The Minister MAY (discretionary) grant a certificate of naturalisation to any alien of full age and capacity who: resided in Saint Lucia for a period exceeding 12 months immediately preceding the application (s.8(1)(c)); during the 7 years preceding that 12-month period had residence/Government-service aggregating not less than 7 years (s.8(1)(d)) — an ~8-year footprint; is of good character (s.8(1)(a)); has adequate knowledge of English and the duties of a citizen (s.8(1)(b)); and intends to reside or to enter/continue Government service (s.8(1)(e)). An alien shall NOT be granted naturalisation unless he or she first renounces any other citizenship in the prescribed form AND takes the oath of allegiance (s.8(3)). 'Alien' excludes Commonwealth citizens, British protected persons and citizens of the Republic of Ireland (who route via registration). Citizenship from date of certificate (s.8(4)).

  • Naturalisation residence footprint: the applicant must (i) have resided in Saint Lucia for a period exceeding 12 months immediately preceding the application (s.8(1)(c)), AND (ii) during the 7 years immediately preceding that 12-month period have resided in Saint Lucia or had service under the Government (or a mix) for periods aggregating not less than 7 years (s.8(1)(d)) — i.e. an ~8-year residence/service footprint in total. - Naturalisation good-character and language/civic conditions: the applicant must satisfy the Minister that he or she is of good character (s.8(1)(a)) and has an adequate knowledge of the English language and of the duties of a citizen of Saint Lucia (s.8(1)(b)). - Naturalisation intention requirement: the applicant must satisfy the Minister that he or she intends to reside in Saint Lucia or to enter or continue in the service of the Government (s.8(1)(e)). - Naturalisation is available only to an alien of 'full age and capacity' — i.e. an adult applicant with legal capacity; minors and persons lacking capacity cannot naturalise under s.8 and must use the registration/adoption routes (s.6, s.7) (Citizenship Act s.8(1)).

  • Naturalisation precondition (renunciation + oath): an alien shall NOT be granted a certificate of naturalisation under s.8 unless he or she first renounces in the prescribed form the citizenship of any other country he or she may possess AND takes the oath of allegiance (s.8(3)). This is the ONLY general statutory dual-citizenship constraint in the Citizenship Act — it bites only on aliens naturalising under s.8. - Ministerial residence-computation discretion for naturalisation: the Minister may (a) treat a continuous 12-month period ending not later than 6 months before the application as if it immediately preceded the application date (s.8(2)(a)); (b) reckon residence/service earlier than the 7 years before application toward the aggregate (s.8(2)(b)); and (c) for special reasons accept a period shorter than 7 years (s.8(2)(c)). - Authority and channel for ordinary citizenship/registration/naturalisation applications: applications for a certificate of citizenship or naturalisation, or for registration as a citizen, are made to the Minister; where the applicant resides outside Saint Lucia, a s.6 application is submitted through a Saint Lucia diplomatic agent or consular officer, who may grant the certificate (Citizenship Regulations reg.10).

    Advise that s.8 naturalisation is a discretionary, residence-intensive route reserved for ALIENS (non-Commonwealth, non-British-protected, non-Irish) of full age and capacity who can evidence the stacked footprint: more than 12 months' residence immediately before the application (s.8(1)(c)) on top of a 7-year aggregate of residence and/or Government service in the prior 7 years (s.8(1)(d)) — an ~8-year baseline. The footprint is genuinely flexible only to the extent s.8(2) authorises: a 6-month recency bridge (s.8(2)(a)), reckoning of earlier residence/service (s.8(2)(b)), and special-reasons shortening of the 7-year aggregate (s.8(2)(c)). The s.8(3) renounce-and-oath precondition bites here.

  • Potentially eligible via LC-NAT-01 (discretionary), if the ~8-year footprint, good character, English/civic and intention conditions are met and renunciation + oath are completed.

    An alien of full age and capacity may be granted a discretionary certificate of naturalisation where: residence exceeding 12 months immediately before the application (s.8(1)(c)); a 7-year aggregate of residence/Government service in the prior 7 years (s.8(1)(d)) — an ~8-year footprint; good character (s.8(1)(a)); adequate knowledge of English and the duties of a citizen (s.8(1)(b)); and intention to reside or enter/continue Government service (s.8(1)(e)) (LC-ASSERT-041/042/043/044). An alien must first renounce any other citizenship and take the oath of allegiance (s.8(3); LC-ASSERT-045). Citizenship from the date of the certificate (s.8(4)). The grant is a ministerial discretion, not an entitlement.

  • NOT eligible to be GRANTED naturalisation without renouncing the other citizenship: s.8(3) is a hard precondition.

    An alien shall NOT be granted a certificate of naturalisation under s.8 unless he or she FIRST renounces in the prescribed form the citizenship of any other country possessed AND takes the oath of allegiance (Cit Act s.8(3); LC-ASSERT-045). This s.8(3) renounce-and-oath gate is the ONLY general statutory dual-citizenship constraint in the Act, and it bites specifically on aliens naturalising (LC-ASSERT-074). An applicant unwilling to renounce cannot complete s.8 naturalisation. If they are instead a Commonwealth citizen, they would route via registration (LC-NAT-02), which carries no renunciation precondition. As of continuously since 5 June 1979.

  • NOT eligible via LC-NAT-01: naturalisation is available only to an alien of full age and capacity.

    Naturalisation under s.8 is available only to an alien of 'full age and capacity' — an adult applicant with legal capacity (Cit Act s.8(1); LC-ASSERT-078). A minor cannot naturalise and must instead use the registration or adoption routes: derivative/vulnerable-minor registration (s.7(2) / s.6(2)(d), LC-CBN-01) or citizenship on adoption by a citizen (s.7(1), LC-ADP-01). The Minister may register a minor in special circumstances under s.7(2), distinct from the adult naturalisation discretion. As of continuously since 5 June 1979.

  • Potentially eligible via LC-NAT-01: Government service counts toward the s.8(1)(d) aggregate, with s.8(2) computation discretion.

    The s.8(1)(d) footprint may be satisfied by residence in Saint Lucia OR service under the Government, or a mix, aggregating not less than 7 years in the 7 years preceding the qualifying 12-month residence period (LC-ASSERT-042). The Minister has computation discretion under s.8(2): treating a 12-month period ending up to 6 months before the application as if it immediately preceded; reckoning earlier residence/service toward the aggregate; and, for special reasons, accepting a period shorter than 7 years (LC-ASSERT-047). The applicant must still meet good character, English/civic and intention conditions (s.8(1)(a)/(b)/(e)) and the s.8(3) renounce-and-oath gate. As of continuously since 5 June 1979.
