Citizenship by descent is the mechanism by which Antiguan and Barbudan citizenship passes automatically to a child born outside the territory of Antigua and Barbuda when that child's parent (or, by the government-service carve-in, that parent's death-in-service circumstances) satisfies the qualifying criteria in the Constitution. The route addresses the practical reality that Antiguan citizens live, work, and have children abroad; it ensures that the children of citizens are not left stateless merely because they were born outside the islands. This route (AG-DSC-01) covers the primary, straightforward first-generation descent scenario: a child born abroad (on or after 1 November 1981) to at least one parent who is a citizen of Antigua and Barbuda by virtue of the constitutional provisions for automatic birth-in-territory citizenship (s.113(a)) or the transitional independence-cohort citizenship (s.112). The rule is automatic — no application or registration is required to acquire citizenship — though evidence-gathering and documentary confirmation are typically necessary to prove the entitlement to government authorities in practice. The route is distinct from AG-DSC-02 (the generational limiter — how the chain of descent transmission terminates for a parent who is themselves a citizen only by descent) and AG-DSC-03 (the grandparent independence-acquisition pathway under s.112(b)).

ELIGIBLE — AG-DSC-01. The mother was born in Antigua and Barbuda on or after 1 November 1981, so she is a citizen by jus soli under Constitution s.113(a) — NOT merely by descent. She is therefore a qualifying transmitting parent. Her child born in London acquires AG citizenship automatically at birth under s.113(b): 'every person born outside Antigua and Barbuda... one of whose parents is, at the time of his birth, a citizen.' No application needed; citizenship vests at birth.
Constitution s.113(a): birth in AG after 1 Nov 1981 = citizenship by jus soli. Mother's subsequent Trinidadian naturalisation does not strip her AG citizenship (dual nationality permitted per Const s.115). As a citizen who is NOT 'only by descent,' she is a qualifying transmitting parent under s.113(b) for her foreign-born child. AG-DSC-01 route doc confirms this analysis.
ELIGIBLE — AG-DSC-01 via government-service carve-in (Constitution s.113(c)). When an AG citizen is abroad in government service, the child born abroad acquires citizenship regardless of the parent's citizenship class. Even if the father were 'only a citizen by descent' (which would normally block transmission under AG-DSC-02), s.113(c) provides a genuine escape valve. The child acquires AG citizenship at birth.
Constitution s.113(c): child of an AG citizen posted abroad in government service acquires citizenship regardless of the parent's descent class. This is confirmed in AG-DSC-01 and AG-DSC-02 as a structural escape valve. The non-citizen mother is irrelevant — one qualifying parent suffices.
ELIGIBLE — AG-DSC-01. Constitution s.113(b): 'every person born outside Antigua and Barbuda... one of whose parents is, at the time of his birth, a citizen.' The mother is an AG citizen by naturalisation. She is a 'citizen' for the purposes of s.113(b). The son acquires AG citizenship automatically at birth. There is no distinction in the transmissibility rule based on HOW the parent acquired citizenship — naturalised citizens transmit citizenship to foreign-born children on equal terms as citizens by birth.
AG-DSC-01 route doc: Constitution s.113(b) — one citizen parent sufficient. No restriction based on the parent's mode of citizenship acquisition. The mother is an AG citizen; son born abroad acquires citizenship at birth. The only cut-off applies when the transmitting parent is ONLY a citizen 'by descent' under s.113(b) itself (which blocks further foreign-born transmission) — but a naturalised citizen is NOT a citizen 'only by descent'; naturalisation produces citizenship by registration, not by descent.
ELIGIBLE — AG-DSC-01 (posthumous parent). Constitution s.118(1) governs posthumous-parent scenarios: the citizenship test is applied at the date of the parent's death, not the date of the child's birth. The father was an AG citizen at the time of his death. The child is therefore entitled to AG citizenship by descent under s.113(b). The child's citizenship arises at birth.
AG-DSC-01 route doc: 'Posthumous parent: test applied at date of parent's death (s.118(1)).' Father was an AG citizen when he died — he satisfies the 'parent is a citizen at the time of the child's birth' test (keyed to death date by s.118(1)). Child acquires citizenship at birth under s.113(b).
ELIGIBLE — AG-DSC-01 (name change is irrelevant to citizenship). The child's AG citizenship arises at birth under Constitution s.113(b) from the father's status as an AG citizen at the time of birth. A deed-poll name change by the father does not alter his citizenship status — citizenship is personal status, not name-dependent. The child acquires AG citizenship at birth from the father. Birth registration and passport application must reflect the current (post-deed-poll) name, but the citizenship entitlement itself is unaffected.
AG-DSC-01: citizenship transmission under s.113(b) depends on the parent being 'a citizen at the time of birth.' Citizenship is a personal legal status independent of name. Deed-poll name changes do not affect citizenship status. Father remains an AG citizen under his new name.
