For the descent limb (as of 2026), eligibility requires an ethnic-Greek Vorioepirote with an ancestor who held Greek nationality and is documentarily traceable in a Greek civil or male registry; there is no age limit and no residence requirement because the status exists ipso jure from birth. For the Art 23 limb, eligibility requires a valid ΕΔΤΟ, adulthood and clean record under Code Art 5(1), and permanent residence in Greece.

As of 2026 the competent authority for both Art 23 naturalisation and Art 25(2) determination is the Regional Citizenship Directorate (Περιφερειακή Διεύθυνση Ιθαγένειας) of permanent residence, under the General Secretariat for Citizenship of the Ministry of Interior — successor to the Code's 'General Secretary of the Region' / 'Coordinator of the Decentralised Administration' references, with terminology codified by L.5225/2025 Art 95. The ΕΔΤΟ card itself is issued by the Hellenic Police; abroad, the Greek consular authority in Albania handles descent filings.
Exceptions & edge cases
An ethnic-Greek consciousness without a registered Greek-national ancestor does not establish descent and routes to Art 23 ΕΔΤΟ naturalisation. A descent claim with a gap in the chain may be cured by alternative proof under Code Art 25(2) (Μητρώο Αρρένων, old passports) or pivot to Art 23. The non-ethnic-Greek spouse of an ΕΔΤΟ-holder receives ΕΔΤΟ/residence but not nationality. A Vorioepirote resident in Albania can still claim Art 1 descent (no residence requirement) but cannot use Art 23 until permanently resident in Greece. (As of 2026.)

The ΕΔΤΟ extended to a non-ethnic-Greek spouse is a residence/identity status, not citizenship, and Art 23 facilitation is for ομογενείς. The spouse must naturalise on an ordinary track (e.g. the 3-year reduced spouse track only if there is a child of the marriage under Art 5(1)(δ)/GR-MAR-01, else the general 7-year track), with the ordinary ΠΕΓΠ exam.

Can pursue Art 1 descent from Albania; cannot use Art 23 (no Greek residence)
Art 1 descent has no residence requirement, so the great-grandmother's registered Greek nationality transmits down the provable chain and can be determined via the Greek consulate in Albania under Art 25(2). The Art 23 ΕΔΤΟ track, by contrast, keys to permanent residence in Greece, so it is unavailable until he relocates and holds an ΕΔΤΟ — but he does not need it if descent is provable.

As a male Greek national he becomes liable to conscription (Constitution Art 4(6), L.3421/2005) from 1 January of his 19th year to age 45 (12-month service since May 2021); diaspora deferral is available on the residence/employment-abroad thresholds, and any future renunciation is blocked while military obligations remain outstanding.
