Resumen

The Minister may grant a certificate of naturalisation to a minor who is permanently and lawfully resident in the Republic, on an application made by the minor's responsible parent or legal guardian (s5(4) of the Citizenship Act 88 of 1995). This is a discrete route for minor children that operates in place of the ordinary adult naturalisation requirements of s5(1).

  • Reviewability of naturalisation decisions (s25): any provincial or local division of the High Court of South Africa has jurisdiction to review any decision of the Minister under the Act, and may consider the merits and confirm, vary or set aside the decision. This subjects the discretionary naturalisation grants/refusals (incl. s5(9) exceptional-circumstances) to full merits review — reinforced by constitutional supremacy (Constitution s2) and just-administrative-action.

    s5(4) lets the Minister, on application, grant a certificate of naturalisation to a minor who is permanently and lawfully resident in the Republic; Ahmed qualifies as a minor (under 18, per s1) with lawful permanent residence. The grant is discretionary, and any refusal is reviewable by the High Court under s25.

  • Not eligible — minor not permanently and lawfully resident.

    s5(4) requires the minor to be 'permanently and lawfully resident' in the Republic; a child residing on a temporary visitor's basis does not meet the precondition. The family would need to regularise permanent-residence status before a minor-naturalisation application could succeed.
