Who qualifies

  • Japan-born stateless simplified naturalization (Art. 8(iv)): a person born in Japan who has been STATELESS since birth, with 3+ years' continuous domicile since birth, may be naturalized with Art. 5(1)(i), (ii) and (iv) conditions waived. - Positive N/A on the conventions — Japan is a non-party to the 1954 Convention relating to the Status of Stateless Persons, the 1961 Convention on the Reduction of Statelessness, and the 1957 Convention on the Nationality of Married Women (depositary-verified); there is no treaty-based statelessness route to nationality. - Despite non-party status to the statelessness conventions, Japanese domestic law provides limited statelessness safeguards: Art. 2(iii) confers nationality at birth on a child born in Japan whose parents are both unknown or stateless, and Art. 8(iv) provides simplified naturalization for a Japan-born person stateless since birth with 3+ years continuous domicile.

Timeline

  • When naturalization is permitted, the Minister of Justice publishes a public notice (告示) in the Official Gazette (官報), and the naturalization takes legal effect on the date of that gazette notice (Art. 10(1)-(2)). - After naturalization takes effect on the gazette-notice date, the new Japanese national must file a notification of naturalization for koseki entry within 1 month (Family Register Act Art. 102-2), creating or joining a family register.
