Cohort A (pre-1947 British subjects): a person who was a British subject ordinarily resident in or connected to Canada immediately before 1 January 1947 may, under the transitional/historical provisions carried into the 1947 Act and the live s.3(1) chain, have become a Canadian citizen on 1947-01-01 or be treated as a citizen through the historical-citizen paragraphs. Cohort B (Newfoundland union): a person who was a British subject ordinarily resident in Newfoundland and Labrador and who met the union-transition conditions acquired Canadian citizenship on 1 April 1949, not on 1947-01-01. Eligibility is status-based and determined by operation of law as at the relevant historical date; it is not a discretionary grant. Because pre-1977 descent and registration rules were gender-discriminatory and produced 'Lost Canadians,' a given individual's status may have been lost or never recognized under outdated rules and subsequently restored by remedial legislation (C-37, C-24, C-3). The practical eligibility question is therefore whether the person (or their ancestor) held the qualifying historical status and whether any later remedial provision restores it.

Documents in languages other than English or French require certified translation per IRCC standards.

Citizenship status under this route arises by operation of law as at the historical date (1947-01-01 for the pre-1947 British-subject cohort; 1949-04-01 for the Newfoundland-union cohort), so no discretionary grant decision is made and there is no Ministerial 'authority' that confers the status itself. Citizenship is an exclusive federal head of power under s.91(25) of the Constitution Act, 1867 ('Naturalization and Aliens'). The administrative decision-maker for confirming that status is Immigration, Refugees and Citizenship Canada (IRCC), acting under the Minister of Citizenship and Immigration (Citizenship Act s.1, s.2(1)), when it issues proof of citizenship (a citizenship certificate) or completes a search of citizenship records. Dual citizenship interacts sharply with this route because the historical cohorts straddle the pre/post-1977 divide. Under the Canadian Citizenship Act, S.C. 1946, c. 15 (in force 1947-01-01) through 14 February 1977, a Canadian who voluntarily acquired a foreign nationality generally lost Canadian citizenship automatically, and British subjects received preferential treatment. From 15 February 1977 (commencement of the Citizenship Act, S.C. 1974-75-76, c. 108) dual citizenship has been permitted without restriction and the preferential British-subject status was removed; the current Act requires no renunciation of a foreign citizenship. Consequently, a person from a pre-1947 or pre-1949 cohort who took a foreign nationality before 1977 may have lost Canadian citizenship by automatic operation of the old law — but many such losses have since been reversed by the Lost-Canadian remediation arc (C-37, C-24, C-3), restoring citizenship by operation of law. The automatic-loss mechanism was distinct from a formal renunciation filing. A modern holder of historical-status citizenship may freely hold other nationalities.
