סקירה כללית

Foreign military service can cost you Dutch nationality, but not by itself and not silently. The governing provision is art 14(3) of the Rijkswet op het Nederlanderschap: the Minister may withdraw Dutch nationality from a person aged 16 or over who voluntarily enters the military service of a state involved in combat operations against the Kingdom, or against an alliance to which the Kingdom belongs (consolidated text in force since 1 October 2023, read 25 July 2026).

Read the word may. This is a discretionary ministerial decision, not loss by operation of law. Nothing falls away on the day of enlistment, and no one becomes a former Dutch national merely by meeting the description. Withdrawal happens only if the Minister decides to withdraw.

The corollary is the part that costs people their nationality. Because it is a decision, you can fight it, and the ordinary administrative time limits run against it. Only the first runs from the withdrawal: six weeks to object, from the day after the decision is notified to you (Algemene wet bestuursrecht arts 6:7 and 6:8, consolidated text in force since 1 July 2026). Each later period runs from the decision before it: six weeks to appeal once the objection is decided, then six weeks again to go higher once the court has ruled — that last term is a derivation rather than a directly confirmed rule, so check it before relying on it. Miss a term and the withdrawal will normally stand. Two provisions can still rescue a late filing: one posted in time counts if it arrives within a week of the term expiring (art 6:9), and lateness is excused where the filer cannot reasonably be blamed (art 6:11). Neither is automatic. Any letter about your nationality is urgent on the day it arrives.

Two limits are built into the power itself. It may not be used where the withdrawal would leave the person stateless (RWN art 14(8)). And once used, it bars getting Dutch nationality back: art 14(5) blocks re-acquisition after such a withdrawal, subject to an exception granted by Royal Decree available after five years, the Council of State having been heard.

Three neighbouring subjects are often confused with this one and are not it. Withdrawal on national-security grounds under art 14(4) has its own separate, faster appeal route. Art 15(1)(d) and (e) concern withdrawal for failure to renounce another nationality, and art 15(2) is a carve-out from loss on voluntarily acquiring another nationality. And the restoration option in art 6(1)(p) is built for disproportionate automatic loss; it is not the remedy against a withdrawal under art 14(3).

There is no document checklist for losing Dutch nationality, because nothing is filed. What follows is what a restoration claim under RWN art 6(1)(p) has to be built from.

The burden of proof is on you. You must state and make plausible the relevant facts, with evidence, and greater weight is given to documents issued by official government bodies (ECLI:NL:RVS:2020:423, 12 February 2020, drawing on the policy manual in force since 1 July 2026).

The controlling rule about all of it: every piece of evidence must relate to the moment of loss. Ties to Europe that developed afterwards do not assist, however strong.

What that means in practice. The immigration service applies a two-step test — were you exercising, or reasonably foreseeably about to exercise, rights derived from EU citizenship at that moment, and were you impeded in exercising them by the loss. A failure at either step produces a negative advice, and most cases fail at the first. So assemble:

  • Proof that you were exercising EU-derived rights at the date of loss, or were about to: employment or study in an EU member state, or documented steps towards it.
  • Proof of residence in an EU member state at that date, and of your address history around it.
  • Evidence of the family relationships you rely on, as they stood then.
  • Evidence that the loss actually obstructed you. The pattern the immigration service identified as succeeding is a job interview in an EU member state around the time of loss, combined with a statement obtained afterwards from that employer that it could not or would not sponsor a residence permit.

What tends to defeat a claim is equally concrete: being a national of a country whose citizens travel visa-free within the EU, or who can obtain a visa or residence permit without real difficulty (IND, Invoeringstoets Tjebbes, July 2023).

Alongside the substantive evidence, the ordinary identity documents for an option declaration apply — proof of identity and of your former Dutch nationality, such as an expired Dutch passport, a declaration of possession of Dutch nationality, a historical population-register extract or consular records.

Three clocks matter here and they run on different scales.

The restoration decision period. An option declaration must be decided within 13 weeks of receipt, extendable once by at most 13 weeks, giving an absolute maximum of 26 weeks (RWN art 6(5); consolidated text in force since 1 October 2023). Extensions are routine in this category. The 13 weeks do not start on filing: they start once the fee has been paid or fully waived and any requested supplementary material has been supplied. On a positive outcome the period ends only when you take receipt of the confirmation, in principle at a ceremony.

Expiry of the period gives you nothing. There is no positive silence — failure to decide does not amount to a confirmation. The remedy is a written notice of default, after which a penalty payment starts running by operation of law if no decision follows within two weeks, alongside an appeal for failure to decide.

The advice inside it. The immigration service works to a target of two months for its advice. It met that target in 69 per cent of cases and exceeded it in 26 per cent, with actual turnaround ranging from a few weeks to a year (IND, Invoeringstoets Tjebbes, July 2023). The service itself recorded that the 13-week option period and the objection period are not always achievable given that turnaround.

The thirteen-year cessation clock. Separately from any military-service question, RWN art 15(1)(c) provides for loss after an uninterrupted period of thirteen years by a person who also holds a foreign nationality. That period is interrupted by the issue of a declaration of possession of Dutch nationality or of a travel document, and a fresh thirteen-year period then runs from the day of issue (RWN art 15(4)). This is why renewing a Dutch passport is not merely administrative housekeeping. Note that the thirteen-year rule is the current formulation; earlier cases arose under a ten-year version, and 74 per cent of the proportionality advice requests recorded to July 2023 concerned losses under this provision.

After restoration under art 6(1)(p), the period starts again on the day the option is confirmed (RWN art 15(4)).

No published figures exist for how long a restoration takes end to end. The statutory 13 or 26 weeks and the advice turnaround above are the only anchors.

Losing Dutch nationality costs nothing. Recovering it does, and the sequencing usually means paying twice.

The pattern documented by the immigration service is that a former Dutch national discovers the loss only when a passport application is set aside — so the passport fee has already been paid before the option procedure begins (IND, Invoeringstoets Tjebbes, July 2023, which recorded consular figures then current). Current passport and consular charges are not established here; check them with the post or municipality before budgeting.

The option fee for a single declarant, in force 1 January 2026, per constituency. These are separately fixed amounts in each currency, not conversions of one another:

  • European Netherlands EUR 241 (WBN 2025/3, Stcrt. 2025, 31825)
  • Aruba Afl. 501 (WBN-A 2025/3, Stcrt. 2025, 31841)
  • Curacao and Sint Maarten Cg 502 (WBN-CM 2025/3, Stcrt. 2025, 31847)
  • Bonaire, Sint Eustatius and Saba USD 282 (WBN-BES 2025/3, Stcrt. 2025, 31842)

A caution for Sint Maarten: the Cabinet of the Governor publishes lower option figures for 2026 than the governing instrument sets. The instrument governs, and underpaying risks the declaration being set aside.

Where the declaration is lodged at a Dutch diplomatic or consular post, the fee is paid to the head of post (BON 2002 art 5(4)). Which currency schedule applies to a declaration lodged abroad is not established — confirm with the post before paying.

Payment mechanics. The fee is payable in one instalment, and if it is not paid within six weeks of receipt of the declaration the declaration is set aside without being handled; that six-week period is suspended while a request for exemption is pending (BON 2002 arts 5(5) and 6). The receiving authority keeps the whole option fee — nothing is remitted to central government, unlike naturalisation. There is no refund if the declaration is not confirmed.

If you instead petition the court for a declaration of your nationality status under RWN art 17, the 2026 court fee for a request of unspecified value at a district court is EUR 341 for an individual, or EUR 93 on proof of limited means (Regeling indexering, Stcrt. 2025, 39855, in force 1 January 2026). The schedule does not itself classify a nationality petition, so confirm the rate with the registry.

If an option refusal is litigated, add EUR 200 for appeal and EUR 297 for further appeal in the European Netherlands (2026 figures). Objection is free.

הרשות המוסמכת

שני דברים שונים מאוד יכולים לקרות כאן, ורק לאחד מהם יש משרד צמוד.

כאשר אזרחות הולנדית אובדת מכוח החוק, אין גוף מנהל כלל. לא פותחים תיק, אף פקיד לא מחליט, שום דבר לא נשלח אליכם, ובגלל שאין החלטה אין מה להתנגד ואין מגבלת זמן בתוקף. הדרך היחידה לפסיקה היא שיפוטית: העתירה לקבוע אם אתה בעל אזרחות הולנדית עוברת ל-rechtbank בהאג אם אתה גר בהולנד האירופית או מחוץ לממלכה, ול-Gemeenschappelijk Hof van Justitie אם אתה גר בארובה, קוראסאו, סנט מרטן או הולנד הקריבית. השר הוא בעל עניין, המדינה או הפרקליטות נשמעים, והפסידת היא צעד המשך היחיד.

נסיגה לשירות צבאי חוץ מרצון היא הפוכה. שר המשפטים והביטחון מקבל החלטה אינדיבידואלית, שאותה אתה עונה בהתנגדות לשר בתוך שישה שבועות ללא עלות, ולאחר מכן פנה ל-rechtbank ולמועצת המדינה, או בקריביים ל-Gerecht in eerste aanleg ול-Gemeenschappelijk Hof. משרה נכון ל-25 ביולי 2026.

ערעורים וביקורת

A withdrawal under art 14(3) is a decision taken by the Minister. That fact drives everything here: the ordinary administrative remedies do run against it, and each is time-limited. The chain is a derivation, not a pinned rule: art 22a diverts only the art 14(4) national-security withdrawal, leaving art 14(3) under Awb art 7:1 (objection compulsory before court) and art 8:1 (appeal against a decision).

Objection (bezwaar) comes first and is compulsory before any court (Awb art 7:1). It goes to the body that took the decision, within six weeks (art 6:7), from the day after it is notified in the prescribed manner (art 6:8); Awb articles here are cited in the text in force since 1 July 2026. It costs nothing (art 7:15(1)), you are heard before it is decided (art 7:2), and the reconsideration is full, not a legality check (art 7:11).

Appeal (beroep) to the district court follows, again within six weeks (art 6:7). The 2026 court fee for an individual is EUR 200 (art 8:41(2)(b), as indexed by Stcrt. 2025, 39855, in force 1 January 2026), payable within four weeks of the registry's notice; without payment the appeal is inadmissible unless you cannot reasonably be blamed, or insolvency is proved (art 8:41(5) and (6)). Living abroad, you appeal to the court for the seat of the deciding body (art 8:7(2)).

Further appeal (hoger beroep) lies to the Afdeling bestuursrechtspraak van de Raad van State; the 2026 fee for an individual is EUR 297 (art 8:109(1)(b), which sets the fee and no deadline). Its six-week term is a derivation, from art 6:7 as carried to higher appeal by art 6:24, a link not confirmed article by article, so check it first.

How closely a court looks splits in two. On ministerial discretion the Afdeling's 2018 formulation was review with restraint only (ECLI:NL:RVS:2018:2056, 20 June 2018); no later judgment restating it after the 2022 shift in Dutch administrative law was found, so treat it as the 2018 position only. Where losing Dutch nationality would also remove EU citizenship, review is not deferential: an EU-law proportionality assessment is always required, as at the moment of loss, covering consequences manifest or reasonably foreseeable then (ECLI:NL:RVS:2025:421, 5 February 2025), the burden of showing them on the individual (ECLI:NL:RVS:2020:423, 12 February 2020). Both arose from automatic loss; none applying it to a discretionary withdrawal was found, so its reach here is open.

Every term and fee above is European-Netherlands law.

Exceptions & edge cases

The automatic-loss remedy does not reach this. RWN art 6(1)(p) allows re-acquisition by a person who lost Dutch nationality by operation of law where EU citizenship went with it and disproportionate consequences were reasonably foreseeable at that moment. A withdrawal under art 14(3) is a ministerial decision, so that option is not the route here, and the proportionality argument belongs inside the objection and appeal against the decision itself.

Statelessness is an absolute bar. The withdrawal may not be imposed if it would leave the person stateless (RWN art 14(8), in force since 1 October 2023, read 25 July 2026). Whether another nationality is genuinely held is therefore the first question.

Recovery afterwards is blocked, with one narrow exception: art 14(5) bars re-acquisition after a withdrawal of this kind, though an exception may be granted by Royal Decree after five years, with the Council of State heard.

The national-security withdrawal is a different route on a different clock. Against a withdrawal under art 14(4) there is no objection stage: appeal goes straight to the district court in The Hague and the term is four weeks, not six (RWN art 22a). Those provisions are recorded as lapsing on 1 March 2027, but the lapse clause has not been read in full, so verify before relying on it.

Provisions that sound similar and are not this one. Art 15(1)(d) and (e) concern withdrawal for failure to renounce another nationality; art 15(2) is a carve-out from loss on voluntarily acquiring another nationality. There is no art 15a in the Rijkswet.

Outside the European Netherlands the procedure is not the same. Sint Maarten and Curacao each apply six-week objection and appeal terms, with court fees of NAf 150 at first instance and NAf 300 on further appeal; whether Curacao's 2015 amendment changed those figures is not established. Aruba's court publishes six-week terms with fees of AWG 25 and AWG 75, on a page written for immigration cases, so its transfer to nationality is not established. Bonaire, Sint Eustatius and Saba run on their own statute, the Wet administratieve rechtspraak BES: on the text in force since 4 June 2026 (read 26 July 2026) the appeal term is six weeks (art 16(1)) and the fee USD 84 (art 17(1)). The objection term there is still not established: do not assume six weeks.

A dated change to art 14 is on the statute book for 1 March 2027, so re-check anything here against the text in force on the day you act.
