that the State's FAILURE TO LEGISLATE this lacuna breaches Art 40.1 — a declaration about the lacuna, not an operative conferral. So no citizenship currently. [Pins: INCA 1956 s.11A (uncommenced); Act 18/2024 s.226; A,B&C [2023] IESC 10; X./Z. [2025] IEHC 214] [COHORT-DISTINCTIVE: DAHR surrogacy + uncommenced §11A]
