To qualify under Minor 5(2), as of 2026-06-01, the applicant child must: (1) be under 18 at the date of application ('minor' is defined at s.2(1) as a person under 18); (2) be a permanent resident under IRPA s.2(1), with no unfulfilled conditions attached to that PR status (s.5(2)(b)); (3) be the minor child of a Canadian citizen, OR have a parent who is applying for a grant of citizenship at the same time (the IRCC operational trigger for the 5(2) stream); (4) not be subject to a prohibition under s.22 (e.g., certain criminal charges/convictions or security grounds — rarely engaged for young children but applicable to older minors); and (5) take the Oath of Citizenship if 14 years of age or older (s.3(1)(c)). Critically, the child does NOT have to meet the s.5(1)(c)(i) 1,095-day physical-presence requirement, the s.5(1)(c)(iii) tax-filing requirement, the s.5(1)(d) language requirement, or the s.5(1)(e) knowledge (citizenship test) requirement — these do not apply to the 5(2) minor. Section 5(2) is framed in mandatory terms — the Minister 'shall grant' citizenship once the statutory conditions are met — so the grant is non-discretionary where eligibility is established, mirroring the adult s.5(1) grant; the discretionary elements in s.5 are confined to the s.5(3) waivers (which can, for a minor, waive the requirement as to who may apply, and waive certain requirements on compassionate grounds) and the s.5(4) special grant. Officer and Ministerial citizenship decisions are subject to judicial review in the Federal Court (the statutory 'Court' under s.2(1)), on the presumptive standard of reasonableness established by Canada (Minister of Citizenship and Immigration) v. Vavilov, 2019 SCC 65, [2019] 4 SCR 653. Correctness review is reserved for limited categories (e.g., constitutional questions and general questions of law of central importance). There is no internal merits appeal of a citizenship grant refusal; the remedy is judicial review.

Where an applicant cannot meet a procedural requirement (such as who may apply on the child's behalf), the s.5(3) compassionate-waiver mechanism — itself reviewable on reasonableness — may be engaged rather than the judicial-review route.
Exceptions & edge cases
Canada permits dual (and multiple) citizenship without restriction, and has done so since the Citizenship Act (S.C. 1974-75-76, c.108) came into force on 15 February 1977. A minor who becomes a Canadian citizen through a s.5(2) grant therefore does NOT have to renounce any existing foreign nationality, and the child may lawfully hold Canadian citizenship alongside one or more other citizenships. Whether the child's other country of nationality permits dual citizenship is a question of that country's law, not Canadian law; some states automatically withdraw their nationality on the voluntary acquisition of another, while others permit dual status — this must be checked against the other state's rules, and Canada does not require proof of the foreign country's position. The current Citizenship Act contains no provision requiring renunciation of a foreign citizenship upon a grant, and there is no automatic loss of Canadian citizenship on later acquiring or holding a foreign nationality (loss occurs only by renunciation under s.9 or revocation for fraud under s.10/10.1). For a child, renunciation under s.9 is in any event generally unavailable while the person is a minor.
