This is broader than standard naturalization (no residence requirement) and operationally the primary pathway for multi-generational diaspora descendants seeking MD citizenship documentation.
Law 253/2025 introduced COHORT-FIRST tightening by mandating Romanian language + Constitution knowledge for ALL acquisition modes via Article 15 — including Art. 10 recognition. Previously under Law 1024, language was required only for naturalization (Art. 17(1)(c)). Who qualifies
Applicant must be:
- Aged 18+
- Demonstrate Romanian language + Constitution knowledge (Art. 15 — NEW universal requirement)
- Lack proof of current MD citizenship (deține dovada cetățeniei)
- Fall into at least one of categories (a)-(d):
Category (a) — Territorial birth
Persons born on MD territory OR at least one parent or grandparent born on MD territory.
Category (b) — Pre-1940 Bessarabian residents
Persons who until 28 June 1940 (Soviet annexation date) resided in Basarabia, Northern Bukovina, Hertsa region, and the RASSM (Moldavian Autonomous Soviet Socialist Republic), and their descendants. This connects to Romanian Kingdom citizenship under Law 724/1924 — the historical anchor for current claims.
Category (c) — Deportees and refugees post-28.06.1940
Persons deported or refugees from MD territory beginning 28 June 1940 (Soviet annexation), and their descendants. Covers Stalin-era deportations, post-1944 Soviet repressions, and 1990-1991 Transnistria conflict displacement.
Category (d) — 23 June 1990 residents
