There are no currently operative eligibility requirements under AG-PND-01. The route is not operative. This section records what the ECCIRA framework will require once operative, based on the decoded Agreement text, for planning and monitoring purposes only. All requirements stated here are prospective and contingent on commencement and EIF. What ECCIRA will regulate (prospective — not yet operative): ECCIRA is a regulatory authority over participating states' CBI programmes, not a separate citizenship pathway. It does not create a new route to Antiguan citizenship; instead, it layers regional oversight on the existing CBI programme. When operative, ECCIRA's Agreement will impose: - Uniform standards and timelines for application processing across participating states (Art 45) - Mandatory background checks / due diligence requirements of uniform regional standards (Arts 50-54) - Mandatory interviews for applicants (Arts 56-60), including for dependants (Art 57) - Residency and genuine-link requirements (Art 48) — applicants may be required to establish a genuine link to the participating state beyond the current 5-day physical presence requirement in the Antiguan CBI Act - Escrow-account management for investment funds (Art 66) - Maximum number of approved applicants quotas (Art 47) — new numerical caps on annual CBI grants, a significant structural change to the current uncapped Antiguan programme - Change-of-name restrictions (Arts 61-63) - Uniform fee and pricing standards already partially anticipated by the OECS Mar 2024 MoU (Era E10) Impact on existing CBI routes (AG-INV-01 through AG-INV-05): When ECCIRA enters into force, it will add compliance layers to the existing NDF (AG-INV-01), Real Estate (AG-INV-02), Business (AG-INV-03), UWI Fund (AG-INV-04), and Dependants (AG-INV-05) routes. The existing investment thresholds (NDF US$230,000, RE US$300,000, UWI US$260,000 — all as-of SI 2024 No. 50 effective 25 July 2024) are set by the CBI regulations, not by ECCIRA directly; however, ECCIRA's Council of Ministers (Art 12) and the Authority (Arts 4-11) may issue directives and standards that constrain how the thresholds are implemented. Offences and penalties (already live upon commencement of Act, even before Treaty EIF): Part III of the Act (ss.7-22) establishes offences and penalties including: - False or misleading statements to the Authority: fine up to USD $250,000 or 12 months' imprisonment (s.7) - Failure to cooperate/obstruction: fine up to USD $200,000 or 12 months' imprisonment (s.8) - Conflict of interest by licensees: administrative fine up to USD $100,000 and Authority sanction (s.9) - Non-compliance with directives: administrative fine up to USD $100,000 (s.10) - Confidential-disclosure offences: fine up to USD $250,000 or 18 months' imprisonment (s.11(2)) Whether these penalty provisions can be enforced before the Act commences (and before the Agreement enters into force) depends on the commencement Order.

This section is prospective only (no route currently operative). Documentation ECCIRA will require (once operative) — derived from Agreement text: Under Art 51, participating states must collect and protect biometric data. Under Arts 50-54, mandatory due-diligence background checks apply. Under Arts 56-60, mandatory interviews are required. These obligations, once operative, will add documentary requirements beyond the current CBI application (which requires the existing processing + due-diligence package under CBI Act 2013 and Regulations). Current CBI documentation (under operative routes AG-INV-01 through AG-INV-05) is governed by the CBI Act 2013 (as amended) and Regulations (SI 2024 No. 50 and predecessors); see those route documents. For monitoring / planning purposes only: - Legal practitioners advising CBI applicants should monitor the Official Gazette of Antigua and Barbuda for the Act 18/2025 commencement Order - Monitor ECCIRA/OECS communications for ratification deposits (target: 5 deposits for Art 95.1 EIF) - Monitor Art 96.2 provisional-application declarations (target: 3 declarations for provisional EIF) - After commencement/EIF: obtain ECCIRA-compliant due-diligence service provider registrations and adapt application preparation to ECCIRA's uniform standards (Arts 44-54)

  • NOT AUTOMATICALLY — this route. ECCIRA is a regulatory authority over participating states' CBI programmes, not a source of investment thresholds. The NDF amount is set by AG's domestic CBI regulations (currently SI 2024 No.50 reg 7(1): US$230,000 effective 1 Aug 2024). When and if ECCIRA becomes operative, it may issue directives or standards constraining how thresholds are implemented, but the primary source of investment thresholds remains AG's own domestic instruments. Any ECCIRA-driven change to the NDF figure would require a new AG Statutory Instrument amending reg 7(1). As of 2026-06-14, ECCIRA is not yet commenced.

    AG-PND-01 route doc: ECCIRA is a regulatory overlay, not a tariff-setting body with direct domestic law effect until commencement + EIF. Investment thresholds are domestic CBI regulation matters. SI 2024 No.50 governs current thresholds. ECCIRA's Art 47 (quota caps) and Art 45 (processing standards) would layer over the domestic programme, but direct threshold changes require domestic implementing instruments.
