Elegibilidad
La adquisición derivada por un menor es la alternativa por aplicación a la adquisición por nacimiento: a un menor que NO adquirió la ciudadanía georgiana al nacer se le concede según el procedimiento regular en el que uno de sus padres posee (o adquiere) la ciudadanía georgiana (artículo 13(1)). La regla distintiva del CBN es la puerta de consentimiento a los 14 años: la ciudadanía de un menor de 14 años o más puede cambiarse (excepto la pérdida) SÓLO con el consentimiento del menor (Art. 6), por lo que la adquisición derivada o adoptiva para un joven de 14 a 17 años requiere su consentimiento. La adquisición de derivados también puede ocurrir por acumulación: cuando a un ex ciudadano se le concede la ciudadanía mediante restauración bajo la ventana temporal del Artículo 32-2, la ciudadanía también se otorga a su hijo menor de edad que lo acompaña en los mismos términos.

Resumen

Derivative acquisition by a minor is the by-application alternative to acquisition by birth: a minor who did NOT acquire Georgian citizenship at birth is granted it under the regular procedure where one of his/her parents holds (or acquires) Georgian citizenship (Art 13(1)). The signature CBN rule is the age-14 consent gate — the citizenship of a minor aged 14 or older may be changed (other than loss) ONLY with that minor's own consent (Art 6), so derivative or adoptive acquisition for a 14–17-year-old requires their consent. Derivative acquisition can also occur by joinder: when a former citizen is granted citizenship by restoration under the temporary Art 32-2 window, citizenship is also granted to his/her accompanying minor child on the same terms.

  • Accompanying derivative acquisition on a parent's restoration: when a former citizen is granted citizenship by way of restoration under the temporary Art 32-2 window, citizenship is ALSO granted to his/her minor child; a child aged 14+ is granted on the basis of his/her own consent.
