Debido a que el decreto de 1954 es un régimen histórico, «eligibility» describe a quién el decreto reconoció como ciudadano y en qué términos admitió a nuevos ciudadanos. organismo inicial (Neni 1): ciudadanía adscrita a «te gjithe ata qe kane qene shtetas shqiptare me daten 29.11.1944 dhe nuk e kane humbur me vone shtetesine shqiptare»: toda persona que poseía la ciudadanía albanesa el 29.11.1944 y no la había perdido posteriormente (Neni 1(a), OCR;). El decreto interpretativo de 1961 redujo el desencadenante «residence abroad» en Nenet 2/7: los ciudadanos en el extranjero «per aresye studimi ose sherbimi» (por estudios o servicios) no se consideraban residentes en el extranjero. Tal como se decodifica, el decreto no contenía ninguna regla de pérdida basada en la ausencia ni ninguna cláusula de recuperación de ningún tipo. A partir del 11/07/2026 el régimen no está operativo.

Quién califica

Because the 1954 decree is a historical regime, «eligibility» describes who the decree recognised as a citizen and on what terms it admitted new citizens. INITIAL BODY (Neni 1): citizenship attached to «te gjithe ata qe kane qene shtetas shqiptare me daten 29.11.1944 dhe nuk e kane humbur me vone shtetesine shqiptare» — every person who held Albanian citizenship on 29.11.1944 and had not later lost it ( Neni 1(a), OCR). The continuity qualifier is exclusionary: anyone already stripped under the 1946 tools (Ligje 377/1946 Arts 13-14) fell outside the 1954 body without being named. BIRTH / MIXED PARENTAGE (Neni 2): a child of parents of different citizenship, one an Albanian citizen at birth, was Albanian if at least one parent resided in Albania; where both parents resided abroad, the child's citizenship was set «me marreveshje te te dy prinderve» (by agreement of both parents). ACQUISITION ON REQUEST (Neni 3): citizenship was granted by Presidium decree on the applicant's request with NO enumerated statutory conditions — no residence term, no language test and no character clause appears in the text (contrast the modern Ligj 113/2020 naturalisation catalogue). MARRIAGE (Neni 4): marriage to a foreigner was citizenship-neutral — it «nuk sjell ndryshim ne shtetesi». CHILDREN (Nenet 6-7): a change in the parents' citizenship carried children under 14 automatically; for children aged 14-18 the change required their consent («vetem me pelqimin e tyre»). The 1961 interpretive decree narrowed the «residence abroad» trigger in Nenet 2/7: citizens abroad «per aresye studimi ose sherbimi» (for study or service) were NOT deemed resident abroad ( Dekret 3231/1961, OCR). As decoded, the decree contained NO absence-based loss rule and NO recovery clause of any kind. As of 2026-07-11 the regime is non-operative.

Cómo solicitar

Every citizenship act under the decree flowed through a single organ and a single instrument: a decree of the Presidium of the People's Assembly (Presidiumi i Kuvendit Popullor). Acquisition on request (Neni 3), release (Neni 5) and deprivation (Neni 8) were each «me dekret te Presidiumit» — there was no application-adjudication ladder, no reasoned-decision requirement and no review body described in the text. Deprivation in particular happened «per cdo rast te vegante» — one decree per individual case — so denationalization was never automatic-by-statute and never collective-by-statute; it required a produced, individualized Presidium instrument naming the person. This individualization requirement is the decisive PROCEDURAL fact for any modern family claiming a communist-era deprivation: the first practical question is whether an individualized Neni 8 Presidium decree naming the ascendant actually exists — an archive question (AIDSSH / AQSH presidential-decree stream), not a matter resolvable from the statute (see litigation_posture). The 1961 interpretive Dekret 3231 added the only procedural gloss decoded: for the residence-sensitive rules of Nenet 2 and 7, persons abroad «per aresye studimi ose sherbimi» were not counted as resident abroad ( Dekret 3231/1961, OCR). The honest negative on procedure is that the decree contained NO absence-reporting mechanism of the kind the 1946 Act had built (Ligje 377/1946 Art 13's 15-year and diplomatic-reporting apparatus), so no procedural path to loss-by-absence existed under the 1954 text. Base jurídica

The 1954 regime rests on two instruments. PRIMARY: Dekret Nr. 1874, datë 7.6.1954 «Për shtetësinë shqiptare», a compact 9-article citizenship decree of the People's (later People's Socialist) Republic of Albania. INTERPRETIVE: Dekret Nr. 3231, datë 20.3.1961 (appended), which authoritatively glossed Nenet 2 and 7. Neither confers anything today; the decree is a historical loss regime (operative_today=false), in force 44 years from 7.6.1954 until its repeal by Ligj 8389/1998 (5.8.1998). Structurally the decree made every core citizenship act a discretionary act of the Presidium of the People's Assembly: acquisition on request (Neni 3), release (Neni 5) and DEPRIVATION (Neni 8). Neni 1(a) fixed the citizen body to «te gjithe ata qe kane qene shtetas shqiptare me daten 29.11.1944 dhe nuk e kane humbur me vone shtetesine shqiptare» ( Neni 1(a), OCR) — all who were Albanian citizens on 29.11.1944 and had not since lost it — a continuity clause that textually perpetuated every earlier denationalization. Acquisition under Neni 3 is a discretionary grant open only to FOREIGNERS: «Të huajve, pavarësisht nga kombësia dhe raca e tyre, mund t'u jepet shtetësia shqiptare. mbi kërkesën e tyre, me dekret të Presidiumit të Kuvendit Popullor të Republikës Popullore Socialiste të Shqipërisë» ( Neni 3, full article — re-decoded 2026-07-24 from.pdf p.221 at 400 dpi, superseding the truncated OCR at.txt L25, which dropped the opening clause «Të huajve, pavarësisht nga kombësia dhe raca e tyre, mund t'u»). The full article grants citizenship on the person's own request by decree of the Presidium, expressly irrespective of nationality and race and in the discretionary «mund t'u jepet» (MAY, not shall); it states NO eligibility conditions of residence, duration, language, character or renunciation. The decree was the operative instrument across the late-communist and early-transition period; it was supplemented in the transition window by Dekret 255/1992 (a distinct route, AL-HIS-04) but never amended in its Neni 8 core. Autoridad competente

Under the decree, ONE organ held all citizenship power: the PRESIDIUM OF THE PEOPLE'S ASSEMBLY (Presidiumi i Kuvendit Popullor te Republikes Popullore Socialiste te Shqiperise). It granted citizenship on request (Neni 3), permitted release (Neni 5) and imposed deprivation (Neni 8), in each case «me dekret» — by its own decree, with no subordinate adjudicating authority, no ministerial intake layer and no court described in the text. The interpretive authority was likewise the Presidium, acting through Dekret 3231/20.3.1961 to gloss Nenet 2/7 ( Dekret 3231/1961, OCR). There was no equivalent of a modern immigration service; the decree's machinery was purely a function of the top state organ. FOR THE MODERN (descendant) PATHWAY only, the relevant authorities are today's: applications on the Neni 6 origin basis are lodged through the local State Police structures and processed under the Ministry of the Interior per Ligj 113/2020, with the applicable service fee set at 10,000 lekë by Udhëzim 271/2021 — NOT any pre-2021 figure. ARCHIVE AUTHORITIES decisive to any communist-era deprivation claim are the Authority for Information on Former State Security Documents (AIDSSH) and the Central State Archive (AQSH), which hold the presidential/Presidium decree stream against which the existence of an individualized Neni 8 deprivation must be verified. Exceptions & edge cases

The defining feature of the 1954 regime is its LOSS architecture, which is why AL-HIS-02 is documented as a signature HIS/loss route rather than an acquisition pathway. DEPRIVATION (Neni 8) was the operative denationalization tool: «Heqja e shtetesise shqiptare behet me dekret te Presidiumit te Kuvendit Popullor.. per cdo rast te vegante» ( Neni 8, OCR; standard orthography «për çdo rast të veçantë» — «for each particular case»). The clause set NO enumerated grounds, NO procedure and NO appeal, and imposed no publication requirement — deprivation was a bare, individualized Presidium decree. It was the instrument of the escapee/exile denationalization practice that ran across 1954-1991, operating in absentia against people who had already fled a state in which escape was criminalized. RELEASE (Neni 5) was equally discretionary — «Lenja e shtetesise shqiptare mund te behet vetem me leje te Presidiumit te Kuvendit Popullor» — exit from citizenship was possible only with Presidium permission. STATELESSNESS BY OPERATION OF LAW (Neni 9): residents who were not citizens under the decree and «nuk mund te provojne shtetesine e huaj, konsiderohen persona pa shtetesi» — could not prove a foreign citizenship were deemed stateless ( Neni 9, OCR). The downstream consequence carried to the present is stark and is stated as an honest negative: a person deprived under Neni 8 has NO restoration route in any successor statute — not in Ligj 8389/1998 and not in Ligj 113/2020 as amended through Ligj 49/2026 (see). The predecessor 1946 instruments (Ligje 377/1946 Art 13 absence-loss, Art 14 withdrawal) died unmatured at supersession, their loss function absorbed into Neni 8's open discretion.
