As the Bilaterales III package is not yet operative (pending ratification), there are no currently applicable eligibility criteria deriving from this instrument. Upon entry into force, the amended FZA will produce the following changes relevant to citizenship analysis:

  1. Dynamic acquis alignment: EU nationals in Switzerland will benefit from the updated free-movement framework incorporating Directive 2004/38/EC elements (e.g., enhanced permanent residence rights after 5 years, improved family-member rights). This does not alter BüG Art 9's 10-year federal residence requirement.

  2. Professional qualifications: Updated Annex III recognition of professional qualifications will align more closely with the EU Professional Qualifications Directive (2005/36/EC as updated), potentially facilitating labor-market integration for EU nationals — a factor in meeting BüG Art 12 economic integration criteria.

  3. Workers' rights: Updated provisions on posted workers and coordination with current EU labor directives may affect terms of employment for EU nationals and indirectly the economic integration component of naturalization assessment.

  4. Enhanced dispute settlement: The new binding DSM may result in changes to how CH applies EU free-movement law — if the arbitral panel finds CH's administration of the FZA non-compliant, CH may be required to adjust its administrative practice in ways that affect the B/C permit qualification process.

  5. Social security coordination: Annex II social security update to align with current EU social security coordination regulations (post-883/2004 amendments), affecting accumulated social insurance periods relevant for pension entitlements — indirectly relevant for the economic independence component of BüG Art 12.

CH Federal Assembly ratification procedure

  1. Federal Council submits dispatch (Botschaft) 2026-03-13 to both chambers (National Council / Ständerat).
  2. Parliamentary debate and committee review: typically 6-12 months.
  3. Federal Assembly approval required by both chambers (Nationalrat + Ständerat, Differenzbereinigung if needed).

This initiative, if successful, would require a mandatory referendum for international treaties affecting Swiss democracy. If it passed before Bilaterales III ratification, it could require a popular vote on the package.
