Enumerated prior loss mechanisms triggering Art. 38: 1951 Art. 11 pkt 1 (individualized Rada Panstwa permission); 1951 Art. 12 pkt 1-2 (foreign citizenship acquisition); 1962 Art. 13 pkt 1-2 (voluntary renunciation 1962-2012 incl 1997-10-17 to 1999-01-01 transition per NSA II OSK 3006/13 pro-constitutional doctrine). NOT eligible: 1951 Art. 4 pkt 2 ex-lege loss for ethnic minorities (Ukrainian/Belarusian/Russian/Lithuanian/Latvian/Estonian/German residing abroad at 1951-01-19) per NSA II OSK 1805/24 — irremediable legislative gap; fallback Art. 30 ust. 1 pkt 1/pkt 6. Uchwala 5/58 cohort NOT eligible — remain legally Polish (NSA Chain 2), file Art. 55 instead.
Requirements
Documentary proof of prior Polish citizenship + specific loss event under 1920/1951/1962 Acts; current foreign citizenship; criminal records (origin + PL); CV in Polish. IPN archive request typical 6-12 months for individualized loss documentation. Via Wojewoda (PL) or Polish consul for abroad. PLN 1,000 fee from 2025-08-01.
How to apply
Application to MSWiA per Art. 41 UOP. MSWiA security consultation (ABW + Policja + Zandarmeria per Art. 42 KPA); negative security = mandatory refusal per Art. 39 regardless of Art. 38 trigger. 3-month per Art. 43 (extended in complex). Art. 44: restoration retroactive to date of decision (NOT to original loss); dual permitted.
Timeline
3-12 months variable (Art. 43 + extensions). IPN archive 6-12 months additional. Total cumulative 9-24 months including documentation. WSA review under Art. 45 examines procedural correctness only — cannot substitute security judgment for ABW.

NOT ELIGIBLE Art 38 — citizenship never validly lost. Correct route is Art 55 Potwierdzenie (PL-DSC-04) declaratory + lower fee PLN 277 + lower evidentiary threshold.
NSA Chain II OSK 267/05+1001/05+965/05+1085/05+1153/06+SN III RN 56/01: Uchwala 5/58 general (non-individualized) = did NOT validly effect loss Art 11 (required individualized Rada Panstwa permission). Without individual MSW permit IPN to citizenship never validly revoked to remains legally Polish. Przywrocenie cannot apply where nothing was lost.
NOT ELIGIBLE — Art 4 pkt 2 loss outside Art 38 enumerated triggers. NSA II OSK 1805/24 confirms legislative gap with no przywrocenie remedy. Fallback: Art 30 ust 1 pkt 1/pkt 6 Uznanie if independently meets residence.
Art 38 ust 1 enumerates specific prior-law loss mechanisms. Art 4 pkt 2 1951 Act (ex-lege automatic loss for ethnic minorities abroad) NOT among enumerated triggers. NSA II OSK 1805/24 explicitly confirms gap. NLR MEDIUM no active legislative remedy as of 2026-05-25. Gap disproportionately affects descendants of ethnic Ukrainians, Belarusians, Germans pre/during WWII.
