- Involuntary loss of Bulgarian citizenship reaching ONLY naturalized citizens (Конституция чл.25(3) absolutely bars deprivation of birth-citizens). Revocation of naturalization (отмяна, чл.22) for judicially-established false data (т.1), concealment of disqualifying data (т.2) or failure to notify a чл.32а change (т.3) — admissible only within 10 years of acquisition and only if the person is not left stateless, EXCEPT a terrorism carve-out (чл.22(2)) that removes the 10-year bar where the facts relate to participation in terrorism (1-month expedited track в сила 31.01.2026). Deprivation (лишаване, чл.24) where a naturalized citizen abroad is finally convicted of a grave crime against the Republic and is not left stateless. No spillover to spouse/children (чл.23/чл.25). Effected by presidential указ; constrained by EU-law proportionality (TFEU Art 20). The former investment-non-maintenance revocation ground (чл.22(1)т.4) was repealed by ДВ бр.26/2022.

- Statutory PROPOSAL deadline (чл.35(1)): 3 months (т.6) for отмяна на натурализация and лишаване; 1 month (т.7, изм. ДВ бр.61/2025, в сила 31.01.2026) for the expedited terrorism-related track where чл.22(1)т.1/т.2 facts relate to terrorism or the final sentence is for НК чл.114а–114т. These are the deadlines for the Minister of Justice's proposal to the President after the Council's opinion; the President's указ itself enters force on the day of issuance (чл.36). Real-world duration is longer and case-driven because the predicate must mature first: revocation under чл.22(1)т.1 needs a prior court ruling establishing the data as untrue, and deprivation under чл.24 needs a final criminal conviction (both can take years). The Council may suspend, and the чл.35 deadlines are suspended accordingly, where facts must be established (чл.33, нова ДВ бр.21/2021). The 10-year revocation window (чл.22(2)) caps when an ordinary (non-terrorism) revocation may even commence.

Overview
BG-XCT-02 е маршрут за ЗАГУБВАНЕ (loss/expatriation) на българско гражданство, а не за придобиване. Той обхваща двата принудителни (недоброволни) механизма по Глава трета на Закона за българското гражданство (ЗБГ): отмяна на натурализацията (чл.22) и лишаване от гражданство (чл.24). И двата достигат САМО до натурализирани граждани — гражданите по рождение (по произход чл.8 и по месторождение чл.10) са абсолютно защитени от Конституция чл.25(3). Отмяната санира опорочено придобиване (неверни/укрити данни или неуведомяване по чл.32а); лишаването е наказателна мярка за тежко престъпление против републиката, извършено от натурализиран гражданин, който се намира в чужбина. Никой не може да остане без гражданство (1961 Конвенция, страна от 22.03.2012). Актът се извършва с указ на Президента (чл.36). This is a LIVE loss route as of ЗБГ ДВ бр.61/29.07.2025.
Who qualifies
Тъй като това е маршрут за загуба, 'допустимостта' означава кога държавата МОЖЕ да отнеме гражданството и кои защити са абсолютни. ОБХВАТ: само лица, придобили българско гражданство ПО НАТУРАЛИЗАЦИЯ; гражданите по рождение са изключени (Конституция чл.25(3)). ОТМЯНА (чл.22(1)): т.1 данни/факти, установени по съдебен ред за неверни; т.2 укрити данни, които биха били основание за отказ; т.3 неуведомяване за промяна по чл.32а. Времеви праг: само до изтичане на 10 години от придобиването (чл.22(2)), освен при тероризъм. ЛИШАВАНЕ (чл.24): кумулативно — (i) натурализиран гражданин; (ii) влязла в сила присъда за тежко престъпление против републиката; (iii) лицето се намира в чужбина; (iv) не остава без гражданство. Без разпростиране върху съпруг/деца (чл.23/чл.25), освен ако са придобили на същото невярно основание.
Requirements
No qualifying residence period attaches to a loss route — instead a TEMPORAL ADMISSIBILITY WINDOW governs revocation. Под чл.22(2) отмяната на натурализацията е допустима 'само до изтичане на 10 години от придобиване на българското гражданство'. След изтичането на този 10-годишен срок ordinary revocation is time-barred. The single exception is the terrorism carve-out: когато данните/фактите по ал.1 т.1 и 2 или промяната по т.3 'се отнасят до участие на лицето в тероризъм', the 10-year limit does NOT apply (чл.22(2), доп. ДВ бр.21/2021). For DEPRIVATION (чл.24) there is no statutory 10-year window; the operative condition is the person's physical presence abroad (се намира в чужбина) at the time, plus a final conviction. The chл.22(2) window runs from the date of acquisition of citizenship, not from discovery of the fraud.

There is no applicant-facing document checklist: загубването по чл.22/24 is State-initiated, not application-based, so Наредба №1/1999 forms (Прил. №1 натурализация, №2 възстановяване, №3 освобождаване, №5 чл.39) do NOT cover the loss side. The evidentiary record is assembled by the proposing authority: за отмяна по чл.22(1)т.1 — съдебно решение, установяващо неверността на данните; за т.2 — доказателства за укрити дисквалифициращи факти; за т.3 — доказателства за промяна по чл.32а; за лишаване по чл.24 — влязла в сила присъда за тежко престъпление против републиката + доказателство, че лицето се намира в чужбина. За двата случая е задължително доказателство, че лицето НЕ остава без гражданство (наличие на друго гражданство). Procedurally required: писмени мнения на МВР и ДАНС (чл.33(3)) и мнение на Съвета по гражданството (чл.34).
How to apply
Процедурата по загуба (чл.31-36): (1) PREDICATE matures — for revocation, a court ruling establishing untrue data (чл.22(1)т.1) or evidence of concealment/non-notification; for deprivation, a final criminal conviction (влязла в сила присъда, чл.24). (2) PROPOSAL — предложението се прави от Главния прокурор (чл.31(1)); ако са налице условията по чл.22/24, и Министърът на правосъдието може сам да направи предложение (чл.31(2), изм. ДВ бр.41/2001). (3) COUNCIL — Съветът по гражданството дава мнение след задължителни писмени мнения на МВР и ДАНС (чл.33(3)); може да спре производството и сроковете по чл.35 (чл.33, нова ДВ бр.21/2021). (4) MoJ→President — Министърът на правосъдието прави предложение до Президента за издаване или отказ на указ (чл.34). (5) DECREE — Президентът се произнася с указ (чл.36), който влиза в сила от деня на издаването. Срокове за предложение: 3 месеца (чл.35(1)т.6); 1 месец за тероризъм (чл.35(1)т.7, в сила 31.01.2026).

The presidential указ itself enters force on the day of its issuance (чл.36). Real-world duration is materially longer and case-driven, because the predicate must mature first: a чл.22(1)т.1 revocation needs a prior civil/criminal court ruling establishing the data as untrue, and a чл.24 deprivation needs a FINAL criminal conviction — both can take years through the court system. The Съвет по гражданството may suspend the proceeding (and the чл.35 deadlines correspondingly) while facts are established (чл.33, нова ДВ бр.21/2021). The 10-year revocation window (чл.22(2)) caps when an ordinary (non-terrorism) revocation may even be commenced.
Fees & cost
No state fee is levied on the affected person, because the loss procedure is State-initiated (by the Prosecutor General or the Minister of Justice), not application-based. Тарифа № 1 към Закона за държавните такси (раздел 'Г. Такси, събирани от Министерството на правосъдието', приета ПМС № 167/1992, last amended ПМС № 104/25.06.2025, ДВ бр.52/2025) charges fees only on applications for придобиване/възстановяване (т.55), освобождаване (т.56, 250 BGN ≈ 127,82 EUR) and чл.39 certificates (т.57, 250 BGN) — none of which applies to отмяна/лишаване. A чл.37 certificate documenting the change of citizenship is a downstream administrative document. Euro framing: any BGN figure dated before 2026-01-01 converts at the irrevocable rate 1 EUR = 1.95583 BGN; euro is sole legal tender from 01.02.2026. No Тарифа №1 line maps to a loss-procedure applicant fee — consistent with the absence of any applicant in a State-initiated loss.

Legal anchor: ЗБГ Глава трета 'Загубване на българско гражданство' — Раздел II Отмяна на натурализацията (чл.22-23) + Раздел III Лишаване (чл.24-25). чл.24 verbatim: 'Лице, което е придобило българско гражданство по натурализация, може да бъде лишено от него, ако е осъдено с влязла в сила присъда за тежко престъпление против републиката, при условие че се намира в чужбина и не остава без гражданство.' Constitutional ceiling: Конституция чл.25(3) 'Български гражданин по рождение не може да бъде лишен от българско гражданство' (original 1991, UNAMENDED — only чл.25(4) extradition was ever amended, ДВ бр.18/2005). Competent authority
Initiating proposer: Главен прокурор (Prosecutor General, чл.31(1)), or the Министър на правосъдието (Minister of Justice) where the чл.22/24 conditions are met (чл.31(2)). Advisory body: Съвет по гражданството (Citizenship Council) at the Ministry of Justice (чл.33), chaired by a Deputy Minister of Justice, composed of representatives of MoJ, МВнР, МВР, МРРБ, МТСП, МЗ, Министерство на иновациите и растежа, ДАНС, ИАБЧ and the State Agency for Refugees; it opines after the mandatory written opinions of МВР and ДАНС (чл.33(3)). Proposing minister to the head of state: Minister of Justice (чл.34). Final decision-maker: Президент на Републиката by указ (чл.36; Конституция чл.98 т.9) — in practice exercised through the Vice-President's delegated citizenship competence. Predicate fora: the criminal courts (final conviction, чл.24) and civil courts (ruling establishing untrue data, чл.22(1)т.1); judicial review and CJEU proportionality frame control of the loss.
Exceptions & edge cases
Bulgaria tolerates dual nationality and there is NO automatic loss of Bulgarian citizenship on acquiring a foreign one. ЗБГ чл.3: 'Български гражданин, който е и гражданин на друга държава, се смята само за български гражданин при прилагането на българското законодателство, освен ако в закон е предвидено друго.' This makes BG-XCT-02 critical to understand: the ONLY ways to lose Bulgarian citizenship are the three express modes (release чл.20 / revocation чл.22 / deprivation чл.24) — never the mere fact of holding or acquiring a second nationality. Conversely, the not-stateless condition in both чл.22(2) and чл.24 means a SECOND nationality is what makes revocation/deprivation legally possible: a person whose only nationality is Bulgarian cannot be revoked or deprived even where a ground otherwise exists, because that would breach the 'не остава без гражданство' floor and BG's 1961 Reduction Convention obligation (accession 22.03.2012).

Outside чл.24 on the statutory text. чл.24 requires the cumulative condition 'при условие че се намира в чужбина' — physical presence abroad. A naturalized convict who is in Bulgaria fails the abroad condition, so deprivation under чл.24 is not available on the face of the statute (the other conditions — naturalized, final conviction, not-stateless — being met). Within reach: revocation under чл.22(1)т.1 (данни, установени по съдебен ред за неверни) is available because (a) the predicate court ruling exists, (b) the acquisition is within the 10-year window (чл.22(2)), and (c) the person is not left stateless (holds a second nationality). Outcome is conditional because it requires the Prosecutor-General/MoJ proposal (чл.31), the Citizenship Council opinion (чл.33), a presidential указ (чл.36), and — as a loss of Union citizenship — an individualized EU-law proportionality assessment (Rottmann C-135/08). Cannot be deprived. Конституция чл.25(3) absolutely bars deprivation of a citizen 'по рождение' ('Български гражданин по рождение не може да бъде лишен от българско гражданство'), and чл.24 by its terms reaches only a person 'придобило българско гражданство по натурализация'. Cannot be revoked despite a valid чл.22(1)т.2 ground. чл.22(2) makes revocation admissible only 'при условие че лицето не остава без гражданство' — the not-stateless floor. Because the person holds only Bulgarian nationality, revocation would render them stateless, which is barred (and would breach BG's 1961 Reduction Convention obligation, accession 22.03.2012). Time-barred. чл.22(2) limits ordinary revocation to '10 години от придобиване на българското гражданство'.
