Overview

This route covers Belgium's vestigial military service framework and its (lack of) connection to nationality. Compulsory military service in Belgium ended in 1992. The Loi du 23 mai 2024 updates the reservist-obligation framework that remains in place.

The defining feature of this route is what it is not: military obligations in Belgium are not conditioned on nationality after 1992. Naturalized citizens carry the same obligations and rights as native-born Belgians, and there is no military-service pathway to, or precondition for, Belgian nationality.

Belgian nationality is an exclusive federal competence (Constitution, Article 8) and is administered through the Code de la nationalité belge (CNB) — the Loi du 28 juin 1984 — as subsequently amended. Within that framework, acquisition of nationality is handled through Belgium's federal, trilingual administrative structure, with the relevant linguistic community (French, Dutch, or German) determining the language of the procedure. Filings are made at the municipal civil status office, with input from the Procureur du Roi and decisions taken at the ministerial or parliamentary level depending on the basis of the application.

In short, BE-MIL-01 documents that Belgium's residual reservist obligations operate independently of citizenship status and do not create a distinct route to Belgian nationality.

Who qualifies

Military-service track is vestigial in modern BE nationality law: compulsory service ended 1992 (Loi 31 décembre 1992) and reservist obligations remaining post-1992 are NOT nationality-conditioning. Historical military-service nationality routes under Loi 1909/1932/1984 are closed for new applications; Loi 23 mai 2024 updates reservist obligations without nationality effect.
