כיצד להגיש

For most of the commencement cohort there was and is no procedure: Art 5 and Art 6(b)(i) operated automatically to fix citizenship at 26 January 1950 for those who met the domicile/nexus or pre-19-July-1948 migration tests. Two of the articles contemplated a registration step at the time: Art 6(b)(ii) (registration before commencement for those who migrated on or after 19 July 1948) and Art 8 (consular registration for persons of Indian origin residing abroad, before or after commencement). Today, no person 'applies' under Arts 5-8; the determination is spent for new acquisitions. Its live procedural relevance is as a FORWARD BRIDGE: Citizenship Act 1955 §4(3) deems any person born outside undivided India who was, or was deemed to be, a citizen at the commencement of the Constitution to be a citizen 'by descent only' — which then engages the §4 consulate-registration provisos on the NEXT generation's descent claim.
