סקירה כללית
People in this cohort — born to a Dutch mother in the decades before the law was equalised — usually arrive with one of two very different questions, and the first thing to do is work out which one is yours, because the answers run through different institutions.
Question one: am I already Dutch? If you believe nationality vested in you at birth or by some later event and an authority disagrees, there is nothing to apply for. The instrument is a petition to have nationality established, decided by a court, from which only cassation lies.
Question two: I am not Dutch, but the law should have given it to me — can I still get it? Then the instrument is an optieverklaring, a written declaration under one of the seventeen grounds in article 6 of the Kingdom Act on Netherlands Nationality (Rijkswet op het Nederlanderschap, RWN), in force since 1 October 2023 with no amendment in force since (verified 25 July 2026). The relevant ground covers a person born before 1 January 1985 to a Dutch mother and a non-Dutch father, and it carries no residence requirement. Parallel grounds cover pre-1985 adoption by a Dutch woman, and the children of people in either category.
The practical difference matters. The first route asks a court to declare an existing state of affairs and, if it succeeds, you were Dutch all along. The second creates nationality from the date of the confirmation forward and not before. Choosing the wrong one wastes years.
One honest limit: whether the historic transitional declaration window that opened in the mid-1980s remains available in any form is not established in the sources verified for this pathway. The option ground family described above is what is in force now.

No residence, no language, no renunciation. The pre-1985 maternal-descent ground carries no residence requirement, so you need never have lived in the Kingdom. Option imposes no integration requirement at all — the policy manual states that confirmation cannot be refused because the declarant does not speak Dutch, and the structural reason is that the integration condition sits in article 8(1), which by its own terms governs only naturalisation. The duty to give up an existing nationality is confined by article 6a(1) to a single, different option ground and does not touch this family.
The sequencing rule. Where a child claims through one of the derivative grounds, the parent who qualifies on the pre-1985 maternal-descent or adoption ground must have acquired Dutch nationality first. The only relief is where that parent died before being able to acquire it, in which case the parent's compliance with the ground is investigated posthumously. Families frequently file in the wrong order and lose time.
The one-shot rule — a hard bar. Anyone who has at any time acquired Dutch nationality by option may afterwards use only two of the seventeen grounds: the ground for former Dutch nationals and the ground for disproportionate loss of EU citizenship (RWN art 6(9)). Someone who used a historic declaration window decades ago, and later lost nationality, cannot come back through the maternal-descent grounds.
Conditions must be met at the moment of confirmation, not merely when the declaration is lodged. A ground satisfied on the day of filing that has since lapsed will not carry, and the assessment is made against the position at confirmation.
Declaration of solidarity. Adults and minors aged 16 or over must be willing to make the verklaring van verbondenheid, whose wording is fixed by statute and cannot be varied. It is made in Dutch, normally orally and in person; a written declaration is permitted where an oral one cannot reasonably be required, and it is dispensed with where physical or psychological condition prevents it.
Conduct. Confirmation is refused where, on the basis of the person's conduct, serious suspicions exist that they present a danger to public order, good morals or the security of the Kingdom, unless obligations under international law preclude refusal. The ground is imperative — the deciding authority has no policy freedom.

A pre-1985 maternal claim is won or lost on documents, and the authority is expressly permitted to reach back two generations to test it.
What the declaration carries. Twelve categories of data, including — specifically for the pre-1985 maternal-descent ground family — historical nationality data on parents and grandparents (Besluit verkrijging en verlies Nederlanderschap art 6(1), in force since 1 March 2017). That reach-back power exists for these grounds and not generally.
The core of the file is proof that your mother held Dutch nationality at the material time: her birth certificate, historical population-register or predecessor-register extracts, an old passport, a declaration of possession of Dutch nationality, consular records. Where a derivative ground is used, the family-law relationship must also be established — a deed of recognition, an adoption judgment, or a judicial establishment of parentage. Your own birth certificate establishes your names under your own law and whether you have a surname at all.
Truth declaration. You must sign a written statement that the data are truthful and that you have concealed nothing relevant. Nationality obtained by option can later be withdrawn where acquisition rested on a false statement, fraud or concealment by the declarant; errors by the authorities are not held against you.
Legalisation and apostille. The authority may require documents that are, where necessary, legalised and where appropriate verified as to content. Legalisation confirms the authenticity of the signature, the capacity of the signatory and the identity of the seal — it never confirms that the contents are true, which is why a separate verification track exists and why an investigation may be ordered where a legalised document is suspected of being substantively wrong. In the Netherlands an apostille is a sticker issued by the courts; the Netherlands accepts digital apostilles issued abroad but issues paper only (Ministry of Foreign Affairs, Nederland Wereldwijd, consulted 25 July 2026). Stated honestly: the policy manual directs officials to the legalisation circular in force, but the most recent circular located lapsed on 1 January 2024 and no successor was found.
Where the paper no longer exists. Evidentiary impossibility is recognised where such deeds were never drawn up in that country, where the deed existed but the register was lost, or where an official report of the Ministry of Foreign Affairs has led to a decision not to require deeds from that country. For a historical claim the second of these is the common one, and it is the reason predecessor population registers, church records and consular files carry weight.
Translation. European Netherlands: required where the document is in a language other than Dutch, English, German or French, by a sworn translator, preferably into Dutch, and physically attached to the original or certified copy. BES islands: anything other than Dutch or English. For Aruba, Curaçao and Sint Maarten the trigger set is not established.
No second submission. Documents already legalised or apostilled and processed into the population administration or a Dutch civil-status deed need not be produced again unless there is well-founded doubt.

Route one — petition to establish nationality (RWN art 17, in force since 1 October 2023).
Anyone with an immediate interest, outside proceedings already pending before a court or on administrative appeal anywhere in the Kingdom, may petition:
- the rechtbank Den Haag, if resident in the European Netherlands or outside the Kingdom; or
- the Gemeenschappelijk Hof van Justitie, if resident in Aruba, Curaçao, Sint Maarten or the public bodies Bonaire, Sint Eustatius and Saba.
The forum follows where the petitioner lives, not where the claim arose. Critically for a historical cohort, the petition may also be brought in respect of a deceased person — which is how a chain running through a mother or grandmother who has died can be established. The Minister is an interested party; the rechtbank hears the State and the Gemeenschappelijk Hof hears the public prosecutor. Once irrevocable, the decision binds every body charged with executing any statutory scheme. A court dealing with some other matter may ask the Minister for advice on a nationality question, and a body hearing an administrative appeal must stay its proceedings until that is resolved.
Route two — option declaration.
The declaration is lodged in person with the authority for where you live: the burgemeester of your municipality in the European Netherlands; the Minister, in practice through the IND unit Caribbean Netherlands, for Bonaire, Sint Eustatius and Saba; the Governor of Aruba, Curaçao or Sint Maarten; or the Minister of Foreign Affairs at the diplomatic or consular post in whose district you have your principal residence. Only the authority for your own catchment may handle it. It is date- and service-stamped on receipt and you are given a copy.
The fee is checked before the file is taken into handling. The authority then assesses the ground on the basis of the documents you submit, cross-checks against the population administration, and asks other authorities in the Kingdom to verify where your history sits elsewhere. If the conditions are met it must confirm in writing — there is no discretion on the merits. Adults and children aged 16 or over then make the verklaring van verbondenheid, the declaration of solidarity, and the confirmation is handed over within nine weeks of the conditions being found to be met. You become Dutch on that handover, with effect back to the date the confirmation bears.

Option declaration. Thirteen weeks from receipt, extendable once by at most thirteen further weeks — an absolute ceiling of twenty-six weeks (RWN art 6(5), in force since 1 October 2023). The clock does not start on filing: it starts once the fee has been received or fully waived and once any requested supplementary data and documents have been supplied. An incomplete historical file — and these files are frequently incomplete — silently postpones the start. Where you are formally put in default, the period is suspended until the missing material arrives or the cure period expires.
The period ends when you take receipt of the notification, in principle at a ceremony, not when the internal decision is taken. Because handover may take up to nine weeks after the conditions are found to be met, twenty-six weeks rather than thirteen is the realistic ceiling.
Silence confers nothing. If the deadline passes with no decision, nationality is not deemed confirmed. In the European Netherlands you may serve a written notice of default, after which a penalty payment runs automatically from two weeks later at € 23 per day for the first fourteen days, € 35 for the next fourteen and € 45 thereafter, capped at forty-two days (Algemene wet bestuursrecht art 4:17, in force since 1 July 2026). Routine capacity problems are expressly not force majeure. Whether this regime is available against a Governor's cabinet or in the BES islands is not established.
No real-world option statistics exist. The IND holds only the confirmations, plays no part in handling option files and never sees refusals, so no national processing-time series is published anywhere in the Kingdom (IND, Monitor Naturalisatie en Optie 2018-2024, June 2025). Aruba and Curaçao each self-report an average of six to nine months; Sint Maarten and the BES publish nothing.
Petition to establish nationality. No statutory decision period for this procedure appears in the RWN, and none is established in the sources verified here. Nor does any time limit for bringing the petition appear in article 17; whether a general civil limitation period applies was not established. For contrast, where the question is statelessness rather than nationality, the separate statelessness-determination procedure gives the court six months, extendable once by six months (Wet vaststellingsprocedure staatloosheid art 3(3), in force since 1 October 2023).

Option declaration. The 2026 tariffs took effect on 1 January 2026 and differ per constituency. They are fixed amounts in their own currencies, not conversions of one another.
- European Netherlands — single € 241, joint € 412, each co-opting minor € 27 (WBN 2025/3, Stcrt. 2025, 31825 of 19 September 2025).
- Aruba — Afl. 501 / 857 / 56 (WBN-A 2025/3, Stcrt. 2025, 31841).
- Curaçao and Sint Maarten — Cg 502 / 858 / 56 in Caribische gulden (WBN-CM 2025/3, Stcrt. 2025, 31847). The Sint Maarten Governor's website publishes lower option figures for 2026 that do not match this instrument; the instrument governs.
- Bonaire, Sint Eustatius and Saba — US$ 282 / 481 / 32 (WBN-BES 2025/3, Stcrt. 2025, 31842).
Filing at a post abroad: the fee is paid to the head of the designated post, who retains the same amounts as a Netherlands municipality. That the euro schedule applies to a declaration lodged abroad is inferred from those retention figures, not expressly confirmed.
If the fee is not paid within six weeks of receipt of the declaration, the declaration is set aside without being handled. The period is suspended while a request for exemption is pending. The receiving authority keeps the whole option fee. No payment at all is due from a person treated as a Dutch national under the Wet betreffende de positie van Molukkers.
Petition to establish nationality. This is a court petition and the ordinary civil court-fee schedule applies. On the schedule in force since 1 January 2026 (Regeling of 14 November 2025, Stcrt. 2025, 39855), a petition of unspecified value at the rechtbank costs € 341 for a natural person, € 93 for a person of limited means, and € 735 for a non-natural person. Because only cassation lies from that decision, the onward figure is the Hoge Raad tariff for a petition of unspecified value: € 386 for a natural person and € 932 for a non-natural person.
One qualification stated openly: the tariff amounts are verified, but the classification of a nationality-status petition as a petition of unspecified value is an inference from the structure of the schedule and is not expressly stated in any source.
A standing warning: the consolidated online text of the fee decree has not been amended since 1 January 2011 and still displays 2011 amounts. Never quote it as current.

Against a refusal to confirm an option declaration. The refusal is an ordinary administrative decision and the refusal letter must state the objection deadline.
In the European Netherlands: bezwaar to the deciding authority within six weeks, free of charge, with a right to be heard and a full reconsideration rather than a legality check; the authority decides within six weeks, or twelve where an advisory committee is involved, extendable once by six weeks. Then beroep to the rechtbank within six weeks, court fee € 200 for a natural person on the 2026 schedule, payable within four weeks of the registrar's notice on pain of inadmissibility. Then hoger beroep to the Afdeling bestuursrechtspraak van de Raad van State within six weeks, court fee € 297. Total € 497 for a natural person taking a case to the end, excluding legal fees.
If you have no residence in the Netherlands — the normal position in this cohort — the competent rechtbank is the one for the district in which the administrative body has its seat.
Outside the European Netherlands the applicable procedural law is different: Aruba, Curaçao and Sint Maarten apply their own Landsverordening administratieve rechtspraak, and the BES islands the Wet administratieve rechtspraak BES, under which appeal lies to the Gerecht in eerste aanleg of Bonaire, Sint Eustatius and Saba within six weeks with a court fee of US$ 84, and onward to the Gemeenschappelijk Hof van Justitie. The BES objection deadline and onward-appeal fee are not established.
Against the outcome of a petition to establish nationality. There is no ordinary appeal on the facts. Only cassation lies (RWN art 18(2)). That makes the first-instance hearing your single factual opportunity, which is why the documentary preparation described above is decisive rather than merely advisable.
Standard of review on refusals. On domestic refusal grounds the appellate courts review with restraint, and departure from published policy calls for very great restraint — though departure is required where only that produces a correct application of the law (Afdeling bestuursrechtspraak van de Raad van State, 20 June 2018, ECLI:NL:RVS:2018:2056). Whether that formulation stands unchanged today is not established. Where EU law is engaged because nationality and EU citizenship were lost, review of the proportionality assessment is intensive rather than deferential (same court, 5 February 2025, ECLI:NL:RVS:2025:421).
Exceptions & edge cases
Option does not make you retrospectively Dutch. Acquisition by option confirmation has no retroactive effect; the date on the written confirmation fixes the moment of acquisition. For a cohort whose grievance is precisely that nationality should have vested decades ago, this is the hardest point to absorb, and it has a concrete consequence: children born to you before your confirmation do not acquire Dutch nationality through you automatically. They must qualify under a derivative ground of their own, and the sequencing rule means you must be confirmed first.
The only retroactive option ground is the one for people who lost Dutch nationality automatically where that loss also removed EU citizenship and the consequences were disproportionate under EU law; re-acquisition there runs back to the moment of loss. It is unavailable to someone who never held Dutch nationality.
Missing the ceremony destroys the confirmation. A confirmation not made known to the declarant within one year of the date it bears lapses by operation of law, and no objection or appeal lies against the lapse. Two carve-outs: the year is suspended while an objection or appeal about the manner of the declaration of solidarity or of the notification is running; and where the authority failed to send three invitations within the year, the decision is treated as handed over in time and the person is Dutch.
Distance is recognised. Where personal handover cannot reasonably be required — expressly including because of a travel distance that cannot reasonably be expected of the person — another mode of notification may be chosen, and notification by post is made in principle immediately and at the latest within one week. In Caribbean and consular settings the confirmation may be handed over or sent by post within a reasonable time, an open-textured standard.
Deceased ancestors are not a dead end for the status-determination route: the petition may be brought in respect of a deceased person, which is how a broken chain is sometimes repaired.
You cannot run the same question twice. The status-determination petition is available only outside proceedings already pending before a court or on administrative appeal anywhere in the Kingdom.
Names. A name change is in principle not available on acquisition by option, unlike naturalisation. Where you have no surname or given name, or its spelling is not established, it is fixed in consultation with you and recorded in the confirmation.
