- The Government may, if satisfied that a child under the age of 21 years is the child of a Singapore citizen and is residing in Singapore, cause that child to be registered as a citizen of Singapore on application by the child's parent or guardian (a discretionary registration route for minor children of citizens). - A child who becomes a citizen of Singapore by registration under Art 124 (or under s.13 of the repealed Singapore Citizenship Ordinance 1957) ceases to be a citizen on attaining the age of 22 years unless, within 12 months after attaining 21, the person takes the Oath of Renunciation, Allegiance and Loyalty set out in the Second Schedule. - A person registered as a citizen of Singapore under Art 123 or Art 124 is a citizen of Singapore from the date on which he is so registered (registration is constitutive from the registration date, subject to Art 126). [Art 125]
- No person may be registered as a citizen of Singapore under Art 123 until he has taken the Oath of Renunciation, Allegiance and Loyalty in the form set out in the Second Schedule; and, except with the Government's approval, no person who has renounced or been deprived of Singapore citizenship under the Constitution or the Singapore Citizenship Ordinance 1957 may be re-registered. - The operative citizenship instrument is the Constitution of the Republic of Singapore (2020 Revised Edition), Part 10 'Citizenship', version in force from 9 December 2024 — NOT a standalone 'Singapore Citizenship Act (Cap. 122)'. She may apply for a certificate of citizenship in cases of doubt under Art 138. On application in the prescribed manner, the Government MAY grant a certificate that a person about whose citizenship a doubt exists (of fact or law) is a Singapore citizen. This is a declaratory/confirmatory mechanism, not an acquisition route. The certificate may later be cancelled if obtained by fraud/false representation/concealment (Art 132(1) circumstances).
Art 138 (SG-E3-001): 'Upon application made in that behalf in the prescribed manner, the Government may grant in the form prescribed a certificate of citizenship to a person with respect to whose citizenship a doubt exists, whether of fact or of law,' with a proviso allowing cancellation if obtained in Art 132(1)(a)/(b) circumstances. This is confirmatory/declaratory (A266 declaratory-constitutive), not a means of acquiring citizenship (SG-SPC-02 route). 'May' = discretionary. Decision is non-justiciable (Third Schedule para 2 ouster, SG-E3-010).
His Art 138 certificate is liable to CANCELLATION. The Art 138 proviso allows the Government, where satisfied the certificate was obtained in the circumstances set out in Art 132(1)(a) or (b) (fraud, false representation, concealment of material fact, or mistake), to by order cancel the certificate. Cancellation does not discharge liabilities incurred while treated as a citizen.
Art 138 proviso (SG-E3-001, SG-E2-028): 'where the Government is satisfied that such a certificate was obtained in circumstances set out in Article 132(1)(a) or (b), the Government may, by order, cancel such certificate.' Art 132(1) circumstances = fraud/false representation/concealment of material fact, or mistake. Art 131 (general loss provisions) means prior liabilities survive cancellation. Discretionary; non-justiciable (Third Schedule para 2 ouster).
