Adoption by Icelandic citizen (under 18, adoption in Iceland)

A child acquires Icelandic citizenship automatically by adoption when the adoption satisfies the requirements of Act 100/1952 §2 a (as rewritten by L. 61/2018). The automatic-acquisition character of this route is critical — unlike naturalization routes, the adoptive parent does not file a separate citizenship application; citizenship attaches by operation of law upon the adoption recognition [pins: + +].

The two operative pathways under §2 a:

Pathway A — Adoption license issued in Iceland (sýslumenn)

Where the adoption is processed by an Icelandic district magistrate (sýslumaður) and an adoption license (leyfi til að taka barn að) is issued under Icelandic adoption law, citizenship is acquired automatically upon issuance of the license. The adoptive parent must be an Icelandic citizen [pins: + +].

Pathway B — Foreign adoption recognized in Iceland

Where the adoption was effected abroad and subsequently recognized under Icelandic law, the child acquires Icelandic citizenship upon the recognition. Recognition is the operative legal event — the adoption recognition by sýslumaður under Icelandic international private law rules triggers citizenship acquisition [pins: +].

Age threshold

The child must be under 18 years of age at the time the adoption license is issued (Pathway A) or at the time the foreign adoption is recognized in Iceland (Pathway B). Adoptions of persons who have already attained age 18 at the relevant date do not fall under §2 a and do not confer automatic citizenship [pins: +].

Consent requirement for children aged 12 and over

Per Act 100/1952 §2 a as updated by L. 145/2013 and L. 61/2018: if the adoptee is 12 years of age or older and currently holds foreign citizenship, the adoptee's own written consent to acquire Icelandic citizenship is required before citizenship can be confirmed. This consent requirement reflects Iceland's harmonization with international child-rights standards [pins: + +].

If the child is under 12, or if the child does not currently hold foreign citizenship, the consent requirement does not apply.

Parent's citizenship tenure

The adoptive parent must be an Icelandic citizen at the time of the adoption. There is no minimum tenure requirement for the parent's own citizenship in order to transfer citizenship via adoption (distinct from IS-NAT-03/IS-NAT-04 routes where a 5-year tenure requirement applies) [pins: +].

5. Para crianças com mais de 12 anos com cidadania estrangeira existente — documento de consentimento por escrito apresentado à autoridade de registro antes que a cidadania seja formalmente registrada em Þjóðskrá
