Italy · 1948 cases (judicial route — pre-1948 maternal lines)
Could my pre-1948 maternal line still win in court?
Italian consulates have never recognized citizenship through a woman whose child was born before January 1, 1948 — only courts apply the Cass. SU 4466/2009 case-law. That means this route is a lawsuit brought through an Italian lawyer, not an application you file. A few questions to see where your line stands after the March 27, 2025 cutoff and Law 74/2025's Art. 3-bis — parts of which are genuinely unsettled.
Does your Italian line pass through a woman whose child was born before January 1, 1948?
Until January 1, 1948, Italian law did not let women transmit citizenship. A "1948 case" is a line with at least one mother-to-child link where the child was born before that date — the link consulates won't recognize and only a judge can establish.
