Who qualifies
Cohort eligibility (pre-1999): persons recognised as Statusdeutsche under GG Art 116(1) Var 2 — typically (a) German-Volkszugehoerige Vertriebene (expellees) from former Ostgebiete (territories east of the Oder-Neisse line and Sudetenland/Karpatenukraine, ceded to Poland/Soviet Union/Czechoslovakia under 1945 Potsdam Conference and confirmed by 1990 Two-Plus-Four Agreement); (b) accompanying spouses (Ehegatten) of such Vertriebene; (c) Abkoemmlinge (descendants) born in Germany (BRD) or German-Polish/Czech/Soviet-occupied 1937-borders territory who received Statusdeutsche recognition. Distinction from Spaetaussiedler: Vertriebene typically arrived pre-1953 or via specific post-war repatriation programmes; Spaetaussiedler post-1990 Soviet-collapse cohort. § 40a closure: as of 1999-08-01 reform effective date, all persons holding active Statusdeutsche recognition acquired full StAG citizenship ex lege; no application required. How to apply
No procedure was required for the principal § 40a transition — citizenship status changed by operation of law at 1999-08-01 reform effective date for all then-Statusdeutsche. Subsequent administrative perfection: (1) issuance of unified German Personalausweis/Reisepass reflecting full StAG status (where pre-1999 documentation had reflected only Statusdeutsche); (2) Staatsangehoerigkeitsurkunde issued on request by Land Einbuergerungsbehoerde to confirm § 40a acquisition. Special-cohort processing: (a) Vertriebene who had received pre-1999 individual § 7 grants: no impact — already StAG citizens; (b) Vertriebene who had never sought individual perfection: § 40a auto-perfected status; (c) recently-deceased Statusdeutsche pre-1999-08-01: status terminated at death; § 40a not retroactive to pre-death status — though descendants may still claim under § 4(1) where parent had been Statusdeutsche; (d) Vertriebenenstatus claims first-arising post-1999 (rare): processed via standard BVFG framework with § 40a not directly applicable.
