מי זכאי

Two mutually exclusive eligibility paths exist as of 2026. Path A (Art 1(1)) requires an unbroken, documentarily-provable chain to an ancestor who actually held Greek nationality (registered in the Δημοτολόγιο or Μητρώο Αρρένων); Art 1(1) transmits indefinitely across generations with no statutory generational cap. Path B (Art 10) requires only ομογενής (Greek-ethnic-origin) quality plus residence abroad, with no Greece-residence requirement and no registered-ancestor proof.

Exceptions & edge cases

The headline pitfall (V-Corr 22) is assuming Lausanne made Constantinopolitan Greeks Greek — Conv. VI Art 2 did the opposite (they remained Turkish). Further pitfalls: conflating them with the ~1.2-1.5M transferred Greek Orthodox who DID become Greek under Exchange Conv. Art 7; coding the 1964-65 expellees as denationalised (they retained nationality); citing 'Tsiliggros v. Greece' (a military-service case, not nationality) as nationality authority; charging the €550 allogeneis fee to an Art 10 ομογενής applicant (it is €100); and requiring a language test for Art 10 (ομογενείς are exempt).

    Lausanne Art 30 did not apply (Constantinople not detached) and Exchange Convention VI Art 2(a) exempted the Greeks of Constantinople, who remained Turkish; with no registered Greek ancestor Art 1 descent is unavailable, so the route is Art 10 ομογενής (consul → Minister of Interior, Art 8 decision, Art 9 oath), exempt from Art 5(2) integration conditions per the chapeau.

  • age 29 · nationality: American

    Greek by descent under Art 1(1) (Path A) — recognition, not naturalisation; register the chain via the Greek consulate / Region Citizenship Directorate, no fee, no test, no residence.

    Art 1(1) transmits jus sanguinis indefinitely across generations provided each link held Greek nationality and the chain is documentarily provable; because the grandfather was actually REGISTERED Greek (an ancestral link that became Greek), the Lausanne 'remained Turkish' default is overcome on this specific line and descent applies.

  • age 55 · nationality: Greek (claimed) / Turkish

    No pre-existing Greek nationality to confirm; the Art 25(2) determination would ascertain NON-acquisition. Realistic route is Art 10 ομογενής naturalisation, identical to the Constantinople analysis.

    Greeks of Imbros and Tenedos were exchange-exempted exactly like the Constantinopolitan établis and remained Turkish; an Art 25(2) determination (drawing on the Ankara/Lausanne corpus per Art 15(1)(b)) would find no acquisition, leaving Art 10 ομογενής as the available pathway.

  • age 34 · nationality: German

    Eligible to seek retroactive-from-birth determination under Art 26(1) as amended by L.5143/2024 Art 56, given the mother's later-confirmed Greek status; otherwise Art 10 ομογενής in her own right.

    L.5143/2024 Art 56 (ΦΕΚ Α' 161/11-10-2024) amended Art 26(1) to permit retroactive-from-birth determination for children of a later-confirmed-Greek parent; this is the precise edge case it addresses, distinct from the general gender-neutral Art 1(1) transmission which requires the parent to have been Greek at the child's birth.

  • age 68 · nationality: Greek

    Retained Greek nationality throughout; the 1964-65 expulsions removed residence/property in Turkey, not Greek citizenship. No re-acquisition route is needed.

    The ~10,000-12,000 expelled in 1964-65 (after Turkey denounced the 1930 Establishment Convention on 16-3-1964) were Greek-passport holders who RETAINED Greek nationality (V-Corr 23); this cohort is distinct from the protected Constantinopolitan minority that remained Turkish, and must not be coded as a denationalisation.
