Кто имеет право

To apply under BueG Art 23 the person must: (1) be a MINOR (minderjaehrig, under 18) — Art 23 is a minor-only facilitation; (2) be STATELESS (staatenlos) — i.e. not recognised as a national by any State under the operation of its law; a recognised refugee who still holds a nationality is not stateless for this purpose; (3) prove a TOTAL of FIVE years' residence in Switzerland (Art 23(1)); (4) prove ONE year of that residence IMMEDIATELY before the application (Art 23(1)); and (5) any residence held in compliance with the foreigner-law provisions counts toward the five years (Art 23(2)). In addition, the common facilitated-naturalisation conditions apply via BueG Art 20: the integration criteria of Art 12(1)-(2) must be met (assessed age-appropriately for a minor — public security/order, respect for constitutional values, age-appropriate language and participation) and the applicant must not endanger the internal or external security of Switzerland. The age condition is assessed at the time of application; a stateless person who is already an adult is NOT facilitated under Art 23 and must use ordinary naturalisation (10 years, Art 9 — carried at CH-NAT-01; stateless ADULTS get no facilitation, the positive disconfirmation noted at CH-SPC-02). On a successful grant the child acquires the citizenship of its commune and canton of residence (Art 23(3)).

The cumulative requirements are (BueG Art 23 + Art 20, /016): (a) MINORITY at application (under 18); (b) STATELESSNESS, evidenced by documentation that no State recognises the child as a national; (c) FIVE years' total residence in Switzerland (Art 23(1)); (d) ONE year of residence immediately before the application (Art 23(1)); (e) residence counted only where in compliance with the foreigner-law provisions (Art 23(2)); (f) the Art 12(1)-(2) integration criteria via Art 20, assessed age-appropriately for a minor — respect for public security and order, respect for the values of the Federal Constitution, age-appropriate ability to communicate in a national language, and participation in economic life / education as appropriate to the child's age; and (g) no endangerment of the internal or external security of Switzerland (Art 20(1)-(2)). Persons who cannot meet the language/economic criteria due to disability, illness or weighty personal circumstances are reasonably accommodated (Art 12(2)). Unlike CH-NAT-01 there is NO 10-year residence, NO C-permit prerequisite framed as a naturalisation gate, and NO cantonal 2-5y minimum (Art 18) — the five-year facilitated residence and the federal-decision structure replace those.

Unlike ordinary naturalisation, Art 23 is a FEDERAL facilitated procedure decided by the SEM after consulting the canton (BueG Art 20/25). Practical steps: (1) Establish stateless status — obtain documentation that no State recognises the child as a national (statelessness determination; the child must hold a foreigner-law-compliant residence status counting toward the five years, Art 23(2)). (2) Assemble residence evidence — proof of a total of five years' CH residence with one year immediately before the application, drawn from the residence-permit history and registration records (Art 23(1)). (3) File the Gesuch um erleichterte Einbuergerung with the SEM (via the cantonal migration authority); a minor applies through the legal representative, and from age 16 the minor must additionally declare its own will in writing per the common provisions (BueG Art 30-31/32). (4) Integration/security assessment — SEM verifies the Art 20/Art 12(1)-(2) criteria age-appropriately and the security condition; pending criminal proceedings or unmet conditions can suspend or defeat the application. (5) Federal decision — SEM grants or refuses; on grant the child acquires the citizenship of its commune and canton of residence (Art 23(3)). Minor children may be included per the common provisions (Art 30).

The general facilitated-naturalisation conditions come from BueG Art 20 (integration criteria of Art 12(1)-(2) plus the security non-endangerment requirement; for applicants without CH residence these apply by analogy). The constitutional anchor is BV Art 38(3)(b): 'Er [der Bund] erleichtert die Einbuergerung von:.. b. staatenlosen Kindern' (/029). The predecessor provision was BueG 1952 Art 30 (Fassung 2003) (continuity, merge_note). The treaty backdrop: Switzerland is a PARTY to the 1954 Convention relating to the Status of Stateless Persons (signed 1954-09-28, ratified 1972-07-03, EIF for CH approx 1972-10-01), whose Art 32 obliges contracting states to facilitate the naturalisation of stateless persons; Switzerland is a NON-party to the 1961 Reduction of Statelessness Convention. SEM decides facilitated naturalisation after consulting the canton (Art 25(1)).
