Overview

The German Staatsangehörigkeitsrechts-Modernisierungsgesetz (StARModG) entered into force on 2024-06-27, fundamentally reforming German nationality law in three directions: permitting dual nationality, reducing the standard naturalization residency requirement from 8 to 5 years (with a 3-year fast track for special integration achievements), and abolishing the Optionspflicht (the citizenship-election obligation that previously required persons born in Germany with foreign-national parents to choose between German and their parents' nationality upon reaching adulthood).

For Mexican-German persons, the pre-StARModG regime created a hard choice: acquiring Mexican nationality while residing in Germany after 2000 typically triggered automatic loss of German nationality (Automatischer Verlust) unless a prior Beibehaltungsgenehmigung (retention permit) had been obtained from the Bundesverwaltungsamt (BVA). Thousands of Germans of Mexican descent — and Mexicans who had naturalized as German citizens — faced this dilemma.

Post-StARModG (from 2024-06-27): dual Mexican-German nationality is fully permitted in both directions. A German national may acquire Mexican nationality (through any route in this knowledge base) without losing German nationality. A Mexican national may naturalize as a German citizen without losing Mexican nationality. The reform has no retroactive effect for persons who already lost German nationality under the prior automatic-loss rule — those persons must re-naturalize.

Who qualifies

German nationals acquiring Mexican nationality post-2024:

  • No Beibehaltungsgenehmigung needed — acquisition of Mexican nationality is no longer grounds for German nationality loss
  • Standard Mexican naturalization requirements apply (MX-NAT-01 through MX-NAT-04 depending on qualifying ground)

Mexican nationals naturalizing as German citizens post-2024:

  • Standard German naturalization: 5-year lawful residence in Germany (reduced from 8); language proficiency (B1 German); civic knowledge test; economic self-sufficiency; no criminal record
  • Fast-track 3 years for special integration achievements (StAG §10a)
  • Dual nationality permitted — Mexican nationality retained; CPEUM Art 37 A absolute shield for por-nacimiento Mexicans unchanged

Pre-2024 automatic-loss cases:

  • Persons who lost German nationality before 2024-06-27 under the pre-reform automatic-loss regime must re-naturalize; StARModG is NOT retroactive for completed losses
  • BVA may offer expedited re-naturalization procedures in appropriate cases

How to apply

Mexican national naturalizing in Germany:

  1. Establish 5-year lawful German residency (Niederlassungserlaubnis or equivalent)
  2. Pass German language proficiency test (B1 Goethe-Institut or recognized equivalent)
  3. Pass Leben in Deutschland civic knowledge test
  4. Submit naturalization application (Einbürgerungsantrag) at Einbürgerungsbehörde (Kreisbehörde or Stadtverwaltung)
  5. Surrender of prior passports / prior renunciation oath NOT required post-2024 (dual nationality permitted)
  6. Approval + Einbürgerungsurkunde (naturalization certificate) issued; German passport applicable

German national acquiring Mexican citizenship:

  • Proceed through applicable MX route (MX-NAT-01 general / MX-NAT-02 Iberoamericano — Germany not qualifying, Iberoamericano applies to Iberian + Latin American countries; German nationals use general 5-year Art 19 route)
  • No German permission required post-2024
