ME-ADP-01 is Montenegro's adoption-based acquisition route, and its defining feature is a BIFURCATION by adoption type that places the same family event on two different acquisition tracks. Montenegrin law distinguishes FULL adoption (potpuno usvojenje) from INCOMPLETE/PARTIAL adoption (nepotpuno usvojenje), a civil-law distinction in which full adoption severs the legal ties to the birth family and fully assimilates the child to the adopter's family, while partial adoption creates a more limited legal relationship. The Law on Montenegrin Citizenship (Zakon o crnogorskom drzavljanstvu, Sl. list CG 13/2008 as consolidated through 77/2024) tracks that distinction precisely: a child of FULL adoption acquires Montenegrin citizenship BY ORIGIN (porijeklom) under Article 6(3) — assimilated to the descent/origin track — whereas a child of PARTIAL adoption acquires BY ADMISSION (prijemom) under Article 16(3), the same admission sub-mode as a derived child following a naturalised parent. Within the Article 4 taxonomy of four acquisition modes, adoption therefore straddles mode (1) origin and mode (3) admission, depending solely on the adoption's legal type. The practical consequence is significant: the full-adoption (origin) limb carries NO residence requirement and confers an origin-basis status, while the partial-adoption (admission) limb is conditioned on the child's legal and continuous residence in Montenegro with the adopter and is subject to the Art 16 chapeau (no other citizenship or release) and consent rules. This route is non-signature — it is a comparatively low-volume, well-defined derivative pathway — but it is doctrinally important as the cleanest illustration of how Montenegrin nationality law lets a civil-status category (the type of adoption) determine the acquisition mode, the conditions, and the register basis.

Art 6(3) (ME-PRIMARY-01:Art 6(3); ME-ASSERT-015/017): in FULL adoption (potpuno usvojenje), a child acquires Montenegrin citizenship BY ORIGIN if one adopter is a Montenegrin citizen and the child does not hold the citizenship of the other adopter. Full adoption is assimilated to the descent/origin track, so there is NO residence requirement. Both adopters are Montenegrin and she does not hold a competing other-adopter citizenship → eligible by origin.
not eligible (yet) — partial adoption routes through Art 16(3) as acquisition BY ADMISSION, which requires residence in Montenegro with the adopter.
Art 16(3) (ME-ASSERT-016/017): in INCOMPLETE/partial adoption (nepotpuno usvojenje), a child acquires citizenship BY ADMISSION only if the child lives legally and continuously in Montenegro WITH the Montenegrin-citizen adopter (subject to the Art 16 chapeau). Living abroad in Spain, he fails the residence-with-adopter condition. Unlike full adoption (Art 6(3), no residence), partial adoption requires it. Not eligible until they reside in Montenegro.

Art 16(3) (ME-ASSERT-016): a partially-adopted child acquires citizenship BY ADMISSION where she lives legally and continuously in Montenegro with the Montenegrin-citizen adopter. She has resided with her adoptive mother in Cetinje for 2 years and the Art 16 chapeau is met (release from prior citizenship — ME-ASSERT-018). At 7 (≤14) no separate consent is needed. Eligible.
not eligible via Art 6(3) origin — full-adoption origin acquisition requires that the child not hold the OTHER adopter's citizenship, and he holds Italian.
Art 6(3) (ME-ASSERT-015): the full-adoption origin route applies only where the child 'does not hold the citizenship of the other adopter.' Because he holds Italian citizenship (the other adopter's), the Art 6(3) by-origin route is barred. Acquisition would instead have to proceed on the admission/derivation track (Art 16) with release of the Italian citizenship to satisfy the Art 16 chapeau (ME-ASSERT-018); at 13 (≤14) no separate consent is yet required, but release is the gating issue.
