Quién califica

Under the former L.3838/2010 regime (2010 to 4-2-2013 only), eligibility rested on purely formal criteria: a child born in Greece to third-country-national parents where at least one parent had been lawfully and continuously resident in Greece for at least five years before the birth, triggered by a joint parental declaration; an alternative limb covered a foreign minor who had completed roughly six years of Greek schooling. No substantive integration assessment was required, which is precisely the feature the Plenary Council of State found unconstitutional.

Requisitos

GR-BTH-02 required NO language or civics test: it rested on purely formal criteria (residence years, school years, clean record) without any substantive integration assessment. That very absence was the constitutional defect identified by ΟλΣτΕ 460/2013, which held that formal criteria must be combined with substantive criteria evidencing a genuine bond. Integration is tested instead in the successor regime (GR-BTH-01 substantive schooling) and in ordinary naturalisation (the ΠΕΓΠ exam, GR-NAT-01).

The former declaration mechanism contemplated the child's Greek birth certificate, proof of the parents' lawful Greek residence for at least five years, a joint parental declaration, and (for the schooling limb) Greek school attendance certificates, plus absence of a serious criminal conviction. Historically (2010 to Feb 2013) parents established ≥5 years' lawful residence and the child's birth in Greece, lodged a joint declaration with the competent citizenship service, the administration verified the formal criteria, and acquisition was perfected by ΦΕΚ publication. ΟλΣτΕ 460/2013 invalidated this pathway, so any process built on it ceased; analogous applicants now follow the GR-BTH-01 Art 1A declaration-application.

Not applicable: no current processing timeline exists because the route is repealed. Historically the L.3838/2010 declaration was an administrative act culminating in ΦΕΚ publication. By contrast the live successor GR-BTH-01 (Art 1A) has the Coordinator decide within six months of the declaration-application, with nationality acquired on ΦΕΚ publication.

Not applicable: no fee is payable for GR-BTH-02 because no application can be lodged under a repealed provision. For comparison, the live successor GR-BTH-01 declaration under Art 1A/1B carries a €100 fee per the current Code procedure.

Autoridad competente

No authority processes GR-BTH-02 in 2026. Former L.3838/2010 declarations were received by the citizenship services of the Decentralised Administration and municipal registries. For the live successor route the competent body is the Regional Citizenship Directorate (Περιφερειακή Διεύθυνση Ιθαγένειας — renamed by L.5225/2025 Art 95) of the Decentralised Administration, under the Ministry of Interior General Secretariat for Citizenship.

Exceptions & edge cases

The most common error is treating GR-BTH-02 as live because stale databases describe 'declaration-at-birth second-generation acquisition' (corrected by V-CORR 14: it is REPEALED). A second error is conflating the strike with the successor — 'νόμος Ραγκούση αντισυνταγματικός' headlines refer to 460/2013 striking L.3838/2010, NOT to L.4332/2015 (GR-BTH-01), which survived. A third is carrying the non-existent uphold cite 'ΣτΕ 1891/2019', which is refuted (1889/2019 is an ΕΦΚΑ pensions case).
