Resumen

The Spijtoptanten — literally the "regret-opters" — are people born in the Dutch East Indies who elected Indonesian nationality around the 1949 transfer of sovereignty and afterwards wished they had not. A dedicated historic scheme once let some of them opt back; that window has long closed, and this evidence base does not establish its terms. What matters now is which instruments actually in force can be used.

There are two, and a third that is almost certainly shut.

Option as a former Dutch national (RWN art 6(1)(f), in force since 1 October 2023) is the ordinary way back, but it is demanding in one respect: it requires you to move to the Kingdom and hold admission for an indefinite period there, with principal residence, for a full year before the confirmation.

Naturalisation is the route that works from abroad. For anyone who at some time held Dutch nationality or the status of Nederlands onderdaan-niet-Nederlander (Netherlands subject who is not a Netherlands national), the five-year residence condition does not apply at all (RWN art 8(2)), and a request can be lodged at the Netherlands diplomatic or consular post in whose district you live.

The proportionality-based restoration option (RWN art 6(1)(p), in force since 1 April 2022) is shut to the original cohort. It requires that EU citizenship was lost together with Dutch nationality, and EU citizenship did not exist before 1 November 1993. A 1949 or 1950s election of Indonesian nationality falls decades outside it.

Requisitos

Option as a former Dutch national. You must be an adult; have held Dutch nationality or the status of Nederlands onderdaan-niet-Nederlander at some time; and have had at least one uninterrupted year of toelating voor onbepaalde tijd (admission for an indefinite period) together with hoofdverblijf (principal residence) in the Kingdom, running up to the moment of confirmation. That year has to be accrued as a foreign national — time held as a Dutch national does not count. There is no language or integration requirement for option at all, and the duty to renounce another nationality does not attach to this ground.

Naturalisation. The five-year residence condition falls away for former Dutch nationals and former Netherlands subjects (RWN art 8(2)). What remains is:

  • the naturalisation test at CEFR level A2 in all four skills, plus the knowledge-of-society component (Besluit naturalisatietoets arts 3(1)(h)(2) and 5(1), in force since 26 May 2022). A person who was never subject to the civic-integration obligation must still in principle pass it;
  • good character. Refusal follows where serious suspicions exist, on your conduct, of danger to public order, good morals or the security of the Kingdom (RWN art 9(1)(a)). The rehabilitation period is five years, raised from four with effect from 1 May 2018;
  • the duty to renounce your other nationality (RWN art 9(1)(b)), subject to four statutory exemptions and eleven further policy categories — including a state that does not permit renunciation in law or in practice;
  • the verklaring van verbondenheid (declaration of solidarity), required of adults and of minors aged 16 or over.

Both routes are barred if you have ever already acquired Dutch nationality by option: only the former-national and proportionality grounds remain open to you afterwards (RWN art 6(9)).

Documentos

Establish the Dutch link first: an old Dutch passport, a bewijs van Nederlanderschap (certificate of Dutch nationality), a historical population-register extract, or consular records, together with evidence of the nationality election or other loss event.

Then the ordinary civil-status set for a naturalisation file: your own birth certificate; birth certificates of any children included; marriage certificate; divorce or repudiation deeds and, where the country uses one, the family booklet. A valid foreign travel document must in principle be produced unless you are registered as stateless in the population register.

Two documentary points are specific to this cohort and cut in opposite directions.

The favourable one: the last located version of the legalisation circular structurally exempted documents from Indonesia, New Guinea and Suriname from legalisation altogether. Do not rely on it without checking. That circular (Stcrt. 2023, 8509) was repealed with effect from 1 January 2024, the Handleiding in force since 1 July 2026 still directs officials to "the legalisation circular currently in force", and no successor could be located as of 25 July 2026. Ask the receiving authority which instrument it applies before commissioning legalisation.

The unfavourable one: the list of diplomas that exempt you from the naturalisation test includes a comparable diploma obtained in Dutch-medium education in Belgium and in Suriname, with a pass in the subject Dutch (Besluit naturalisatietoets art 3(1)(k) and (l)). Indonesia is not on that list. Dutch-medium schooling in the Indies does not, by itself, exempt you.

Where deeds genuinely cannot be obtained, bewijsnood applies — accepted where such deeds were never drawn up in that country, or were drawn up but the register was lost, supported by a written reasoned statement from the authorities of the country concerned.

Plazos

No processing time specific to this cohort is established. The general position:

Statutory decision periods. Option: 13 weeks from receipt of the declaration, extendable once by at most 13 weeks, so a 26-week ceiling (RWN art 6(5)), plus four weeks where the authority seeks the Minister's advice on renunciation (RWN art 6a(6)). Naturalisation: one year, running from the latest of payment of the fee, the decision fully waiving it, or receipt of the requested supplementation, and capable of being held at most twice by six months, giving a two-year ceiling (RWN art 9(4)).

Neither clock starts on the day you file. For naturalisation the year begins only once all documents necessary for the assessment have been received; for option, only once the fee position is settled and requested supplements are in.

Published performance covers naturalisation only and stops at 2024. In 2024 the average time from filing at a municipality to the ceremony was 182 days, against 344 days in 2018; the municipal stage took 13 days, the IND stage 95 days for grants, and the Kabinet van de Koning 18 days from proposal to Royal Decree (IND, Monitor Naturalisatie en Optie 2018-2024, June 2025).

For anyone filing abroad, the constituency breakdown matters. Over 2018-2024, 82% of granted requests filed in the European Netherlands reached a ceremony within a year of filing, against 77% of those filed at diplomatic posts; 68% of requests lodged at posts reached the IND within three weeks to two months. Do not read the European figure across to a consular filing.

Missing a deadline confers nothing: there is no silent approval. The remedy is a written notice of default, after which a statutory penalty payment runs from two weeks later, capped at 42 days (Algemene wet bestuursrecht arts 4:17-4:20).

The ordinary 2026 tariffs apply; no cohort-specific reduction or waiver is established. In the European Netherlands, in force since 1 January 2026: option EUR 241 single, EUR 412 joint, EUR 27 per co-opting minor child; naturalisation EUR 1,139 single, EUR 1,454 joint, EUR 168 per co-naturalising child (WBN 2025/3, Stcrt. 2025, 31825). A reduced naturalisation tariff of EUR 847 single and EUR 1,163 joint applies to stateless persons and to holders of an asylum residence permit.

Filing from abroad raises a question the sources do not settle. Where a request is lodged at a Netherlands diplomatic or consular post, the fee is paid to the head of that post (Besluit optie- en naturalisatiegelden 2002 art 5(4)), and the 2026 instrument gives heads of post the same euro retention figures as a Netherlands municipality — EUR 241 single, EUR 412 joint, EUR 27 per child. That strongly implies the euro schedule governs a consular filing, but no source states it outright. Confirm the amount and currency with the post before paying.

Payment mechanics matter here as much as the amount. The fee is payable in one instalment, and if it is not paid within six weeks of receipt of the declaration or request the file is set aside without being handled (Besluit optie- en naturalisatiegelden 2002 art 6). That six-week clock is suspended while a request for exemption from payment is pending.

Do not take fee figures from the consolidated text of the Besluit optie- en naturalisatiegelden 2002. It still prints 2011 amounts — EUR 789 for a single naturalisation against the EUR 1,139 actually payable in 2026.

Exceptions & edge cases

The date bar on the proportionality route is absolute and it is the single most common misconception about this cohort. The restoration option requires that EU citizenship was lost together with Dutch nationality. EU citizenship was created on 1 November 1993, so any loss before that date is outside the ground entirely; so is any case where the person held another EU member state's nationality at the moment of loss. Of the roughly 800 proportionality advice requests the IND handled from February 2020 to July 2023, it found the loss disproportionate in about 4% of cases and advised that it was not disproportionate in 90%.

The option for former nationals cannot be exercised from abroad. It needs a year of permanent-status admission and principal residence inside the Kingdom, running up to the confirmation. If you are living in Indonesia or elsewhere and cannot relocate, naturalisation through a consular post is the route to look at, not option.

Residence gaps reset the clock rather than pause it, and registration as a niet-ingezetene (non-resident) in the population register is expressly treated as an indication that principal residence has moved abroad.

One exemption from the naturalisation test is worth checking for anyone who spent childhood years in the Netherlands: at least eight years' residence in the European Netherlands during compulsory-school age exempts you outright, and those years need not be continuous or even lawful.

Nationality vests on handover, not on the decision. Miss the ceremony and the decision lapses by operation of law one year after the date it bears, with no objection or appeal against the lapse.
