Elegibilidad
La puerta de elegibilidad es una puerta de clase de estatus, no un catálogo de residencia o condición. Según la única afirmación, Dekret 255/1992 (artículo 1, párrafo 1) abría la doble ciudadanía sólo a "nacionales extranjeros de nacionalidad u origen albanés", quienes podían adquirir la ciudadanía albanesa previa solicitud y, fundamentalmente, sin renunciar a su ciudadanía anterior. The status conferred was full Albanian citizenship, and the signature right attached to this route is the RETENTION OF THE PRIOR NATIONALITY — dual citizenship — which the 1992 additions granted for the first time in Albanian legal history, though only to the Albanian-origin class (GLOBALCIT-CR 2021/5 §2.5). Two boundaries matter. FIRST, the tolerance was PARTIAL and CLASS-SPECIFIC in 1992: GLOBALCIT records that unconditional dual citizenship 'for the first time in the history of Albania's citizenship' arrived only with the 1998 law, so between 1992 and 1998 the general population remained outside the dual-citizenship allowance ( §2.5). SECOND, the 1992 opening is the HEAD of a continuous permissive lineage that runs to the present: it was generalised by Ligj 8389/1998 Neni 3 — 'Shtetasi shqiptar mundet të jetë edhe shtetas i një shteti tjetër' ( Neni 3) — and that permissive default was carried forward by Ligj 113/2020, which imposes no renunciation condition, backed by the constitutional guarantee that an Albanian may lose citizenship only by voluntary renunciation: Kushtetuta Neni 19 pika 2, 'Shtetasi shqiptar nuk mund ta humbasë shtetësinë, përveçse kur ai heq dorë prej saj' ( Neni 19 pika 2). The 1998 statute also secured the continuity of already-held status — Neni 2(a): 'çdo person, i cili ka pasur shtetësinë shqiptare deri në hyrjen në fuqi të këtij ligji' remained a citizen — so 1992-era dual acquirers were not disturbed by the 1998 transition ( Neni 2).
