Recognition under the Dutch legislation for victims of wartime persecution between 1940 and 1945 is a benefits and welfare status. This evidence base establishes no effect of that recognition in nationality law: no dedicated ground of acquisition, no reduced fee, no exemption from the naturalisation test, and no priority handling of a nationality file. Claims that a recognition decision accelerates or unlocks a Dutch nationality claim are not established here and should not be relied on.

What a person in this position actually has is the ordinary set of instruments. If you or your parent once held Dutch nationality, the useful facts are these. The five-year residence condition for naturalisation does not apply to anyone who has at some time held Dutch nationality or the status of Nederlands onderdaan-niet-Nederlander (RWN art 8(2)), and a naturalisation request can be lodged at the Netherlands diplomatic or consular post in whose district you live. The option for former Dutch nationals is also available, but only after a year of permanent-status residence inside the Kingdom.

Where the war record genuinely does bite is documentary, and that is the substance of this page. Netherlands policy recognises evidentiary impossibility — bewijsnood — expressly including the case where a civil-status deed was drawn up but the register in which it sat was lost. For families whose records were destroyed, that limb is the operative rule.

Naturalisation. The five-year residence condition does not apply to a former Dutch national or a former Nederlands onderdaan-niet-Nederlander (RWN art 8(2)). Still required: the naturalisation test at CEFR level A2 in all four skills plus the knowledge-of-society component (Besluit naturalisatietoets arts 3(1)(h)(2) and 5(1)); good character, with a five-year rehabilitation period raised from four with effect from 1 May 2018; the duty to renounce another nationality (RWN art 9(1)(b)); and the verklaring van verbondenheid (declaration of solidarity).

Two reliefs are worth checking against the facts of an individual case.

Statelessness. A stateless applicant needs three years of admission and principal residence rather than five (RWN art 8(4)), and pays the reduced naturalisation tariff of EUR 847 single or EUR 1,163 joint under the 2026 schedule in the European Netherlands (WBN 2025/3, Stcrt. 2025, 31825, in force 1 January 2026). Registration as "staatloos" in the population register also removes the requirement to produce a foreign passport. Note the trap: a registration of "onbekende nationaliteit" (unknown nationality) is expressly not the same as stateless, and a passport must still in principle be produced.

Recognised refugee status. A person recognised as a refugee in the Netherlands, Aruba, Curacao or Sint Maarten is exempt from the renunciation duty outright (RWN art 9(3)(d)), pays the reduced tariff, and may substitute a Dutch refugee passport or Dutch alien's passport for a foreign travel document.

Option as a former national requires one uninterrupted year of admission for an indefinite period with principal residence in the Kingdom, accrued as a foreign national.

Documentos

Bewijsnood — evidentiary impossibility — is the operative rule for this cohort, and it is narrower than people expect. The Handleiding in force since 1 July 2026 accepts it for civil-status deeds in three situations only:

  • the deed was never drawn up, because such deeds are or were never made in that country;
  • the deed was drawn up but the register was lost. This is the limb that reaches destroyed wartime registers;
  • an official report of the Ministry of Foreign Affairs has led to a decision not to require deeds from that country, temporarily, because of the political situation.

For the foreign passport requirement, bewijsnood is accepted where the person is stateless, or where an official report has led to a decision not to require a travel document from that country.

Proving bewijsnood, if you are not an asylum-permit holder, means producing a written and reasoned statement from the authorities of your country of nationality or birth explaining why the document is refused. Difficulty of travel is expressly not enough.

Otherwise the ordinary set applies: your own birth certificate; birth certificates of children included; marriage certificate; divorce or repudiation deeds and the family booklet where used; and, to establish the Dutch link, an old Dutch passport, a bewijs van Nederlanderschap, a historical population-register extract or consular records.

Formalities: foreign documents legalised or apostilled at your own cost; sworn translation, preferably into Dutch, where the document is in a language other than Dutch, English, German or French, physically attached to the original. Documents already legalised and processed into the population register need not be produced again unless there is well-founded doubt. Note that the legalisation circular the Handleiding points to (Stcrt. 2023, 8509) was repealed with effect from 1 January 2024 and no successor could be located as of 25 July 2026 — confirm the requirement before paying for legalisation.

Exceptions & edge cases

Priority handling is not established. No source compiled for this route records faster treatment, a shorter decision period or any procedural preference for a recognised victim of persecution. Plan against the ordinary statutory periods: 13 weeks extendable to 26 for an option declaration, one year extendable to two for naturalisation.

If statelessness is the real issue, there is a dedicated procedure and it is judicial, not administrative. Under the Wet vaststellingsprocedure staatloosheid, in force since 1 October 2023, a person with an immediate interest who has their domicile or habitual residence in the Netherlands may petition the rechtbank Den Haag to have statelessness established. The court decides within six months, extendable once by six months, and only cassation lies from its decision. The residence limb matters: on its wording the procedure is not available to residents of Aruba, Curacao or Sint Maarten, and its coverage of the BES islands is not established. The IND fee for a statelessness document is EUR 254 for an adult and EUR 85 for a child under 18 in 2026.

The proportionality-based restoration option does not reach wartime or immediate post-war losses. It requires that EU citizenship was lost together with Dutch nationality, and EU citizenship was created on 1 November 1993.

The renunciation exemption for a person born in the Netherlands, Aruba, Curacao or Sint Maarten requires both birth there and principal residence there at the time of the application — birth alone is not enough.

Nationality vests only when the decision is physically handed over, in principle at a ceremony, and then backdates to the date the document bears. Miss the ceremony and the decision lapses by operation of law one year after that date, with no objection or appeal against the lapse.
