סקירה כללית
For families whose Dutch connection runs through the former Netherlands Indies, the decisive legal question is usually not whether an ancestor was Dutch in the everyday sense, but whether the person in your line held Dutch nationality or the status of Nederlands onderdaan-niet-Nederlander — Netherlands subject who was not a Netherlands national. That second status matters enormously here, because the Kingdom Act on Netherlands Nationality (Rijkswet op het Nederlanderschap, RWN, in force in its present form since 1 October 2023, verified 25 July 2026) treats the two identically for the two most useful provisions in this pathway.
Where the chain of Dutch nationality is unbroken, the child of a Dutch parent is Dutch by descent and nothing is applied for. Where the chain broke — because an ancestor took Indonesian nationality, or because the documentation cannot carry the claim — two distinct instruments remain open, and they trade off against each other:
- An option declaration on the former-nationals ground. Cheap and non-discretionary, but it demands that the person relocate to the Kingdom and accrue a year of indefinite-status residence there. It is not exercisable from abroad.
- Naturalisation with the residence period disapplied. The five-year residence requirement does not apply to a person who has at some time held Dutch nationality or the status of Netherlands subject who was not a Netherlands national. That is a very substantial concession, but naturalisation is a discretionary grant, costs several times more, and still carries the language and integration requirement.
A third possibility exists where a person once held Dutch nationality and believes they still do: a court petition to have nationality established, which if it succeeds confirms a state of affairs rather than creating one.

דרישות
Option on the former-nationals ground. You must be an adult; you must at some time have held Dutch nationality or the status of Nederlands onderdaan-niet-Nederlander; and you must have at least one uninterrupted year of admission for an indefinite period together with principal residence in the Kingdom at the moment of confirmation. Two details defeat people: time spent as a Dutch national does not count toward that year — it must be accrued as a foreign national — and the admission must be indefinite, not a fixed-term permit. Residence gaps break the period.
Exclusions: anyone who lost Dutch nationality through withdrawal for failing to give up another nationality after naturalisation or option cannot use this ground. Nor can a person whose pre-2003 fraudulent naturalisation was withdrawn, who is deemed never to have held Dutch nationality for the purposes of this ground.
This ground is also one of only two still open to someone who has previously acquired Dutch nationality by option, the other being the ground for disproportionate loss of EU citizenship.
Option imposes no language or integration requirement and, for this ground, no obligation to give up another nationality — that duty is confined to a single, different option ground.
Naturalisation. The five-year residence and principal-residence requirement does not apply to a person who has at some time held Dutch nationality or the status of Netherlands subject who was not a Netherlands national (RWN art 8(2)). The other conditions in article 8(1) remain, and they include:
- Language at CEFR A2 across all four skills — speaking, listening, reading and writing (Besluit naturalisatietoets arts 3(1)(h)(2) and 5(1), in force since 26 May 2022). B1 is sufficient but has never been required. Where your principal residence is in the Caribbean part of the Kingdom the requirement is cumulative: Dutch and the language current on the island.
- Willingness to make the verklaring van verbondenheid, the declaration of solidarity, whose wording is fixed by statute; the granting decision is not made known until it has actually been made.
- Good character. The application is refused where, on the basis of your conduct, serious suspicions exist that you present a danger to public order, good morals or the security of the Kingdom. The rehabilitation period is five years, raised from four with effect from 1 May 2018; applications made before that date keep the four-year period.
- Renunciation of another nationality, unless that cannot reasonably be required. Four statutory exemptions apply, including for a person born in the Netherlands, Aruba, Curaçao or Sint Maarten with principal residence there at the time of the application, and for a person married to a Dutch national.
Whether the remaining article 8(1) conditions can in practice be satisfied by an applicant living outside the Kingdom is not established in the sources verified here.

This is where Indies-descent claims succeed or fail. The chain that has to be built typically runs: proof of the ancestor's Dutch nationality or Netherlands-subject status before independence; documentation of what happened to it; and an unbroken line of civil-status records down to you.
Proof of former Dutch nationality. Evidence accepted in this class includes an old passport, a bewijs van Nederlanderschap — a declaration of possession of Dutch nationality — historical extracts from the population register or its predecessors, and consular records. Where the option ground is used you must also produce a permanent residence document and population-administration history covering the qualifying year.
Where the paper no longer exists. Evidentiary impossibility, bewijsnood, is recognised for a civil-status deed where such deeds are or were never drawn up in that country; where the deed was drawn up but the register was lost; or where an official report of the Ministry of Foreign Affairs has led to a decision not to require deeds from that country. For colonial-era records the second of these is the one that matters, and it is why predecessor population registers and consular files carry weight. Where a country has no civil-status system, an alternative proof is requested — a hospital birth certificate or a family-booklet entry.
Legalisation, and a genuine gap in the chain of authority. The policy manual, in force from 1 July 2026, directs officials to apply the legalisation circular currently in force. The most recent such circular located lapsed on 1 January 2024 and no successor was found. Its text is therefore stated here as historic content, not current law — and one of its provisions was squarely relevant to this cohort: it listed structural exemptions from legalisation for documents from Indonesia, New Guinea and Suriname. Do not assert that exemption is in force today; equally, do not assume it was abolished. Check before relying on it.
What legalisation does and does not prove. It confirms the authenticity of the signature, the capacity of the signatory and the identity of the seal — never that the contents are true. A separate verification track exists, and where there are indications that a legalised document is substantively incorrect the IND decides whether a verification investigation is run. For states party to the Apostille Convention the apostille is the short route; in the Netherlands it is a sticker issued by the courts, and the Netherlands accepts digital apostilles issued abroad but issues paper only.
Translation. European Netherlands: required where the document is in a language other than Dutch, English, German or French, by a sworn translator, preferably into Dutch, physically attached to the original or certified copy. BES islands: anything other than Dutch or English. The trigger set for Aruba, Curaçao and Sint Maarten is not established.
No second submission. Documents already legalised or apostilled and processed into the population administration or a Dutch civil-status deed need not be produced again, unless there is well-founded doubt.
For naturalisation specifically, add: your own birth certificate and those of any children included; marriage certificate and any divorce or repudiation deed, which exist to detect polygamy; a valid foreign passport; and a signed verklaring verblijf en gedrag, a declaration of residence and conduct. Note that there is no Verklaring Omtrent het Gedrag in this procedure — the authorities instead obtain a judicial-records extract and run a police-systems check.

Instrument one — option declaration on the former-nationals ground.
The declaration is lodged in person with the authority for where you live: the burgemeester of your municipality in the European Netherlands; the Minister, in practice through the IND unit Caribbean Netherlands, for Bonaire, Sint Eustatius and Saba; the Governor of Aruba, Curaçao or Sint Maarten. Because the ground requires residence in the Kingdom, the consular route is not a realistic entry point for it. The declaration is date- and service-stamped on receipt and you are given a copy. The fee is checked before the file is taken into handling. The authority assesses the ground on the documents put before it and cross-checks the population administration; where it cannot establish unbroken admission from your residence document and the population data, it must obtain a report on admission from the IND. If the conditions are met it must confirm in writing — there is no discretion on the merits. The declaration of solidarity follows, and handover takes place within nine weeks of the conditions being found to be met. You become Dutch on handover, with effect back to the date the confirmation bears.
Instrument two — naturalisation.
You file with the burgemeester, the Governor or the IND unit Caribbean Netherlands, depending on where you live, or at a Dutch diplomatic or consular post if you are outside the Kingdom. Filing is in person. If documents are missing at filing you have six weeks to complete the file. The receiving authority investigates, then advises the Minister; in Aruba, Curaçao and Sint Maarten the file additionally passes through that country's Minister of Justice, who adds a second advice. The IND assesses; if granted, the Minister proposes you to the King and a Koninklijk Besluit issues. You are summoned within six weeks of the date the decree bears and the handover takes place within six weeks of the summons being sent. Nationality vests on that handover, retroactively to the date of the decree.
Instrument three — petition to establish nationality. Where you contend you already are Dutch, the route is a court petition rather than an application: to the rechtbank Den Haag if you live in the European Netherlands or outside the Kingdom, or to the Gemeenschappelijk Hof van Justitie if you live in Aruba, Curaçao, Sint Maarten or the BES islands. It may be brought in respect of a deceased person — often the only way to fix a broken generational link. Only cassation lies against the outcome.

Option. Thirteen weeks from receipt of the declaration, extendable once by at most thirteen further weeks — a ceiling of twenty-six weeks (RWN art 6(5), in force since 1 October 2023). The clock starts only once the fee has been received or fully waived and the requested supplementary material has been supplied. There is no positive silence. The period ends when you take receipt of the notification, in principle at a ceremony, so twenty-six weeks rather than thirteen is the realistic ceiling. No national processing-time series exists for option anywhere in the Kingdom, because the IND holds only the confirmations and never sees refusals; Aruba and Curaçao each self-report an average of six to nine months.
Naturalisation.One year, running from the latest of payment of the fee, the decision fully waiving payment, or receipt of the supplementary material requested for the assessment (RWN art 9(4)). In practice the year begins only once all documents necessary for the assessment have been received. The decision may then be held — the statute says aangehouden, not extended — at most twice by six months, giving an absolute ceiling of two years. The period ends when you take receipt of the notification at the ceremony, not when the IND decides.
What actually happens. The most recent published per-stage figures are for 2024 (IND, Monitor Naturalisatie en Optie 2018-2024, final report, June 2025). For the European Netherlands, the applicant-experienced time from filing at the municipality to the ceremony fell from 344 days in 2018 to 182 days in 2024; the municipal stage took 13 days in 2024; the IND stage on granted cases fell from 254 days in 2018 to 95 days in 2024; and the Kabinet van de Koning stage took 18 days in 2024, against a seven-year average of 21. Refusals take much longer — 241 days at the IND in 2024.
Per place of filing over 2018-2024, the share of granted requests reaching a ceremony within one year was 82% in the European Netherlands, 77% at diplomatic posts, 67% in Sint Maarten, 49% in Curaçao, 44% in the BES islands and 42% in Aruba. Do not generalise the European figure.
If the authority is late (European Netherlands). After a written notice of default and two further weeks, a penalty payment runs automatically at € 23 per day for the first fourteen days, € 35 for the next fourteen and € 45 thereafter, capped at forty-two days. Routine capacity problems are expressly not force majeure. Whether this regime is available outside the European Netherlands is not established.

The reduced tariff is for stateless persons and holders of an asylum residence permit or comparable Caribbean permit. The 2026 uplift was 4.4% in euro but 13.9% for Aruba and the BES islands and 13.8% for Curaçao and Sint Maarten, because the currency conversion is done at the euro exchange rate of 1 July of the preceding year. These are fixed amounts in their own currencies — do not convert between them.
Payment mechanics. One instalment, to the burgemeester in the European Netherlands, the Governor in Aruba, Curaçao and Sint Maarten, the Minister for the BES islands, or the head of the designated diplomatic or consular post abroad. If the fee is not paid within six weeks of receipt of the declaration or request, it is set aside without being handled; that period is suspended while a request for exemption is pending.
No payment at all is due from a person treated as a Dutch national under the Wet betreffende de positie van Molukkers. The Minister may also waive the naturalisation fee for a minor filing independently, for a person wrongly treated as Dutch for over a year through administrative error, and where naturalisation is granted in the interest of or for merit to the State — but not where the error was caused by the applicant's own fraud or carelessness.
The consolidated online text of the fee decree has not been amended since 1 January 2011 and shows amounts roughly a third to a half below reality. Never quote it.

ערעורים וביקורת
Against a refusal of naturalisation or of an option confirmation, in the European Netherlands.Bezwaar first, within six weeks running from the day after the decision was notified in the prescribed manner. There is no fee; you have the right to be heard; and the review is a full reconsideration, not a legality check. The authority decides within six weeks, or twelve where an advisory committee is involved, extendable once by six weeks. Then beroep to the rechtbank within six weeks, court fee € 200 for a natural person on the 2026 schedule (Regeling of 14 November 2025, Stcrt. 2025, 39855), payable within four weeks of the registrar's notice on pain of inadmissibility. Then hoger beroep to the Afdeling bestuursrechtspraak van de Raad van State within six weeks, court fee € 297. Total € 497 for a natural person taking a case to the end, excluding legal fees.
If you live outside the Netherlands, the competent rechtbank is the one for the district in which the administrative body has its seat, not one you choose.
Elsewhere in the Kingdom the procedural law is different. The Netherlands General Administrative Law Act does not run in Aruba, Curaçao or Sint Maarten, which apply their own Landsverordening administratieve rechtspraak, nor in the BES islands, which apply the Wet administratieve rechtspraak BES. Deadlines coincide at six weeks; courts, fees and currencies do not. In the BES islands appeal lies to the Gerecht in eerste aanleg of Bonaire, Sint Eustatius and Saba with a court fee of US$ 84, and onward to the Gemeenschappelijk Hof van Justitie; the BES objection deadline and onward-appeal fee are not established.
Where you say you already are Dutch, the remedy is not an appeal but a petition to have nationality established, and only cassation lies from the court's decision. The forum follows residence: rechtbank Den Haag for residents of the European Netherlands and of countries outside the Kingdom, Gemeenschappelijk Hof van Justitie for Caribbean residents. It may be brought in respect of a deceased person. Once irrevocable, the decision binds every body charged with executing any statutory scheme.
Standard of review. On domestic refusal grounds the courts review with restraint, and departing from published policy calls for very great restraint, though departure is required where only that produces a correct application of the law (Afdeling bestuursrechtspraak van de Raad van State, 20 June 2018, ECLI:NL:RVS:2018:2056). Whether that formulation stands unchanged today is not established. Where EU law is engaged because nationality and EU citizenship were lost, the proportionality assessment is reviewed intensively (same court, 5 February 2025, ECLI:NL:RVS:2025:421).
Exceptions & edge cases
The residence clock aggregates across the Kingdom. The five-year residence condition lists the European Netherlands, Aruba, Curaçao, Sint Maarten and the BES public bodies disjunctively, in one list. Time in any of them counts toward an application made in any other. The reduced periods work the same way — two years for someone with ten years in those territories in total, three years for a stateless person or for a three-year cohabiting partner of a Dutch national.
But the integration credential does not travel. A Caribbean certificate annotated for English or Papiamentu is recognised only on the islands where that language is current alongside Dutch. Someone who qualified on Saba in Dutch and English and then applies in Curaçao keeps the residence clock and loses the credential. Movement between the Papiamentu zone and the English zone preserves one and destroys the other.
A residence gap resets to zero. Lawful admission must be uninterrupted; a verblijfsgat does not pause the clock, it restarts it. There is no gap where you applied for extension in time and met the conditions then, or where the IND grants the new permit immediately consecutive to the old one even on a late application.
Absence rules that catch returnees. Relocation abroad is assumed where you have stayed outside the Netherlands for more than six consecutive months, rebuttable only by circumstances beyond your fault; and where, for the third consecutive year, you have stayed abroad more than four consecutive months, rebuttable by showing the centre of your activities did not move. Notifying the police in advance of an intended absence of not more than six months is a positive indication. Use of a remigration scheme conclusively establishes relocation abroad — a point of direct relevance to families who used one.
Registration as a non-resident counts against you. Being registered in the population administration as niet-ingezetene is expressly listed as an indication that principal residence has moved abroad. It is evidence against the residence requirement, not for it.
Missing the ceremony destroys the grant. A naturalisation decree or an option confirmation not made known within one year of the date it bears lapses by operation of law, with no objection or appeal against the lapse. Two carve-outs: the year is suspended during an objection or appeal about the manner of the declaration or the notification, and where the authority failed to send three invitations within the year the decision is treated as handed over in time.
Anchor that year to the decree, not to the IND letter. The decree post-dates the IND's proposal by roughly two to three weeks on the published figures.
A proposal that is not law. A legislative proposal to extend the general naturalisation residence term from five to ten years exists. As of 25 July 2026 it has not been submitted to parliament, is not in force, and is not law. The term in force is five years — and in this cohort it may not apply at all, because the residence period is disapplied for former Dutch nationals and former Netherlands subjects.
