BG-RST-02 е възстановяване на българско гражданство на лишено лице по чл. 27 от Закона за българското гражданство (ЗБГ, обн. ДВ бр. 136/1998, в сила 20.02.1999), консолидиран до ДВ бр. 61/29.07.2025. Requisitos

There is NO residence requirement under чл. 27. This is one of the two defining features distinguishing the deprivation-restoration track (чл. 27) from the release-restoration track (чл. 26): чл. 26(1) т. 3 (нова ДВ бр. 41/2001, доп. ДВ бр. 21/2012) requires a permanent or long-term residence permit held for at least 3 years before the application — but чл. 27 attaches no such condition. Likewise the чл. 26(2) Bulgarian-origin exemption from that 3-year requirement, and the Наредба № 1 чл. 11(2) regulatory mirror of it, are features of the чл. 26 (release) track; under чл. 27 the residence question never arises regardless of origin, because the only test is the validity or continued relevance of the original deprivation ground.

Documentos

The restoration application is governed by Наредба № 1 от 19.02.1999 за прилагане на Глава пета от ЗБГ (обн. ДВ бр. 19/1999). Под чл. 11(1) (доп. ДВ бр. 51/2001; изм. бр. 35/2010, бр. 102/2017 в сила 01.01.2019, бр. 52/2018), the restoration молба must attach the documents listed in чл. 4(1) т. 1-4, 7-11, 13 and 14 — covering identity, proof of prior Bulgarian citizenship and the deprivation event (the чл. 24 указ + final conviction), a свидетелство за съдимост (criminal-record certificate) from the country of residence, and the state-fee receipt. Компетентни органи: (a) Министерство на правосъдието, Дирекция 'Българско гражданство и осиновявания' — receives and prepares the application (чл. 29(1)); (b) Съвет по гражданството (Citizenship Council, чл. 33) at the MoJ, chaired by a Deputy Minister, with members from MoJ, MFA, MoI, Min. Regional Development, Min. Labour & Social Policy, Min. Health, Min. Innovation & Growth, ДАНС (State Agency National Security), the State Agency for Bulgarians Abroad, and the State Agency for Refugees — gives the opinion (composition as of ДВ бр. 22/2022); (c) Министър на правосъдието — makes the чл. 34 proposal to the President; (d) Президент на Република България — issues the restoration указ (чл. 36; Const. чл. 98 т. 9 'дава и възстановява българско гражданство'). Exceptions & edge cases

Bulgaria PERMITS multiple nationality for its citizens: ЗБГ чл. 3 treats a Bulgarian who is also a foreign national only as Bulgarian under Bulgarian law (unless a law provides otherwise), and чл. 7(2) recognises 'право на избор на гражданство' (the right to choose citizenship). There is no automatic loss for acquiring another nationality. For BG-RST-02 specifically this is doubly relevant: the чл. 24 deprivation ground that feeds чл. 27 may ONLY be applied if the person 'не остава без гражданство' (does not become stateless) — so a deprived person necessarily holds (or held) another nationality, and on restoration under чл. 27 they may keep it. Restoration therefore typically results in dual nationality.

    Const. чл. 25(3) bars depriving a citizen BY BIRTH — so under current law a birth-citizen cannot be 'лишено', and чл. 27 (which presupposes a valid лишаване) would have nothing to restore. HOWEVER, persons deprived under the 1940 поданство Act or the 1948 ЗБГ were AUTO-restored ex lege on 20.02.1999 by §3 ПЗР; if his case falls in that historical cohort, his citizenship was already restored by operation of law and the route is re-documentation, not a чл. 27 application.     чл. 27 is the DEPRIVATION (лишено) branch only.
