Resumen

On its commencement on 6 October 1995, the Citizenship Act 88 of 1995 restored a common South African citizenship and, through Schedule 2, repealed in their entirety all the TBVC/homeland citizenship statutes for Transkei, Bophuthatswana, Venda and Ciskei. No separate homeland citizenship survives in South African law, and persons formerly assigned to those states are recognised simply as South African citizens; this is a completed historical transition, not a route open to new applicants.

  • Full South African citizen by operation of law — no application needed.

    Act 88/1995 s26(1) read with Schedule 2 repealed every TBVC citizenship statute 'The whole,' and the Restoration Act 196/1993 had already restored the cohort from 1 January 1994 (Chisuse [41]: every person stripped under TBVC legislation became an SA citizen). There is no homeland-restoration application and no residual homeland nationality to renounce; status is confirmed via a s15/s16 certificate.

  • Outside the ZA-HIS-03 cohort — assessed on the ordinary birth/descent rules.

    The s1 'former states' definition is a closed list of the four TBVC Republics (Transkei, Bophuthatswana, Venda, Ciskei); the six self-governing homelands (KwaZulu, Lebowa, Gazankulu, QwaQwa, KaNgwane, KwaNdebele) are not within it. Self-governing-homeland residents never lost SA citizenship in the same manner and are assessed under the ordinary s2 birth / s3 descent provisions.

  • Eligible — resumption by declaration under s13(2).

    s13(2) lets a minor who ceased to be a citizen under a Schedule 2 law and who is resident in or has returned to the Republic for permanent residence make a declaration to resume SA citizenship 'at any time after attaining the age of 18 years,' registered if the Minister deems fit. She satisfies the age and residence conditions.
