GR-BTH-01 הוא מסלול הרכישה הטריטוריאלית של יוון מהדור השני המותנה: ילדים להורים זרים שנולדו ו/או לומדים ביוון רוכשים אזרחות יוונית תחת Code Arts 1A (לידה + חינוך) ו-1B (לימודים בלבד), שהוכנסו על ידי L.4332/2015 (Φ-ΕΚ 720/Α5'Κ ). החל מ-2026-06-05 זהו המשטר המבצעי שלאחר ΟλΣτΕ-460/2013; זה לא jus soli ללא תנאי (רק לידה על אדמת יוון אינה מעניקה דבר בהיעדר התנאים החוקיים).

Art 1A (birth + schooling) requires ALL of: (a) the child born in Greece to foreign parents; (b) enrolment in 1st grade (Α' τάξη) of Greek primary school plus continued/uninterrupted attendance at the time of the joint declaration; (c) at least one parent's ≥5 years' continuous lawful residence before the child's birth (or the right arising on completion of 10 years' continuous residence if the child was born before the 5-year mark); (d) at least one parent holding an enumerated definitive residence title. GR-BTH-01 carries NO ΠΕΓΠ exam, no language test and no civics test: the 'genuine bond' is supplied by the objective birth/schooling and residence facts, with continuous Greek schooling treated as the integration proxy chosen by the legislator after 460/2013. Notably, completing the same 9-/6-grade Greek schooling chain even exempts an applicant from the ΠΕΓΠ in the separate naturalisation context (Art 7(4)), underscoring that schooling is treated as conclusive integration evidence. Qualifying definitive parental residence titles under Art 1A §1(c) (γα–γζ) are enumerated: EU long-term-resident permit; indefinite/ten-year residence permit; EU-citizen permanent-residence certificate (PD 106/2007); recognised-refugee/subsidiary-protection/recognised-stateless title; ΕΔΤΟ plus a valid uniform-type permit; second-generation residence permit (Art 108 L.4251/2014); permanent-residence card of a family member of a Greek/EU citizen. Art 1A procedure: BOTH parents jointly sign and submit the declaration-application (variants for single-parent / international-protection / unaccompanied-minor cases under Art 1A §2β; one parent may act on the other's authorisation, or via a lawyer), filed at the competent Regional Citizenship Directorate of residence with the €100 e-paravolo (code 2163); the competent organ decides within 6 months; nationality is acquired on ΦΕΚ publication of the summary decision, followed by municipal-roll registration. The statutory decision deadline is 6 months (Art 1A §2; Art 1B §1); nationality takes effect on the date of ΦΕΚ publication of the summary decision. Filing and decision lie with the competent service of the Decentralised Administration / Regional Citizenship Directorate (Περιφερειακή Διεύθυνση Ιθαγένειας) of residence, under the General Secretariat for Citizenship, Ministry of Interior. The Code's legacy 'Coordinator of the Decentralised Administration / General Secretary of the Region' references read in 2026 as the current Regional Citizenship Directorate (authority lineage L.3852/2010 → L.4555/2018 → L.4674/2020; terminology codified by L.5225/2025 Art 95). Unlike naturalisation, there is no Naturalisation Committee and no ΠΕΓΠ exam.

Common pitfalls: assuming unconditional birthright citizenship (Greece has none — the conditions are mandatory); relying on a parent's temporary permit (not a qualifying definitive title); counting kindergarten toward the schooling chain; missing the Art 1B 21/23 age caps and the 3-year exclusive deadline; expecting a ΠΕΓΠ exam or paying the €550 naturalisation fee (neither applies — fee is €100, no exam); and citing repealed/refuted authority (L.3838/2010 as if live, or 'ΣτΕ 1891/2019').
