סקירה כללית

This pathway concerns the cohort whose Dutch mother could not pass nationality to them under the law as it stood before 1985. The correction is not a naturalisation and not a retrospective declaration that you were Dutch all along. It is an optieverklaring — a written declaration that you meet a ground the Kingdom Act on Netherlands Nationality (Rijkswet op het Nederlanderschap, RWN) sets out, which the receiving authority must then confirm if the ground is made out.

Among the seventeen option grounds in force since 1 October 2023 (RWN art 6(1)(a)-(q), verified 25 July 2026), the maternal-descent family is the largest genuinely diaspora-facing group. The core ground covers a person born before 1 January 1985 to a Dutch mother and a non-Dutch father, and — the point that makes this route unusual — it carries no residence requirement at all. A parallel ground covers a person adopted before 1 January 1985 in the Kingdom by a woman who was Dutch when the adoption judgment became final. Five further grounds run to the children of those people: born as their child, recognised by them before the age of seven, recognised during minority with proof of biological paternity, parentage judicially established, or adopted by them in the Kingdom while a minor.

What this route does not require is as important as what it does: no language test, no integration examination, and no obligation to give up your existing nationality. What it does require is documentary reconstruction of a family line, and attention to a sequencing rule that catches people out.

One honest limit: the status today of the historic transitional declaration window that ran from the mid-1980s is not established in the sources verified for this pathway. What is established is the option ground family described above, which is in force now.

דרישות

No residence requirement. The core maternal-descent ground — born before 1 January 1985 to a Dutch mother and a non-Dutch father — carries none. You do not have to move to the Kingdom, and you do not have to have ever lived there. This is what distinguishes it sharply from the re-acquisition ground for former Dutch nationals, which demands a year of indefinite-status residence in the Kingdom.

No integration or language requirement. The policy manual states it flatly: unlike naturalisation, option imposes no integration requirements, and confirmation cannot be refused because the declarant does not speak Dutch. The structural reason is that the integration condition sits in article 8(1), which by its own opening words governs only grants made in accordance with article 7 — naturalisation. Article 6 has no counterpart.

No renunciation duty. The obligation to give up an existing nationality is confined by RWN article 6a(1) to a single option ground — the one for adults admitted and resident in the Kingdom since the age of four — and the policy manual says expressly that it does not apply to the other option categories. It does not touch the maternal-descent grounds.

The sequencing rule, which catches people out. Where a child claims through a derivative ground, the parent who qualifies on the pre-1985 maternal-descent or adoption ground must have acquired Dutch nationality first. The child cannot leapfrog. The only relief is where that parent died before being able to acquire it, in which case the parent's compliance with the ground must still be investigated posthumously.

Declaration of solidarity. Adults and minors aged 16 or over must be willing to make the verklaring van verbondenheid. Its wording is fixed by statute and cannot be varied; it is made in Dutch, normally orally and in person. A written declaration is permitted where an oral one cannot reasonably be required, and it is dispensed with where physical or psychological condition prevents it. The confirmation is not made known until the declaration has actually been made.

Conduct. Confirmation is refused where, on the basis of the person's conduct, serious suspicions exist that they present a danger to public order, good morals or the security of the Kingdom, unless obligations under international law preclude refusal. This is an imperative ground with no policy freedom.

The one-shot rule. Anyone who has at any time acquired Dutch nationality by option may afterwards use only two of the seventeen grounds — the former-Dutch-national ground and the disproportionate-loss restoration ground (RWN art 6(9)). If you have used option once already, the maternal-descent grounds are closed to you.

Conditions must be met at the moment of confirmation, not merely when the declaration is lodged.

This is the section that decides most maternal-descent cases, because the ground turns on a family history that has to be reconstructed on paper.

What the declaration itself must carry. Twelve categories of data, including your names, birth details, address, nationality, residence status, marriage details, the data of any minor children included — and, for the pre-1985 maternal-descent grounds specifically, historical nationality data on your parents and grandparents (BVVN art 6(1), in force since 1 March 2017). That express power to reach back two generations exists for this ground family and not generally; expect it to be used.

The truth declaration. You must sign a written statement that the data are truthful and that you have concealed nothing relevant. Nationality acquired by option can later be withdrawn where acquisition rested on a false statement, fraud or concealment by the declarant — though errors by the authorities are not held against you.

Proof of the mother's Dutch nationality at the relevant time is the heart of the file: her birth certificate, historical population-register extracts, an old passport, a declaration of possession of Dutch nationality, or consular records. Where a derivative ground is used, the chain must also establish the family-law relationship — a deed of recognition, an adoption judgment, or a judicial establishment of parentage.

Legalisation and apostille. The authority may require you to prove the accuracy of what you declare by documents that are, where necessary, legalised and where appropriate verified as to content. Legalisation confirms only the authenticity of the signature, the capacity of the signatory and the identity of the seal — never that the contents are true, which is why a separate verification track exists and why the IND may order an investigation where a legalised document is suspected of being substantively wrong. For states party to the Apostille Convention the apostille is the short route; in the Netherlands an apostille is a sticker issued by the courts. The Netherlands accepts digital apostilles issued abroad but issues paper ones only (Ministry of Foreign Affairs, Nederland Wereldwijd, consulted 25 July 2026).

An honest gap: the policy manual instructs officials to apply the legalisation circular in force, but the most recent such circular that could be located lapsed on 1 January 2024 and no successor was found. Do not assume the 2023 text is in force, and do not assume there is nothing in its place.

Translation. In the European Netherlands a translation is required where the document is in a language other than Dutch, English, German or French; it must be by a sworn translator, preferably into Dutch, and physically attached to the original or certified copy. The BES rule is stricter: anything other than Dutch or English. The equivalent trigger for Aruba, Curaçao and Sint Maarten is not established.

You need not produce documents twice. Anything already legalised or apostilled and processed into the population administration or into a Dutch civil-status deed need not be produced again, unless there is well-founded doubt.

The procedure is the ordinary option procedure, set by the Besluit verkrijging en verlies Nederlanderschap (BVVN), in force since 1 March 2017.

  1. Work out where you file. The declaration goes to the authority for the place where you live, and only that authority may handle it: the burgemeester of your municipality in the European Netherlands; the Minister — in practice the IND unit Caribbean Netherlands — for Bonaire, Sint Eustatius and Saba; the Gouverneur of Aruba, Curaçao or Sint Maarten; and, if you live outside the Kingdom, the Minister of Foreign Affairs at the diplomatic or consular post in whose district you have your principal residence. Because this ground has no residence requirement, the consular route is the realistic one for most of this cohort.
  2. Lodge in person. Declarations are made in person; a proxy is permitted only for compelling reasons. The declaration is stamped with a date and a service stamp on receipt and you are given a copy.
  3. Pay the fee. The authority checks the fee obligation before taking the file into handling.
  4. Assessment on the documents you submit. The authority assesses the ground on the basis of the documents put before it, cross-checks against the population administration, and where your history sits in another part of the Kingdom asks that authority to verify — with fixed cooperation deadlines of four weeks for another Netherlands municipality and ten weeks for a Caribbean authority or the Ministry of Foreign Affairs.
  5. Anyone else named is heard. Other people named in the declaration who are aged 12 or over, and legal representatives or the other parent, are given the opportunity on request to state their views.
  6. The decision. If the conditions are met, the authority must confirm your acquisition in writing — it has no discretion on the merits. It writes to you setting out how the confirmation will be made known and naming everyone it covers, and states at the same time in respect of whom confirmation is refused, with the objection deadline.
  7. Declaration of solidarity and handover. Adults and children aged 16 or over make the verklaring van verbondenheid. Handover must take place within nine weeks of it being established that the conditions are met. You become Dutch on handover, with effect back to the date the confirmation itself bears.

A copy of the whole file goes to the Minister for the public nationality register, and the file is archived for at least twelve years.

The legal deadline. Thirteen weeks from receipt of the declaration, extendable once by at most thirteen further weeks — an absolute maximum of twenty-six weeks (RWN art 6(5), in force since 1 October 2023). A further four weeks is added only where the authority seeks the Minister's advice on whether giving up another nationality can reasonably be required, which does not arise on the maternal-descent grounds.

The clock starts late. It runs only once the fee has been received or full exemption granted, and once any additional data and documents requested for the assessment have been supplied. An incomplete file postpones the start without anyone saying so. If you are formally put in default for an incomplete declaration, the thirteen weeks are suspended until the missing material arrives or the cure period expires.

Where the period ends. On a positive outcome it ends when you take receipt of the notification, in principle at a ceremony — not when the internal decision is taken. Since handover may itself take up to nine weeks after the conditions are found to be met, twenty-six weeks is the realistic ceiling whenever a ceremony is involved.

Silence confers nothing. If the deadline passes with no decision, nationality is not deemed confirmed.

If the authority is late (European Netherlands). You may serve a written notice of default. If two weeks then pass with no decision, a penalty payment begins to run automatically: € 23 per day for the first fourteen days, € 35 per day for the next fourteen, and € 45 per day thereafter, capped at forty-two days (Algemene wet bestuursrecht art 4:17, in force since 1 July 2026). You may appeal against the failure to decide at the same time. The penalty runs until the authority informs you in writing how the confirmation will be made known, or that it is refused. Note two limits: routine capacity problems are expressly not force majeure and do not suspend the period, and whether this penalty regime is available at all against a Governor's cabinet or in the BES islands is not established.

Real-world duration. No national processing-time series exists for option anywhere in the Kingdom — the IND holds only the confirmations, plays no part in handling, and never sees refusals. Aruba and Curaçao each self-report an average of six to nine months; Sint Maarten and the BES publish nothing.

The 2026 option tariffs took effect on 1 January 2026. They differ per constituency and are fixed amounts in each currency — they are not exchange-rate conversions of one another, so never convert between the columns.

European Netherlands (WBN 2025/3, Stcrt. 2025, 31825 of 19 September 2025): single € 241; joint € 412; each co-opting minor child € 27. The 2026 euro uplift was 4.4%.

Aruba (WBN-A 2025/3, Stcrt. 2025, 31841): single Afl. 501; joint Afl. 857; each minor Afl. 56. Uplift 13.9%.

Curaçao and Sint Maarten (WBN-CM 2025/3, Stcrt. 2025, 31847): single Cg 502; joint Cg 858; each minor Cg 56, in Caribische gulden. Uplift 13.8%. Caution: the Cabinet of the Governor of Sint Maarten publishes option figures of Cg 481 / Cg 823 / Cg 52 for 2026, which do not match the instrument that governs both islands. The instrument governs; underpaying risks the declaration being set aside.

Bonaire, Sint Eustatius and Saba (WBN-BES 2025/3, Stcrt. 2025, 31842): single US$ 282; joint US$ 481; each minor US$ 32. Uplift 13.9%.

Filing at a post abroad. The fee is paid to the head of the designated diplomatic or consular post, who retains the same amounts as a Netherlands municipality (€ 241 single, € 412 joint, € 27 per co-opting child) and remits the balance. Which currency schedule applies to a declaration lodged abroad is inferred to be the euro schedule from those retention figures, not expressly confirmed.

Payment mechanics. One instalment. If the fee is not paid within six weeks of receipt of the declaration, the declaration is set aside without being handled; that period is suspended while a request for exemption is pending. The receiving authority keeps the entire option fee — unlike naturalisation, where part is remitted to central government. There is no payment at all for a person treated as a Dutch national under the Wet betreffende de positie van Molukkers, and the Minister may exempt a minor filing independently or someone wrongly treated as Dutch for over a year through administrative error.

Finally: the consolidated online text of the fee decree has not been amended since 1 January 2011 and still shows 2011 amounts roughly 30 to 45 per cent below reality. Never quote it.

The maternal-descent family sits at article 6(1)(i) to (o). Article 6(1)(i) covers a person born before 1 January 1985 to a Dutch mother and a non-Dutch father and imposes no residence requirement; article 6(1)(j) covers a person adopted before 1 January 1985 in the Kingdom by a woman who was Dutch when the judgment became final; articles 6(1)(k) to (o) run to their children: born as their child, recognised before the age of seven, recognised during minority with proof of biological paternity, parentage judicially established, or adopted in the Kingdom during minority.

The surrounding rules are also in article 6: confirmation is mandatory where the conditions are met (article 6(3)); it is refused on conduct grounds (article 6(4)); and a previous acquisition by option confines you to two grounds thereafter (article 6(9)). No integration condition applies, that condition sitting in article 8(1), which governs only grants under article 7, and the renunciation duty is confined by article 6a(1) to article 6(1)(e). The Besluit verkrijging en verlies Nederlanderschap, in force since 1 March 2017, expressly permits demanding historical nationality data on parents and grandparents for these grounds. Policy, including the sequencing and no-backdating rules, is the Handleiding Rijkswet op het Nederlanderschap 2003, in force since 1 July 2026.

A refusal to confirm is an ordinary administrative decision and the refusal letter must state the objection deadline.

European Netherlands. Objection first, then two levels of court:

  • Bezwaar to the authority that decided, within six weeks running from the day after the decision was notified in the prescribed manner. There is no fee for a bezwaar. You have the right to be heard before it is decided, and the review is a full reconsideration of the decision, not a legality check. The authority decides within six weeks, or twelve where an advisory committee is involved, extendable once by six weeks.
  • Beroep to the rechtbank, within six weeks. Court fee for a natural person on the 2026 schedule: € 200 (Algemene wet bestuursrecht art 8:41(2)(b); amounts set by the Regeling of 14 November 2025, Stcrt. 2025, 39855, in force 1 January 2026). A reduced € 54 category exists for listed decision types, and a non-natural person pays € 397. The fee must be paid within four weeks of the registrar's notice, failing which the appeal is inadmissible unless the default is excusable or insolvency is proved.
  • Hoger beroep to the Afdeling bestuursrechtspraak van de Raad van State, within six weeks. Court fee for a natural person: € 297 (art 8:109(1)(b), same 2026 schedule); reduced category € 147; non-natural person € 596.

Total court cost for a natural person taking a case to the end in the European Netherlands in 2026 is therefore € 497, excluding legal fees and the option fee itself.

A point that matters to a diaspora cohort. If you have no residence in the Netherlands, the competent rechtbank is the one for the district in which the administrative body has its seat, not one chosen by you (Awb art 8:7(2)).

Outside the European Netherlands the chain is different law. Aruba, Curaçao and Sint Maarten apply their own Landsverordening administratieve rechtspraak; the BES islands apply the Wet administratieve rechtspraak BES, under which appeal lies to the Gerecht in eerste aanleg of Bonaire, Sint Eustatius and Saba within six weeks with a court fee of US$ 84, and onward to the Gemeenschappelijk Hof van Justitie. The BES objection deadline and the onward-appeal fee are not established and should not be assumed to mirror the Netherlands rules.

Not this route. The RWN's special legal-protection chapter — direct appeal with a four-week deadline — governs only withdrawal of nationality on national-security grounds and lapses on 1 March 2027.

Exceptions & edge cases

Confirmation is not retroactive to birth. This is the misunderstanding that does the most damage in this cohort. Acquisition by option confirmation has no retroactive effect: the date on the written confirmation fixes when you became Dutch. You are not treated as having been Dutch since birth, which has consequences for anything that turned on nationality in the intervening decades — including whether your own children acquired Dutch nationality at their birth. Children born before your confirmation do not acquire through you automatically; they must qualify under a derivative ground in their own right, and the sequencing rule means you must be confirmed first.

The single exception is the restoration ground for people who lost Dutch nationality automatically in circumstances disproportionate under EU law, where re-acquisition runs back to the moment of loss. It has no application to a person who never held Dutch nationality.

Missing the ceremony destroys the confirmation. A confirmation not made known to you within one year of the date it bears lapses by operation of law, and no objection or appeal lies against the lapse because it happens automatically. You would have to declare again. Two carve-outs: the year is suspended while an objection or appeal about the manner of the declaration of solidarity or of the notification is running; and where the authority failed to send three invitations within the year, the decision is treated as handed over in time and the person is Dutch.

Group effect. A single confirmation covers everyone named in it, so if the principal declarant does not appear, nothing is handed over for the children either, even if the children are present.

Consular handover has its own rules. Where personal handover cannot reasonably be required — including because of a travel distance that cannot reasonably be expected of the person — another mode of notification may be used, and notification by post is done in principle immediately and at the latest within one week. In Caribbean and consular settings the confirmation may be handed over or sent by post within a reasonable time, an open-textured standard rather than a fixed number of days.

Names. Where you have no surname or given name, or its spelling is not established, it is fixed in consultation with you and recorded in the confirmation, and names are transliterated into characters customary in the Kingdom. A name change is in principle not available on acquisition by option.

Non-recognised states. Documents are not required from Abkhazia, Northern Cyprus, South Ossetia or Taiwan, because no exchange of official documents takes place with states the Netherlands does not recognise.
