Quem se qualifica
Under Act 100/1952 §3 (as rewritten by L. 61/2018 art 3 EIF 2018-07-01), a foreign national who has been continuously resident in Iceland since age 13 is entitled to acquire Icelandic citizenship by filing a written declaration (tilkynning) with UTL between the age of 18 and 21 [pins: + +].
The operative conditions are:
- Foreign national: applicant is not currently an Icelandic citizen
- Resident in Iceland since (at the latest) age 13: continuous lögheimili registration in Iceland from age 13 through the declaration filing date
- Declaration filed between ages 18 and 21: the window opens on the applicant's 18th birthday and closes on the 21st birthday. Filing before age 18 or after age 21 renders the declaration ineffective
- No fangelsi (imprisonment) or öryggisgæsla (security custody) during the period: the applicant must not have been sentenced to imprisonment or security custody in Iceland during the residency period [pins: +]
Continuity of residence
"Continuously resident" is measured by lögheimili (legal domicile) registration in the National Registry (Þjóðskrá). The L. 61/2018 framework is interpreted in light of the Lögheimili-Act L. 80/2018 (EIF 2019-01-01) definitions of domicile continuity. Short absences for education, family visits, or temporary stays abroad would not necessarily break continuity if lögheimili remained registered in Iceland, but extended absences with deregistration could [pins: +].
Criminal record condition
The absence-of-imprisonment condition is a binary test — any imprisonment or öryggisgæsla sentence during the period disqualifies the declaration. This is distinct from the §9.a biðtími graduated table applicable to naturalization routes: there is no fine-based exclusion and no graduated waiting period under §3. The condition is that the applicant must not have been sentenced to imprisonment or öryggisgæsla — it is not clear from the statutory text whether a sentence entirely served before the declaration window would disqualify; administrative practice should be verified with UTL [pins: +].
No permanent-residence-permit prerequisite
Language test inapplicable
The A2 CEFR language test required under §9(1)(3) for naturalization does NOT apply to §3 declaration routes. The declaration route bypasses the §9(1) eligibility conditions applicable to §7/§8 naturalization [pins: +].
Documentos
- Identity documents (passport or equivalent)
- Þjóðskrá extract confirming continuous registration since age 13
- Declaration form (tilkynningarbréf) submitted to UTL
- Sakavottorð or UTL self-check — confirmation of no imprisonment/öryggisgæsla sentence
- Proof of age (birth certificate or passport)
- L. 61/2018 EIF 2018-07-01 — §3 declaration framework's current form (gender-neutral; §3 rewritten to expand and clarify declaration routes including the 13-year continuous residence variant and the stateless 3y variant)
- L. 11/2020 — §9.a biðtími table added to Act 100/1952 for naturalization routes; does NOT add biðtími to §3 declaration routes (different criminal-record test applies)
Pending reforms
- Þingskjal 17/157 deprivation bill — introduces post-grant deprivation provisions applicable across acquisition routes; would apply to citizenship acquired via §3 declaration [pins: +]
