סקירה כללית
This is not a pathway you apply on. The European Convention on Nationality is a treaty framework: it constrains what a state party may do in its nationality law, but it does not itself put an application in an individual's hands. In Dutch practice the effect of nationality treaties surfaces inside the ordinary option and naturalisation procedures — as exemptions written into the Rijkswet op het Nederlanderschap, and as a limit on the power to refuse — and not as a separate procedure with its own form, fee, decision-maker and appeal.
The research underlying this country's documentation covers the Rijkswet, its implementing decree and regulation, the binding policy manual, the fee decree, and the general administrative-procedure and court-fee instruments. It does not decode the text of the European Convention on Nationality. This page therefore states what is verifiable about how treaty obligations actually operate inside Dutch nationality decisions as of 2026-07-25, and does not restate the Convention's articles — doing so would mean writing from memory rather than from source, which is exactly the failure mode this knowledge base exists to avoid.

If you believe a treaty obligation has been breached in your case, the place to raise it is in the objection and appeal against the decision that affects you — not in a free-standing treaty procedure.

No application exists. A nationality treaty constrains what a state may do; it does not put a claim in an individual's hands. Nothing in the Dutch instruments relied on here creates a free-standing treaty procedure; a treaty argument is raised inside the objection and appeal against the decision that affects you.
What the evidence does not cover. The text of the European Convention on Nationality was not decoded in the research behind this documentation. Its articles are therefore not restated here, and nothing on this page should be read as a statement of their content.
Where treaty obligations demonstrably bite. First, the power to refuse. The Rijkswet directs the receiving authority to refuse an option confirmation where the person's conduct gives rise to serious suspicions that they present a danger to public order, good morals or the security of the Kingdom - unless obligations under international law preclude this (article 6(4)). The implementing decree gives that clause effect by exempting two option grounds from the public-order investigation altogether: the ground for a person born in the Kingdom and stateless since birth, and the ground for a minor recognised by a Dutch national.
Second, renunciation. The four statutory exemptions from the duty to do what is possible to lose another nationality are: nationals of a state party to the Second Protocol of 2 February 1993 to the 1963 Strasbourg Convention; a person born in the Netherlands, Aruba, Curacao or Sint Maarten who has their main residence there at the time of the application; a person married to a Dutch national; and a person recognised as a refugee in one of those territories (article 9(3)(a) to (d), mirrored at article 6a(2)). The binding policy states expressly that these rest on treaty obligations, in particular that Second Protocol and the 1951 Refugee Convention.
A trap worth knowing. Since 4 June 2010 only the Netherlands, for the whole Kingdom, remains a party to the Second Protocol, and the policy states its provisions are consequently not applied in practice. The exemption nonetheless survives, because since 1 April 2003 the Rijkswet extends it to the Protocol's target groups whether or not the person's own state is a party. Separately, Chapter 1 of the 1963 Strasbourg Convention has been in force for the whole Kingdom since 10 June 1985, binds only the Netherlands and Austria, and has direct effect.

הרשות המוסמכת
אין גוף לפנות אליו, כי אין פנייה. אמנת לאום מחייבת את המדינה; הוא אינו יוצר הליך עם משרד, טופס, מקבל החלטות או ערעור משלו. נכון ל-25 ביולי 2026, שום דבר במסמכים ההולנדים שעליהם מסתמכים כאן לא קובע שולחן אמנה, רישום או תרופה, ואין להניח שאף אחד מהם.
התחייבויות האמנה צצות בתיק של מישהו אחר במקום זאת. הרשות המוסמכת היא כל גוף שמטפל בהצהרת האופציה או בקשת ההתאזרחות שהגשת בפועל: הבורגר בהולנד האירופית, הקבינט של המושל בארובה, קוראסאו או סינט מרטן, השר באמצעות יחידת הולנד הקאריבית של שירות ההגירה בבונייר, סנט אוסטטיוס וסבא, או עמדה קונסולרית הולנדית בחו"ל. לגבי מענק התאזרחות, מכשיר ההכרעה נשאר הצו המלכותי.
טיעון אמנה מובא בפני גוף זה, ולאחר מכן בהתנגדות ובערעור על החלטתו: ה-rechtbank ומחלקת השיפוט המנהלי של מועצת המדינה בהולנד האירופית, וה-Gerecht in eerste aanleg ואחריו ה-Gemeenschappelijk Hof במחוזות הבחירה בקריביים.
Exceptions & edge cases
Three places where treaty obligations demonstrably bite in Dutch nationality decisions, all as of 2026-07-25.
1. Refusal on public-order grounds is capped by international law. The Rijkswet directs the receiving authority to refuse an option confirmation where the person's conduct gives rise to serious suspicions that they present a danger to public order, good morals or the security of the Kingdom — "unless obligations under international law preclude this" (article 6(4), in force since 2023-10-01). That clause is operationalised in the implementing decree, which exempts two option grounds from the public-order investigation altogether: the ground for a person born in the Kingdom and stateless since birth, and the ground for a minor recognised by a Dutch national. A minor under 16 using the joint-authority ground is likewise outside the test.
2. The renunciation exemptions rest on treaty obligations. The four statutory categories exempt from the duty to give up another nationality are: nationals of a state party to the Second Protocol of 2 February 1993 to the 1963 Strasbourg Convention; a person born in the Netherlands, Aruba, Curaçao or Sint Maarten who has their main residence there at the time of the application; a person married to a Dutch national; and a person recognised as a refugee in one of those territories (Rijkswet article 9(3), mirrored for option purposes at article 6a(2)). The binding policy states expressly that these rest on treaty obligations, in particular that Second Protocol and the 1951 Refugee Convention.
3. A live trap on the Second Protocol. Since 2010-06-04 only the Netherlands, for the whole Kingdom, remains a party — France ceased in 2009 and Italy in 2010 — and the policy manual states that its provisions are consequently not applied in practice. The exemption nonetheless survives, because since 2003-04-01 the Rijkswet extends it to the Protocol's target groups regardless of whether the person's own state is a party. Secondary sources routinely get this backwards.
Separately, Chapter 1 of the 1963 Strasbourg Convention has been in force for the whole Kingdom since 1985-06-10, binds only the Netherlands and Austria, and has direct effect.
