This route documents how persons of Italian descent living in Mexico may access Italian citizenship through the Italian unilateral jure sanguinis framework — and specifically how the 2025 Italian legislative reforms (Legge 74/2025) retroactively narrowed those access pathways. No bilateral Mexico-Italy nationality treaty exists: this was a FATAL caught in P1-C (MX-). The 1971 Italy-Argentina doppia cittadinanza treaty is the ONLY Italian bilateral nationality treaty with a Latin American country; it has no Mexico counterpart.

The Italian jure sanguinis framework has evolved through four instruments in rapid succession:

  1. L. 555/1912: Original Italian citizenship law (operative 1912-1992) — patrilineal-only transmission
  2. Legge 91/1992: Modernized framework; Art 11 (recognition) and Art 13 (naturalization); introduced matrilineal transmission; EIF 1992-08-16
  3. Decreto-Legge 36/2025: Emergency decree EIF 2025-03-29 (the "vincolo effettivo" reform)
  4. Legge 74/2025: Parliamentary conversion of DL 36/2025; EIF 2025-05-24 — the operative current law

The Legge 74/2025 cutoff effect: Persons who had not yet filed a citizenship recognition claim in Italian court or at the consulate before 2025-03-27 23:59 Rome time (the eve of DL 36/2025 entry into force) are now subject to the new two-generation limit and two-year parent-residence requirement. Persons who had filed before this cutoff retain access to the pre-reform unlimited-generation framework under transitional provisions.

Post-reform two key requirements for new claimants:

  1. 2-generation limit: Only first or second generation from the Italian ancestor are eligible for jure sanguinis recognition; third-generation+ must naturalize
  2. 2-year parent residence: The Italian-citizen parent must have resided in Italy for at least 2 years at any point

  • Unlimited generational jure sanguinis under Legge 91/1992 Art 11 (recognition by descent)
  • No 2-generation limit; no 2-year residence requirement
  • Standard documentation chain from Italian ancestor through each generation

Post-cutoff claimants (filed from 2025-03-28 onward):

  • Maximum 2 generations from the Italian ancestor
  • The Italian-citizen parent must have resided in Italy for at least 2 years at any point in their lifetime
  • Vincolo effettivo: "effective connection" requirement — the Italian ancestry must be within 2 generations
  • Third-generation+ must pursue Italian naturalization through the standard Italian pathway (10 years residency in Italy or other qualifying ground)

Documentation requirements (both pre- and post-cutoff):

  • Acta de nacimiento of Italian ancestor (apostillated or consular certified)
  • Marriage certificates at each generational link
  • Birth certificates at each generational link
  • Evidence of Italian ancestor's citizenship at time of birth of the transmitting child
  • For post-2025 claims: Italian ancestor's residence in Italy for 2+ years (passport stamps, registry records, municipal registration records)

  1. Obtain appointment at Italian Embassy (CDMX) or circoscription consulate — waiting lists were extensive pre-reform; post-reform demand may shift
  2. Submit documentary chain with apostilles/certifications; Italian Embassy reviews; if approved, transmits to relevant Comune in Italy for registro
  3. Comune issues Italian birth certificate and Italian identity documents

Judicial pathway (pre-reform, now restricted):

  • Pre-2025-03-27: Italian courts (Rome Tribunale was primary venue for diaspora claims) accepted petitions for jure sanguinis recognition without consular appointment bottleneck; massive diaspora-recognition case volume had developed
  • Post-Legge 74/2025: Italian courts' jurisdiction for diaspora recognition cases from abroad was sharply restricted; primary pathway now reverts to consular route
