Кто имеет право

Art 1A (birth + schooling) requires ALL of: (a) the child born in Greece to foreign parents; (b) enrolment in 1st grade (Α' τάξη) of Greek primary school plus continued/uninterrupted attendance at the time of the joint declaration; (c) at least one parent's ≥5 years' continuous lawful residence before the child's birth (or the right arising on completion of 10 years' continuous residence if the child was born before the 5-year mark); (d) at least one parent holding an enumerated definitive residence title. Компетентный орган

Filing and decision lie with the competent service of the Decentralised Administration / Regional Citizenship Directorate (Περιφερειακή Διεύθυνση Ιθαγένειας) of residence, under the General Secretariat for Citizenship, Ministry of Interior. The Code's legacy 'Coordinator of the Decentralised Administration / General Secretary of the Region' references read in 2026 as the current Regional Citizenship Directorate (authority lineage L.3852/2010 → L.4555/2018 → L.4674/2020; terminology codified by L.5225/2025 Art 95). Unlike naturalisation, there is no Naturalisation Committee and no ΠΕΓΠ exam.

Exceptions & edge cases

Common pitfalls: assuming unconditional birthright citizenship (Greece has none — the conditions are mandatory); relying on a parent's temporary permit (not a qualifying definitive title); counting kindergarten toward the schooling chain; missing the Art 1B 21/23 age caps and the 3-year exclusive deadline; expecting a ΠΕΓΠ exam or paying the €550 naturalisation fee (neither applies — fee is €100, no exam); and citing repealed/refuted authority (L.3838/2010 as if live, or 'ΣτΕ 1891/2019').     DOES NOT QUALIFY under Art 1A (as of filing). The temporary permits are not a qualifying definitive title under Art 1A §1(c). The route fails on the title condition until a parent obtains a definitive title (e.g., EU long-term-resident or 10-year permit), or the child later completes the Art 1B 9-/6-grade chain.

    Art 1A §1(c) enumerates definitive titles (EU long-term, indefinite/10-year, refugee/subsidiary/stateless, ΕΔΤΟ+permit, second-generation permit, EU-family card). Temporary permits are expressly NOT accepted. Birth + schooling alone are insufficient — Greece has no unconditional jus soli. Pathway: wait for a definitive parental title, or pursue Art 1B on the schooling chain at the appropriate age.

    QUALIFIES under Art 1A using the §2β international-protection / single-parent filing variant. The recognised-refugee title is a qualifying definitive title under Art 1A §1(c); €100 fee; decision within 6 months; acquisition on ΦΕΚ publication.

    Art 1A §1(c) lists the recognised-refugee/subsidiary-protection title among qualifying definitive titles; the >5-year pre-birth residence is met (2013→2016 = 3 years short of 5 at birth, so the right matures on the father's completion of 10 years' continuous residence in 2023 — already passed by 2026); Art 1A §2β provides the international-protection/single-parent filing variant. Note the 5-vs-10-year mechanic: born before the 5-year mark, the right vests on the 10-year completion.
