Обзор

People in the Moluccan community who arrived in the Netherlands in 1951, and their descendants, sit in an unusual legal position. A dedicated statute — the Wet van 9 september 1976 betreffende de positie van Molukkers, Stb. 1976, 468 — gives those it covers a status under which they are treated as Netherlanders. This pathway is for people in that position who want Dutch nationality itself, whether for the first time or back after a loss.

Two consequences of the 1976 Act are firmly established and they are the most valuable facts on this page. First, a person treated as a Netherlander under that Act pays nothing at all — for an option declaration and for a naturalisation request alike (Besluit optie- en naturalisatiegelden 2002 art 4(1); the IND's own fee page records "Verzoek door een Molukker EUR 0,-", retrieved 25 July 2026). Second, that person is exempt from the naturalisation test outright (Besluit naturalisatietoets art 3(1)(a), in force since 26 May 2022): no language examination and no knowledge-of-society examination.

What is not established in this evidence base is the precise nationality effect of the 1976 status itself, or any Moluccan-specific transitional provision inside the nationality Act. Treat the pathway as running through the ordinary instruments — option, naturalisation, or the proportionality-based restoration option — with the fee and the test disapplied.

Требования

Two requirements that normally dominate a naturalisation file fall away here, and it is worth being precise about which.

Exempt: the naturalisation test. A person covered by the 1976 Act is released from the whole examination — the four language skills at CEFR level A2 and the knowledge-of-society component alike (Besluit naturalisatietoets art 3(1)(a)). No diploma, no waiver application, no Argonaut medical assessment, no 600-hour course record.

Exempt: the fee, for option and naturalisation both (Besluit optie- en naturalisatiegelden 2002 art 4(1)).

Not exempt, and still fully in play:

  • Good character. The application is refused where serious suspicions exist, based on your conduct, that you present a danger to public order, good morals or the security of the Kingdom (RWN art 9(1)(a)). The rehabilitation period is five years, raised from four with effect from 1 May 2018.
  • The declaration of solidarity, required of adults and of minors aged 16 or over, in fixed statutory wording and in Dutch.
  • The duty to renounce another nationality, if you naturalise (RWN art 9(1)(b)), subject to four statutory exemptions and a further eleven policy categories. This duty does not attach to option except on one ground that is not this one.
  • Residence. If you are a former Dutch national or a former Nederlands onderdaan-niet-Nederlander, the five-year residence condition for naturalisation does not apply to you at all (RWN art 8(2)). If instead you are using the option for former nationals, you need one uninterrupted year of admission for an indefinite period with principal residence in the Kingdom, accrued as a foreign national, running up to the moment of confirmation.

The evidence base compiled for this route establishes no Moluccan-specific documentary checklist — no list of service records, arrival documentation or community-ancestry evidence has a pinned legal basis. What it does establish is that the ordinary document rules apply, and that establishing coverage by the 1976 Act is the practical gateway to both the fee exemption and the test exemption. Ask the receiving authority in advance what it accepts as proof of that status.

The general set for a naturalisation file: your own birth certificate; birth certificates of children included; adoption deed or judgment where relevant; marriage certificate where the claim rests on marriage; divorce or repudiation deeds and, where the country uses one, the family booklet. A valid foreign travel document must in principle be produced unless you are registered as stateless in the population register — a registration of "unknown nationality" is expressly not the same thing.

Where you are relying on prior Dutch nationality or prior subject status, produce it directly: an old Dutch passport, a bewijs van Nederlanderschap, a historical population-register extract, or consular records.

Foreign documents must be legalised or apostilled at your own cost, and translated by a sworn translator, preferably into Dutch, where they are in a language other than Dutch, English, German or French. On Bonaire, Sint Eustatius and Saba only Dutch and English are accepted untranslated. Documents already legalised and processed into the population register need not be produced again unless there is well-founded doubt.

One live gap: the Handleiding instructs officials to apply "the legalisation circular currently in force", but the most recent located version (Stcrt. 2023, 8509) was repealed with effect from 1 January 2024 and no successor could be located as of 25 July 2026. Confirm the applicable requirement before commissioning legalisation abroad.

File in person with the burgemeester (mayor) of the municipality where you are registered, if you live in the European Netherlands; with the Governor if you live in Aruba, Curacao or Sint Maarten; with the Minister, operationally the IND's Caribbean Netherlands unit, on Bonaire, Sint Eustatius or Saba; or with the Netherlands diplomatic or consular post in whose district you live if you are outside the Kingdom (Besluit verkrijging en verlies Nederlanderschap arts 2 and 3(1)). A proxy is allowed only for compelling reasons.

The fee step is where this route diverges from every other. The receiving authority checks the payment obligation before taking the file into handling. Where the exemption for a person treated as a Netherlander under the 1976 Act applies, no payment falls due at all, and the six-week payment deadline that otherwise causes a file to be set aside simply does not bite. The system still settles internally: where a naturalisation exemption is granted, the municipality or consular post is compensated EUR 241 for a single request and EUR 412 for a joint one under the 2026 schedule (WBN 2025/3, Stcrt. 2025, 31825, in force 1 January 2026). None of that is charged to you.

From there the sequence is the ordinary one. For an option, the receiving authority both assesses and decides, and confirms the acquisition in writing if the ground is made out. For a naturalisation request, the burgemeester investigates and advises, the IND assesses, and nationality is granted by Royal Decree on the Minister's proposal.

In both cases nationality vests only when the document is physically handed to you, in principle at a naturalisation ceremony, and then backdates to the date the document itself bears (BVVN arts 60a(1) and 60b(1)). Adults and minors aged 16 or over must first make the verklaring van verbondenheid (declaration of solidarity). The exemption from the naturalisation test does not touch that requirement.

No cohort-specific processing time is established for this pathway. The figures below are the general ones.

Statutory decision periods. For an option declaration: 13 weeks from receipt, extendable once by at most 13 weeks, so a 26-week ceiling (RWN art 6(5)); a further four weeks where the authority seeks the Minister's advice on renunciation (RWN art 6a(6)). For naturalisation: one year, running from the latest of payment of the fee, the decision fully waiving that payment, or receipt of the requested supplementation, with the decision capable of being held at most twice by six months, giving a two-year ceiling (RWN art 9(4)).

Note the interaction with the fee exemption. The one-year naturalisation clock normally starts on payment; where payment is fully waived it starts on the waiver decision instead. For an option, the 13 weeks likewise start once the fee position is settled and any requested supplementary documents have been supplied — not on the day you file.

Published performance, for naturalisation only and only to 2024: the average time from filing at a municipality to the ceremony was 182 days in 2024, against 344 days in 2018; the municipal stage took 13 days, the IND stage 95 days for grants, and the Kabinet van de Koning 18 days from proposal to Royal Decree (IND, Monitor Naturalisatie en Optie 2018-2024, June 2025). Across 2018-2024, 82% of granted requests filed in the European Netherlands reached a ceremony within a year. No national processing-time series exists for option, because the IND holds only confirmations and never sees refusals.

Expiry of a decision period confers nothing — there is no silent approval. The remedy is a written notice of default, after which a statutory penalty payment runs from two weeks later, capped at 42 days (Algemene wet bestuursrecht arts 4:17-4:20).

Nothing is payable by a person treated as a Netherlander under the Wet van 9 september 1976 betreffende de positie van Molukkers. The exemption is statutory, not discretionary, and covers both procedures: "Voor een verzoek om naturalisatie of een verklaring van optie door een persoon die op grond van de Wet betreffende de positie van Molukkers als Nederlander wordt behandeld, is geen betaling verschuldigd" (Besluit optie- en naturalisatiegelden 2002 art 4(1)). The IND's own fee page carries the same line as "Verzoek door een Molukker EUR 0,-" (retrieved 25 July 2026).

If the exemption does not reach you — for instance because you are a descendant outside the Act's scope — the ordinary 2026 tariffs apply, in force since 1 January 2026: in the European Netherlands, option EUR 241 single, EUR 412 joint and EUR 27 per co-opting minor; naturalisation EUR 1,139 single, EUR 1,454 joint and EUR 168 per co-naturalising child (WBN 2025/3, Stcrt. 2025, 31825). A reduced naturalisation tariff of EUR 847 single and EUR 1,163 joint applies to stateless persons and holders of an asylum residence permit. Where the fee is payable it must be paid in one instalment and within six weeks of receipt of the declaration or request, failing which the file is set aside without being handled.

Separately from the exemption in art 4(1), the Minister may waive payment in three further situations: a minor filing independently, a person who was wrongly treated as a Dutch national for more than a year through an administrative error, and naturalisation on grounds of state interest or merit to the state. The first two grounds also apply to option declarations. No waiver is available where the error was caused by the applicant's own fraud or carelessness.

  • Procedure: Besluit verkrijging en verlies Nederlanderschap, in force since 1 March 2017. Binding policy: Handleiding Rijkswet op het Nederlanderschap 2003, version in force since 1 July 2026.

A refusal is an ordinary administrative decision and is challenged the same way whether the fee was waived or not.

In the European Netherlands: bezwaar (objection) to the authority that took the decision, then beroep to the rechtbank, then hoger beroep to the Afdeling bestuursrechtspraak van de Raad van State. Six weeks at each step, running from the day after the decision is notified (Algemene wet bestuursrecht art 6:7). The objection costs nothing (Awb art 7:15(1)); the appeal to the rechtbank costs EUR 200 and the further appeal EUR 297 for an individual under the 2026 schedule (Awb arts 8:41(2)(b) and 8:109(1)(b), set by the regulation of 14 November 2025, Stcrt. 2025, 39855, in force 1 January 2026). The court fee must be paid within four weeks of the registry's notice; proven insolvency excuses it.

The objection stage is a full reconsideration of the decision, not a legality check, and you have a right to be heard. The authority decides within six weeks, or twelve where an advisory committee is involved, extendable once by six weeks.

Outside the European Netherlands the courts and fees differ: Aruba, Curacao and Sint Maarten apply their own Landsverordening administratieve rechtspraak and the BES islands the Wet administratieve rechtspraak BES, with appeals to the Gerecht in eerste aanleg and then the Gemeenschappelijk Hof van Justitie. First-instance court fees are NAf 150 in Curacao and Sint Maarten, AWG 25 in Aruba and USD 84 in the BES islands.

If what you actually need is a ruling that you already hold Dutch nationality, that is not an appeal. It is a petition under RWN art 17 to the rechtbank Den Haag, or to the Gemeenschappelijk Hof if you live in the Caribbean parts of the Kingdom, from which only cassation to the Hoge Raad lies.

Exceptions & edge cases

Being treated as a Netherlander is not the same as being one. The 1976 Act's effect on nationality status itself is not established in this evidence base. If your practical problem is that an authority will not accept that you are Dutch, the tool is the status-determination petition under RWN art 17, not a fresh application.

The test exemption does not waive the ceremony. The declaration of solidarity is still required of adults and of minors aged 16 or over, in fixed statutory wording and in Dutch, and the decision cannot be made known before it has actually been made. Nationality vests only on handover.

Missing the ceremony is fatal. The decision lapses by operation of law one year after the date it bears; no objection or appeal lies against that lapse; you must start again. If the principal applicant does not appear, the extracts for co-naturalising children are not handed over either.

The one-shot bar. If you have ever acquired Dutch nationality by option, only two of the seventeen option grounds remain available to you afterwards — the former-national ground and the proportionality-based restoration ground (RWN art 6(9)).

The proportionality-based restoration option has a hard cut-off that rules out most historic losses: EU citizenship must have been lost together with Dutch nationality, so any loss before 1 November 1993 is outside it, as is any case where the person held another EU member state's nationality at the moment of loss.

If you naturalise rather than optate, the renunciation duty applies, with fifteen exemption categories. Two are worth knowing: a state that does not permit renunciation in law or in practice, and a renunciation fee causing substantial financial disadvantage. On the financial test a fee at or below the reduced single naturalisation tariff, EUR 847 in 2026, can never succeed; a fee at or above ten times the standard single tariff of EUR 1,139 always succeeds.
